The regular meeting of the Enfield Town Board met Wednesday, July 6th, 1994 at the Enfield Community Building, 182 Enfield Main Road, at 6.30 p.m.. Supervisor Owens presiding. PRESENT: Jean Owens, Supervisor Garry Achilles, Councilman Pat Dougherty, Councilman Linda VanNederynen, Councilman Carl Newhart, Councilman (Absent) OTHERS PRESENT: Ron Updike, Highway Superintendent Jack Hubbell, Town Historian Alice Laue, Town Clerk Peggy Hubbell, Housing Enumerator PLEDGE OF ALLEGIANCE: Supervisor Owens lead the assemblage in the Pledge of Allegiance to the flag. APPROVAL OF THE MINUTES: Motion made by Councilman Achilles, seconded by Councilman VanNederynen that the minutes of the regular Town Board Meeting held June 1, 1994 be approved. Carried Unanimously Motion made by Councilman Achilles, seconded by Supervisor Owens that the minutes of the Special Town Board Meeting held June 22nd, 1994 be approved. Carved Unanimously Motion made by Councilman Achilles, seconded by Supervisor Owens that the minutes of the Public Hearing held June 22nd be approved. Carried Unanimously • Motion made by Councilman VanNederynen, seconded by Councilman Achilles that the minutes of the Special Town Board Meeting held,May 18, 1994 be approved. Carried Unanimously 192 2 MINUTES OF THE ENFIELD TOWN BOARD MEETING July 6, 1994 PRIVILEGE OF THE FLOOR: Janet Morse, Enfield Main Road - Asked why architects not contractors proposals. Supervisor Owens stated architect proposals don't cost anything, present ideas. Marvin Arnold, Gray Road- Why does an old building new a permit to be demolished? Supervisor Owens asked Councilman Achilles to set up a meeting with Code Enforcement Officer, Roger Rumsey. Hilda Van Amberg, Black Oak Road Connecticut Hill Road was very danger Stated that Corner Of Black Oak Rd. and ous and asked if the town could help residents Of these two roads do something to correct this situation. At present there is only one stop sign on Corner of Black.Oak Rd. and a 35 m.p.h. speed limit sign. Highway Superintendent Updike stated that Mr. Hungerford from the Tompkins County Highway Department and he would be looking this intersection over on July 7th, 1994 and see what can be done and will bring information back. Shawn brake, 535 Enfield Center Rd. - What is status of Ben Road? Highway Superintendent Updike - Core samples look do the work, gravel pile in back forks o.k., need to look at culvert pipes n��s going to reditching. Find out if tide is O.K. Supervisor Owens- Combined meeting July 13, 1994 at,8:00 p.m. at the Community Building to discuss states of Ben Road and a Junk Car Law with Town Attorney,Robert Mulvey. Special Town Board Meeting to be held on July 13, 1994 at the Community Building at 9:30 p.m. John Tagalaventa, 535 Enfield Center Road - Three accidents in the last two weeks at the intersection of Bostwick Road and S. Applegate Rd., is there something that can be done? Highway Superintendent Updike stated this is a County Road. 193 MINUTES OF THE ENFIELD TOWN BOARD MEETING July 6, 1994 s COMMUNICATIONS: Letter from the State Education Department offering a Local Government Records Improvement Fund Grant in the amount of $13,755.00 (SARA) to the Town of Enfield for an inventory and planning project. COMMITTEES: Tompkins County Board Representative [Ian Winch - County is in their summer modes, which means they don't have as many general meetings throughout July and August but continue doing business which this time of year ends up being getting into the budget process. Tompkins County Board of Representatives included, as an insert, a newsletters to residents of the county in Friday, July sty Ithaca Journal. This will be a quarterly newsletter included in the Ithaca Journal. Budget Reorganization Action Committee and Governmental Affairs Committee is setting up meetings to go out to all town and village boards to present information on the county budget and also relieve information from the constituents. This is a tremendous opportunity for board members and the public to let the people in Governmental Affairs, our committee and BRAC know their feelings. Supervisor Owens stated that a member of the BRAC committee would be joining the August 3rd, 1994 Enfield Town Board Meeting at 8:00 p.m. Enfield Fire Company- Rich Neno No big news outside of planning ahead and thinking about the budget. Trying to get some realistic figures together and on paper to present to the Town board. Junk Car Committee - Pat Dougherty Gant'Achilles co-chariest, passed around pictures that public had given to him of different areas where there were junk cars. Talked about the Citizens Committee, Bruce Lott discussed at March board meeting, noted Citizens Committee hadn't taken any action reason being Mr. Lott had spoken with someone on the board and wanted to be sure that it was legal for them to form this volunteer committee to go out, he was • waiting for direction from the board. Town attorney looking into this question and should be able to answer this next week at July 13th junk car meeting., Possibly rough draft a Junk Car Law. 194 ENFIELD TOWN BOARD MEETING MINUTES - July 6, 1994 4 Junk Car Committee continued - Question asked N this could be put to a vote as a referendum, town attorney to answer at July 13th meeting. Councilman VanNederynen would like the 'town Board to be thinking about a moratorium on junkyards and need to ask the town attorney about this. Planning Board Committee - Rick Chase Town - Had oW6~ eting, working on Sub�-division proposal. County- Working on developing a community profile tourism brochure. Asking townships to contribute information about their towns to this brochure. Public ICETEA meeting July 7, 1994, Holiday Inn. Public invited to bring their ideas to this meeting. Town Historian - Jack Hubbell Annual board picture taking time again. Town Historian thanked who ever was mowing (Town Highway Dept.) around the town buildings, he stated this was a beautification to the town and it gives the impression that the town