HomeMy WebLinkAbout1994-11-02 222 1 TOWN OF ENFIELD TOWN BOARD MEETING MINUTES NOVEMBER 2nd, 1994 The regular Town Board meeting of the Town of Enfield was held at the Enfield Community Building, 182 Enfield Main Road, Ithaca, N. Y. on Wednesday, November 2nd, 1994 at 7:10 p.m. Supervisor Owens presiding. Present: Jean Owens, Supervisor Pat Dougherty, Town Councilman Garry Achilles, Town Councilman Linda VanNederynen, Town Councilman Robert Linton, Interim Town Councilman (absent) Others Present- Robert Mulvey, Town Attorney Ron Updike, Highway Superintendent Jack Hubbell , Town HistDrian Peggy Hubbell, Town Housing Enumerator Alice Laue, Town Clerk PLEDGE OF ALLEGIANCE- Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. APPROVAL OF THE OCTOBER 5th, 1994 REGULAR TOWN BOARD MINUTES - Motion made by Councilman VanNederynen and seconded by Councilman Achilles that the Town Board of the Town of Enfield approve for adoption the minutes of the October 5th, 1994 regular Town Board meeting. Carried Unanimously HUD - Supervisor Owens Supervisor Owens reported that the Town of Enfield has been selected for funding for the 1994 Small Cities Community Development Block Grant Program in the amount of $400,000.00. Karl Heck-Tompkins County Planning Enfield was highest ranked in Tompkins County applications. Enfield Grant I ahead of schedule, five houses completed, 5 more currently under construction, 4 more stated before winter - 14 of 20 are moving a" and another 6 are in the pipeline. 4 haven't started the process yet. Over ten month period have spent over half of construction • budget. Motion made by Councilman Achilles and seconded by Councilman Dougherty that the Town Board of the Town of Enfield approve for adoption the following Small Cities Community Development Block Grant Services resolution. 225 2 MINUTES OF THE ENFIELD TOWN BOARD NOV. 2ND, 1994 MEETING. RESOLUTION: AUTHORIZATION TO CONTRACT WITH TOMPKINS COUNTY FOR SMALL CITIES COMMUNITY DEVELOPMENT BLOCK GRANT SERVICES. WHEREAS, the Town of Enfield received a grant from the U. S. Department of Housing and Urban Development (HUD) for $400,00 for housing rehabilitation; and WHEREAS, the Town has previously worked with Tompkins County on the implementation and development of its HUD grants; and WHEREAS, a cooperative agreement between the Town and County is required in order to allow this administrative arrangement; now therefore be it RESOLVED, that the Town of Enfield is authorized to.enter.into.a Contract with Tompkins County for an amount not to exceed.$75,000 for HUD-required administrative services for its Small Cities grant;and further RESOLVED, that all expenses under this Contract shall be paid through HUD administrative funds in the Small Cities grant. Carried Unanimously SHUDABEN ROAD - Town Attorney Robert Mulvey Checked title- title fine. Alfred Eddy to sign deed, transfer affidavit, sign assessment form which will be recorded in the County Clerk's office. Shudaben road residents to pay Monroe for abstract search bill of$144.00. Motion made by Councilman Dougherty and seconded by Councilman Achilles that the Town Board of the Town of Enfield adopt the following resolution. RESOLUTION - LAYING OUT SHUDABEN ROAD AS A PUBLIC HIGHWAY IN THE TOWN OF_ENFIELD,TOMPKINS COUNTY,-NEW YORK: Resolved, that consent be and the same hereby is given to the Town Superintendent of Highways of the Town of Enfield to make an order laying out the lands described in said dedication, dated the 3rd day of November, 1994, for highway purposes, in accordance with the provisions.of the Highway Law and other statutes applicable thereto. Carried Unanimously 226 MINUTES OF THE NOVEMBER 2nd, 1994 TOWN BOARD MEETING 3 Highway Superintendent agreed with this resolution. Attorney Mulvey presented Highway Superintendent Updike with a retroactive Order of the Laying Out of Lanchshire Drive as a Public Highway in the Town of Enfield, which Highway • Superintendent accepted. Highway Superintendent asked Attorney.Mulvey about Interim Councilman Unton's concern about protection.against sale of properties in the future where ground water from road ditches cross properties to get to the mainstream that new owners could not come in, fill in the ditch, in other words cause flooding at the roadside. Attorney Mulvey stated he looked at the Highway Law and there is nothing that can be recorded to prevent this. If someone did this and it caused damage to the land around the highway, i.e. shoulders, ditches, the town would have cause of action against the landowner. Supervisor Owens thanked the Shudaben Road residents for working with Town Board on the Shudaben Road official take over icy the town. David Jacobsen expressed thanks from the Shudaben Road residents to the Town Board for their