She will get a cost on a 1,C'JO septic tank with installation. • Councilman Achilles suggested having Chuck Hubbell; or someone, come up with a cost to bring the present building to a usable standard, whether it be with partitions or whatever. Councilman Clark said we need a long-range plan. He felt$250,000 was all he could justify spending,if a commitment had to be made. Alfred Eddy noted that we had a minimal amount of space, no parking, we were on a side hill, and basically had no room to expand. Joe Scherer agreed with Dougherty that we had to be proactive and have a"vision" for Enfield's future. o s ai ay Gravel Mine Norm Pure and Deena Wickstrom spoke of a "gravel pit community" meeting they had had last Saturday and asked the Board.to take an interest in the gravel pit events. Dougherty said the Board needed to be kept abreast of their meetings and asked for a chronology of happenings todate. There were no Board members invited to the Saturday meeting, Pure or Wickstrom will pull together something for the Board and give it to Owens for distribution. Su ervisor Owens has spoken with Mike BarYlski, Deputy Regional Permit Administrator for the DEfand a ppermit has not been issued. The DEC will come before the Town Board before a permit is issued. Doughe asked that Attorneeyy Randy Marcus be present when the DEC is here. VanNederynen felt that we didn't need to use$125/hour of the Town's money to have the attorney in attendance. Town 0u e i uces Achilles mentioned several bills that seemed to be appropriated to the wrong accounts. Owens offered to get together with Achilles and show him the account numbers and what went into each account. Achilles has set the Town Budget up on his computer in an effort to personally keep track of expenditures. SStS ant luildinia Code Enforcement Officer Jesse Buchanan was appppointed Assistant Building Code Enforcement Officer to Roger Rumsey at a yearly salary of$V50. Councilman Clark read the minutes of the Februaryy 1%r meeting where the appointment was announced. The appointment was effective 2/15/95. Neither Rurnsey nor Buchanan were present at the 2/15/95 meeting. Ire Denartment Liaison Council VanNederynen attended the February Fire Department meeting. The Fire • Department will not be sending out a newsletter at this time. They will be formulating guidelines for Enfield residents who are building/obtaining new residences to help them make their homes more assessable in cases of emergency. 26 Special Town Board Meeting February 15, 1995 Present: Supervisor Jean Owens, Councilmen Pat Dougherty, Linda VanNederynen Gary Achilles, Lanny Clark, Highway Superintendent Ron pdike, House Enumerator Peggy Hub6e!I Town Clerk Alice Laue was ill and Deputy Town Clerk Michelle Kemp was unable to attend to Councilman Dougherty was appointed to take minutes. community ui in Supervisor Owens opened the meeting by reiterating the history of the renovation of the community building from the time that she proposedf sending$42,000 for upgrading the existing roof to the present plan proposed by John Be o nson Cayuga Architects. Charles Hubbell was the bid winner on the original proposal. The Community Council has applied for a $100,000 grant which, if received, would greatly help with the upstairs.portion of the renovation and a grant for$25,000 to do the vault(storage area) may also be forthcoming. Supervisor Owens says she has spoken with the fire_department regarding a property easement for use with the day care portion of the project and they are,in agreement. Councilman Dougherty asked the size of the property. Owens said she did not hae that information with her. (Dougherty-has since found out the size--130'00'.) Jean spoke with Christian Nielson from Finest Homes of Graham Road. He is presently doing the AII.Saints Church in Lansing and told Jean he might be able to.do the project for around $300,000. He was present at the meeting and invited anyone interested to come look at the Lansing project. He left his business card with the members of the Board. Councilman Achilles motioned that we proceed with the original "roof repair" project. After the discussion, Achilles withdrew his original motion stating that he had changed his mind. The roof renovation would not make the building any more usable than it presently is. Councilman VanNederynen feels we're at a crisis as far as "office usage" is concerned. • Uhe feels a "one shot" building is necessary. "We're a growing town and maybe we should consider bonding for a new building," she said. Owens asked VanNederynen what her suggested timetable might be. VanNederynen said when the grants are denied or received. Councilman Dougherty felt that if we are going to bond to the tune of$500,000 she would rather see it spent on roads that are used by all Enfield residents. 62 1 ENFIELD TOWN BOARD MEETING MINUTES WEDNESDAY, FEBRUARY 1, 1995 6:30 P. M. The regular meeting of the Town Board of the Town of Enfield was held Wednesday, February 1,. 1995 at the Enfield Community Building, 182 Enfield fain Road, Ithaca, N. Y. at 6:30 p.m.. Supervisor Ovens presiding. Present: Jean Owens, Supervisor Pat Dougherty, Councilman Linda VanNederynen, Councilman Garry Achilles, Councilman Lanny Clark; Councilman Others Present: Ron Updike, Highway Superintendent Peggy Hubbell, Housing Enumerator Randolph Warden, Town Justice Alice Laue, Torun Clerk Pledge of Allegiance: Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. Approval of the Minutes: Motion made by Councilman Achilles and seconded by Councilman Clark that the Town Board of the Town of Enfield approve for adoption the minutes of the regular Town Board meeting held January 4th, 1995. Carried Unanimously Communications: Letter from Caroline Supervisor Spaulding address the challenge of the town to maintain a a road previously classified as seasonal. asking for our support. Letter from Assemblyman Marty luster informing us of his knowledge of the problem, he is reintroducing a bill and is asking for the town's input. Privilege of the Floor: Norman Pure, 262 Gray Road Proposed Bailey Gravel Pit • Contacted an organization called citizens Environmental Coalition Statewide Mining Network. Things pointed out that the town needs to be concerned with are: The DEC and the agency that deals with the Reclamation Act and Solid Waste sign a memorandum that opens up the reclamation of mines to any type of fill that the 263 MINUTES OF TOWN BOARD MEETING -February 1, 1995 2 applicant wants to put there, i.e. garbage, construction waste, tainted soil. Applicants have the right to do with out approaching the town. Applicant also has the right, if application is for five acres and permit is ,granted, to open up the entire property at that • point regardless of whether there is a stream involved or any other perimeters. Application at that point is between Bailey, Mobbs and the DEC to extend;the site size. Things this organization has used in the past and suggested we look into are: Enforcing road usage regulations, since the town roads bound the property, any truck leaving would.have to use town roads before reaching county roads. If it is the inclination of the Town and the Town Board to stop this they should heavily press the DEC to deny the permit outright or request a positive declaration from Bailey and Mobbs, which nears requesting,a full fledged environmental impact statement. Mr. Pure is obtaining the name of a lawyer who works for the C. E. C. This lawyer has done research to show the towns the power they do have in this type of situation. Things being heard from DEC and information gathered saying we don't have power because there is no zoning and because this is a DEC regulation is not necessarily true. Lawyer's name will be given to Supervisor Owens. Need to push Public Health and Safety issue because of increased traffic. Town has power to change Reclamation Law which now stands between $1,000 and $2,000 an acres. Up it to$10,000 or more an acre upfront to hold applicants accountable. If permit is approved, applicants would have $50,000 - $80,000 on the line to reclaim the property as stated in the application agreed upon by the town. C. E. C. states that gravel mines are bad news and are getting worse because the DEC is getting lacks ,about enforcing their own regulations and permits. If we, as the town, stand together and push this there is a better shot at stopping it before it becomes something we don't have control over. John Ehbar - Town Highway Department should be concerned because of extra heavy travel on town roads that would be used. Ron Updike - Highway Superintendent Discussed this at last meeting when applicants were here. Response given was post roads. Town could post roads to weight which would eliminate them from using town roads. As a result of that meeting, they verbally agreed to set down and set out a route. If all gravel is going to Ithaca they could go down that shrt spur of S. VanDorn Board on to Route 327 and go either way on the state roads. Superintendent Updike is waiting to see how this progresses, if permit goes through, he will be sitting down with Mr. Mobbs and get this down on the table so we can protect our roads. Our roads won't stand up to this weight. LSG 3 MINUTES OF TOWN BOARD MEE'i ING - February 1., 1995 After further discussion it was the understanding that someone from DEC would be coming down to look at the concerns and evaluate the concerns on site. Town