work and cooperation in making this take over possible. PRIVILEGE OF THE FLOOR - Shirley Hubbell - Harvey Hill Road, expressed concerns about Junk Car law. Who is going to enforce this and has someone been hired to do so? Has law been field with the Secretary of State. Yes, and it is officially a law. Marvin Arnold - Gray Road, questioned Supervisor Owens' right to vote. Supervisor is a voting board member. Peggy Hubbell - Hubbell Drive, expressed concerns about the use of one voting machine per district during November 8th, General Election. Recommendation made by Councilman Achilles and agreed with by Councillmen Dougherty and VanNederynen that there be two machines per district used at the November 8th General Election. COMMUNICATIONS - Office of the Aging.letter stating partial real property tax exemption limits for low income senior citizens. Letter from Tompkins County Department of Administration, Scott Heyman, acknowledging that the Town of Enfield elected to use Enfield's sales tax proceeds as a revenue. COMMITTES - Tompkins County Representative Dan Winch congratulated the Town on the take over of Shudaben Road and congratulated Supervisor Owens on her appointment to • the County Rural Affairs Committee. Final County Board vote on County Budget is November 2, 1994. 227 4 MINUTES OF THE NOV. 2nd, 1994 TOWN BOARD MEETING • HIGHWAY SUPERINTENDENT'S REPORT- Ron Updike Motion made by councilman Dougherty and seconded by Councilman Achilles that the Town Board of the Town of Enfield authorize the Town Supervisor and Town Councilman to enter into an Agreement with the Town Highway Superintendent to spend Town Highway Capitol Improvement Funds. Carried Unanimously Surplus Equipment- one 7' V plow advertised as surplus equipment- received one bid from Jim Reeves for $275.00. Eaves Troughs - received two bids - Scheickel Construction $6,270.00 and Hubbell construction Company for $2,368.00. Motion made by Councilman Dougherty and seconded by Councilman VanNederynen that the Town Board of the Town of Enfield accept the Hubbell Construction Company bid in the amount of $2.368.00 for repair and replacement of the eaves troughs on the Town Barn. Carried Unanimously Rabies Clinic - approximately 200 animals vaccinated. Started hauling cinders from Miliken. Grading roads and trying to get things sealed up for the winter. David Miller hired as of October 31, 1994. TOWN HISTORIAN - Jack Hubbell Fall Festival had a fairly good turn out. Local resident Mary Eckert won to quilt. CEMETERY COMMITTEE -John Smith Cemetery mowing schedule for next year same as this year's. Ken Smith to mow back of cemeteries three times next year. Fill need for back of Christian Cemetery. Highway Superintendent Updike asked permission from the Town Board of the Town of Enfield to cross Harold Laue's property to unload dirt at the back of Christian Cemetery, if permission is granted by Harold Laue for this crossing. Town Board of the Town of Enfield granted this permission to Highway Superintendent Updike. COMMEMORATIVE COMMITTEE - Alice Laue Meeting held October 5th, 1994. Next meeting November 5th at the Town Hall. • Anyone interested is welcome to attend. There is a lot of work to be done. ENFIELD COMMUNITY COUNCIL - Written report. Supervisor Owens reported that the Fall Festival was a success. Around $3,000.00 was netted and around $4,000.00 was grossed. 228 5 MINUTES OF THE NOV. 2nd, 1994 TOWN BOARD MEETING ENFIELD COMMUNITY BUILDING - Supervisor Owens • Supervisor Owens reported that there was an architectual delay but will be back on course shortly. MEDICARE SUPPLEMENTAL INSURANCE - Supervisor Owens Relative to present.retirees. Any town retiree eligible for Medicare are able to get Medicare Supplemental Insurance through Blue Cross/Blue Shield. Would not have prescription coverage. They would have to enter the UPIC program for this coverage. LOCAL COURT AUTOMATION - Supervisor Owens Supervisor Owens wrote a grant for equipment to automate the courts and has received notification that we have received a grant. Councilman Dougherty excused herself from the meeting. ENFIELD FIRE COMPANY - Dominic Seamon Nothing new to report. Board meeting next week. Open House held at the Fail Festival, a lot of families attended. PLANNING BOARD- Town No Report County No Report Supervisor Owens referring problem of residents at the 146 Sheffield Road trailer park applications of change of name for their road. etc. sent to the Ithaca Post Office. MONTHLY BILLS Motion made by Councilman VanNederynen and seconded by Councilman Achilles that the Town Board approve for payment General fund warrants in the amount of $12,672.10, Small Cities Grant warrants in the amount of $48,365.66 and Highway fund warrants in the amount of $23,631.20 for a total of$eA,,668.96. Carried Unanimously UNFINISHED BUSINESS - SPCA Motion made by Councilman VanNederynen and seconded by Councilman • Achilles that the Town Board of the Town of Enfield authorize Town Supervisor Owens, Jean Owens, enter into a contract with the SPCA for dog control in the Town of Enfield for the year 1995. 