needs to take a more active part. • Consensus- Town attorney needs to be made aware of situation. A strong letter from town attorney to DEC stating that the Town Board realizes that things were not done in the proper sequences. Town Board would like the process to start again or at least meet with a representative of the DEC, in person, to discuss this matter with the town lawyer present needs to be written. Norm Pure is to be in contact with Town Attorney Mulvey about information he has obtained. Jack Hubbell - 134 Hubbell Drive Town Board members have a copy of his annual Historian's report. One issue that needs to be addressed - A step has been taken forward in getting the records in shape and this should continue regardless of whether there is forth coming grant money or not. COMMITTEES: Code Enforcement/Junk Cars - Supervisor Owens reported Code Enforcement Officer Rumsey has a candidate he would like the Town Board to talk with for the Code Enforcement Assistant's position. Councilman Clark - Chair of committee is to schedule a meeting. Committee members are Councilman Achilles, Supervisor Owens, Code Enforcement Officer, Fire Company Representative and Councilman Dougherty. Two letters of violation of the Junk Car Law have been issued. Commemorative Committee - Janet Morris Book is in rouge draft. Enfield Community Council - Elected new president, Karen Anderson. Fredi Shapiro, Vice-President, Sheila McCue, Treasure. Secretary position to be filled. To open roads of communication to everyone in the town is a goal for the year. Supervisor Owens has been meeting extensively with members of the Community Council and others whn are working on the Day Care Center grant application due next week. Enfield Fire Company - Dominic Seamon Not much to report this time of year. One reinstated member-Jeff VanEtten. New member of Enfield Volunteer Fire Company Board of Directors, Gregg Stevenson introduced. 265 MINUTES OF TOWN BOARD MEETING - February 1, 1995 4 Councilman VanNederynen attended Board of Director's meeting. Discussed several old issues. • Highway: Superintendent Ron Updike Traveled roads with snowplows, since Fall, a total of five times. Last year in the month of January traveled roads thirty-three time. Hauling stones, patching pot holes, doing maintenance and mechanical work. Permit from DEC for working in streams has been received. Councilman VanNederynen and Highway Superintendent Updike attended a meeting at the school in regards to flashing school beacons. Mike McClellan to contact Syracuse Sign Company for prices of beacons. We need to fill out a permit to work in the state right-of-way N town is going to be involved. Security bond of $1,000 needs to be obtained by the town. Town won't be doing actual work, will be overseeing work done. School district agreeing to bear everything they can. Cost of beacons, cost of boring across highway will be major expenses. Assemblyman Luster has member item money to pay for this project in its entirety. Councilman VanNederynen suggested to school principal that she pursue all avenues about school paying bills and town,obtain security bond and permit. Motion made by Councilman Achilles and seconded by Councilman VanNederynen that the Town Board of the Town of Enfield secure security bond and fill out permit application. Carried Unanimously Further action tabled until more information is available. Highway Superintendent requested a Cooperative Purchase of Highway Services with the County resolution. Councilman Dougherty made the motion wick was seconded by Councilman Achilles that the Town Board of the Town of Enfield approve for adoption a resolution for authorization to participate in cooperative purchasing of highway services with Tompkins County. RESOLUTION#4: COOPERATIVE PURCHASING OF HIGHWAY SERVICES WITH COUNTY: WHEREAS, the Office of the State Comptroller has ruled that counties may no longer • extend their bids for public work (services) to political subdivisions, and 266 MINUTES OF TOWN BOARD MEETING - !February 1, 1995 5 WHEREAS, General Municipal Law, Article 5-G, Section 119-0 states that"any agreement entered into hereunder shall be approved by each participating municipal corporation or district by a majority vote of its governing body: now therefore be it RESOLVED, That the Town of Enfield be hereby authorized to,participate with Tompkins County in the cooperative purchasing of the following highway services: 1. Liquid Bituminous Materials 2. Vegetation %ontrol 3. Calcium Chloride Solution 4. Cold Recycling of Bituminous Materials 5. Bridge Repair 6. Subsurface Drainage 7. Installation of Guide rails FURTHER RESOLVED, That the Town of Enfield reserves the right to reject any or all bids. Carried Unanimously Motion made by Councilman Achilles and seconded by Councilman Clark that the Town Board of the Town of Enfield adopt a resolution in support of Assemblyman Marty Lusters bill to provide guidelines to enable counties and towns to classify roads and bridges according to their principle uses and to establish recommended standards to enable local highway officials to determine the manner in which such roads and bridges should be constructed, reconstructed and maintained. Also, legislation that would amend the Highway Law to make it clear that a town may designate a seasonally maintained highway, if the only resident is served by such a highway are those intended for seasonal use as indicated in the building permit application. Carried Unanimously Fuel Tanks - Underground tanks are due for testing March 1995. In order for testing volume needs to be brought up to 7500 gallons of gasoline and 8500 gallons of diesel fuel. As there is a push for above ground containment storage and the town has been thinking about pulling the underground tanks and going to above ground containment storage to meet all the EPA regulations. What are ter wishes of the board? After a length discussion of cost of removal of underground tanks, filling of tanks for • EPA testing, possible soil contamination leakage, life expectance of above ground tanks, cost of above ground tanks, consensus was to table this topic for the March 1 st, 1995 Town Board meeting when more information would be available. 267 MINUTES OF THE TOWN BOARD'MEETING - February 1, 1995 6 Unfinished Business: Enfield Community Building - Architect John Benson, Cayuga Consultants Architect John Benson presented to the Town Board and the public two scheme plans for the renovation of the Community Building. Comparative evaluation Schemes A & B. Scheme A- (Town Offices on end floor) Advantog," - Community Council office near more activity spaces. Large meeting room - 3 (teens). Large activity space for group storage. Prominent access to community spaces. Disadvantages- Windowless kitchen, remote from yard. Town Offices split (storage below). Day Careis remote from outdoor areas. Scheme B- (Town Offices on 1 st floor) Advantages - Day Care access to rear yard. Visibility of Town Offices. All Town Offices on one floor. Large Reading room. Disadvantages- Group storage not near large activity area. Windowless Court Offices. Special Town Board meeting to be held Wednesday, February 15th at the Enfield Community Building at 6.30 p.m. to discuss Community Building renovations. Meeting.recessed for ten minutes at 9:00 P.M. Monthly Bills - Motion made by Councilman VanNederynen and seconded by Councilman Achilles that the Town Board of the Town of Enfield approve for.payment General Fund warrants31 -�i in the amount of$44,298.82, Highway Fund warrants IS'-3q in the amount of $14,236.43, Small cities Grant warrants 4-6 in the amount of $9,464.90 and SARA Grant warrant 1 in the amount of $1,303.31 for a total of $55,067.03. Carried Unanimously Suggested that the Deputy Town Clerk index minutes. Supervisor Owens recommended that the Town Board of the Town of Enfield pay Virginia Bryant a stipend of $500.00 for her work on SARA grants. Unfinished Business - SARA Grant application 2 • Grant for creating a Records Storage area (vault) plus creating a Records Management system was submitted January 31, 1995. 268 MINUTES OF TOWN BOARD MEETING - February 1, 1995 7 HUD - Supervisor has obtained 14 (possibly 1 S) out of 20 grant applications needed to proceed with HUD grant through Tompkins County Planning Department. In March, S will meet with Better Housing to look at what Newfield did, which was when they didn't have a full grant application (24) they applied for a 14-16 unit grant through HUD monies funded through the state, and pursue this for the Town of Enfield. If this doesn't work out we can apply next year for another round. Also, talking with County Planning to develop a trailer replacement grant. still looking at Senior Housing. New Business- Appointments - Motion made by Councilman Achilles and seconded by Councilman VanNederynen that the Town Board of the Town of Enfield approve for adoption the following appointments: Official Delegate to Association of Towns Annual Meeting - Supervisor, Jean Owens. Ithaca-Tompkins county Highway Transportation Council Planning Committee - Highway Superintendent, Ron Updike. Intermunicipal Recreation Committee - Art Howser. County Youth Board - Marnie Kirchgessner. Carried Unanimously Adjournment - Motion made by Councilman Achilles and seconded by Councilman Dougherty that the regular meeting of the Town Board of the Town of Enfield held Wednesday, February 1, 1995 adjourn.