231 Carried Unanimously 6 MINUTES OF THE NOV. 2nd, 1994 TOWN BOARD MEETING. DOG ENUMERATION - Alice Laue Enumerator is still counting dogs. Bigger job than first anticipated. NEW BUSINESS - 1995 Final Budget Motion made by Councilman Achilles and seconded by Councilman VanNederynen that the Town Board of the Town of Enfield approve for adoption the 1995 Preliminary Budget as the 1995 Final Budget. Carried Unanimously Wright Risk Management - Workmen's Compensation Insurance Motion made by Councilman Achilles and seconded by Councilman VanNederynen that the Town Board of the Town of Enfield adopt the following resolution and grant authority to Supervisor Owens to enter into a contract with Wright Risk Management for Workmen's Compensation Insurance. RESOLUTION- WHEREAS, there has been proposed a"NEW YORK STATE MUNICIPAL WORKERS" COMPENSATION ALLIANCE PLAN Document"" pursuant to Section 50 3-a of the Workers' Compensation Law (hereinafter "the plan"), and WHEREAS, The Town of Enfield is eligible for membership in the Plan; and WHEREAS, The Town of Enfield has made an independent investigation of the Plan and reviewed the Plan's charter document, and has concluded that it would be in the interests of the Town of Enfield to participate therein; now, therefore, be it RESOLVED, that the Town of Enfield enter into membership in the Plan pursuant to Section 50 3-a of the Workers Compensation Law; and be it further RESOLVED , that Jean Owens, Supervisor, be and hereby is authorized and instructed to execute the Plan's charter document on behalf of the Town of Enfield and •be it further RESOLVED that the custody of all joint Plan moneys by the Plan administrator under the Plan be and the same hereby is approved. Carried Unanimously Class MBIA Motion made by Councilman VanNederynen and seconded by Councilman Achilles that the Town Board of the Town of Enfield accept the following Municipal Cooperation Resolution. RESOLUTION: WHEREAS, New York General Municipal Law, Article 5-G, Section 119-o ("Section 119-0 ") empowers municipal corporations (defined in Article 5-G, Section 119-n to include school districts, boards of cooperative educational services, counties, cities, towns and villages) and districts to enter into, amend, carrel and terminate agreements for the performance among themselves (or one for the other) of their respective functions, powers and duties on a cooperative or contract basis: WHEREAS, the Town of Enfield, wishes to invest certain.of its available investment funds in cooperation with other municipal corporations and/or districts pursuant to a municipal cooperation agreement; O 233 8 MINUTES OF THE NOV. 2nd, 1994 TOWN BOARD MEETING WHEREAS, the Town of Enfield, wishes to assure the safety and liquidity of its funds; NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: THE Town of Enfield is hereby authorized to execute and deliver the Cooperative Investment Agreement in the name of and on behalf of the Town of Enfield. Carried Unanimously Motion made by Councilman VanNederynen and seconded by Councilman Achilles that the Town Board of the Town of Enfield authorize Supervisor Owens to enter into a contract with the First National Bank of Dryden. Carried Unanimously Motion made by Councilman VanNederynen and seconded by Councilman Achilles that the Town Board of the Town of Enfield officially name MBIA and the First National Bank of Dryden as official depositories of the Town of Enfield funds. Carried Unanimously Real Property Tax - Motion made by Councilman VanNederynen and seconded by Councilman Achilles that the Town Board of the Town of Enfield charge a $1.00 fee on delinquent tax notices on Real Property taxes. Carried Unanimously FAX Machine - Discussion of the importance of the Town Board of the Town of Enfield purchasing a FAX machine was held. Machine would be of use to the Courts, Highway Department, Supervisor[ and Town Clerk. Supervisor Owens to look for a machine that would serve the town's needs. 234 9 MINUTES OF THE NOV. 2nd, 1994 TOWN BOARD MEETING RURAL AFFAIRS COMMITTEE- Supervisor Owens will now be a representative on the County Rural Affairs. Committee. She will do her best to bring the rural residents concerns to tt.,e County. MEETING- Councilman Achilles to set up a meeting with Code Enforcement OfficEi Roger Rumsey. ADJOURNMENT- Motion made by Councilman VanNederynen and seconded by Councilman Achilles that the Town Board of the Town of Enfield be adjourned.