is practicing what it preaches. Commerative Committee- Jack Hubbell Logos from school are in, decision to be made soon. Not a quorum, so there wasn't a meeting. Still need VOLUNTEERS. Historical Society -Jack Hubbell Caroline Historian, Mrs. Kong, to speak at August 24th, 1994 meeting. Cemetery Committee - No report Community Council - Janet Morse Waiting for daycare information. Summer program started today, July6 1994. Went very weft, very successful. y 195 5 ENFIELD TOWN BOARD MEETING MINUTES - July 6, 1994 Enfield Community Building - Supervisor Owens Met with Town Attorney, Bob Mulvey, went through entire Town Law Manual to determine proper procedure to follow, to the letter of the law ,as how to proceed with the community building renovations and even to the extent of finding out it is a much larger project than what it is. Listed ten to twelve processes to go through in order to correctly proceed to renovate the community building. Starting with the motion that we begin with the ad in the paper, in the legal section, for soliciting proposals from architects. Will give all information we have so far to architects as to what-are "dream plans" of what the building might look like of the various town offices as well as the youth programming and see what the architects come up with. Councilman Achilles asked ,­ ve we ever made a final decision that it was going to be here or some where else, I though it was still up in the air? Supervisor Owens - Architect proposals would give us an idea N it was feasible to do what we would like to do. Councilman VanNederynen asked about the town's liability for bid submitted. Supervisor Owens stated since we had not signed a contract, we are not putting the town in a legal position, according to Town Attorney Mulvey's opinion, to abid by bid, accepted would not have any legal resource against it. Formal notice from town to the Hubbell Construction Company to be sent. Councilman Dougherty asked it this was in writing. Highway - Highway Superintendent, Ron Updike Attended county's quarterly superintendents meeting. One issue covered was equipment sharing agreement. County to draw up a copy, Town of Lansing has drawn up a copy. Superintendents will be getting together and note all thoughts together in one agreement. Agreement will be between, towns and county, towns and towns, its for when wei loan equipment to other towns and county and will save liability issues, legal aspects will be spelled out in agreement. When we have a copy that is satisfactory between superintendents it will be taken to town attorneys and towns will be asked to look at it. If it's satisfactory, adoption by the towns will be asked for. Discussed five year bridge program. Within the-county, here the town, there are three bridges drastically affected, two on Trumbull's Comer Rd., replaced in 1998 at no • cost to the town, and the Harvey Hill Rd. bridge in 1999 estimated to cost the town $15,000.00. 196 6 ENFIELD TOWN BOARD MEETING MINUTES July 6, 1994 Highway report continued - Snow and-Ice budget will approximately increase 38:4°/0 in monies from county for • snow and ice removal. This is based on county's efforts on state highways this last winter. Waterburg and Aiken Road- Jim McConkey's barn. County dug a pad and is moving the barn away from the comer for sight distance. MONTHLY BILLS - Need to add two bills to General Fund. 1. Pat Podufaiski postage $2.61 2. Tompkins County Trust Co. - checks $55.06 Motion made by Councilman VanNederynen, seconded by Councilman Achilles that the Town Board of the Town of Enfield approve for payment General funds warrants in the amount of$53,573.38 and Highway funds warrants in the amount of $41,466.09, in the total amount of$95,039.47. Carried Unanimously UNFINISHED BUSINESS - Alcohoi Venders - Motion made by councilman Dougherty, seconded by Councilman.VanNederynen that the Town Board of the Town of Enfield authorize the Town Cleric to issue a letter of compliance to known alcohol venders requesting a letter of intent. Carried Unanimously NEW BUSINESS - BRAC - A representative from BRAC will be attending the August Town Board Meeting, the representative will be at the meeting at 8:00 p.m. Voting Locations - Supervisor Owens to contact the Fire Company, about moving District#2 to the Fire House. 197 PP- ENFIELD TOWN BOARD MEETING MINUTES July 6, 1994 Cat Licensing - Motion made by Councilman Achilles, seconded by Councilman Dougherty that the Town Board of the Town of Enfield adapt the following resolution against cat licensing. WHEREAS, the people of Tompkins County are already heavily burdened by taxes, fees, rules, regulations, and government bureaucracy and WHEREAS, government agents, such as Town Clerks are already overloaded with administrative mandates, and WHEREAS, dog licensing is not fully utilized in the County and WHEREAS, the SPCA has recently taken on additional municipalities and there was no mention of fiscal problems during the contracting process, and WHEREAS, the SPCA is already receiving just compensation for cat control. THEREFORE, BE IT RESOLVED, this sixth day of,luly, 1994, that the Town Board of the Town of Enfield, on behalf of its constituents, goes on record as being opposed to the licensing of cats in Tompkins County. BE IT FURTHER RESOLVED, that this Board neither supports nor endorses any additional type of household pet licensing. A copy of this resolution is to be transmitted by the Enfield Town Clerk to the two Enfield representatives on the County Board, the Ithaca City Clerk, all Town Clerks in Tompkins County. Carried Unanimously Collection of Annual Solid Waste Fee- Motion made by Councilman VanNederynen, seconded by Councilman Achilies that the Town Board of the Town of Enfield authorize Supervisor Owens to draft a letter to the Tompkins County Department of Solid Waste advising them that the collection of the solid waste fee on the tax bill does not meet with our approval. Carried Unanimously 198 8 Enfield TOWN BOARD MEETING MINUTES JULY 6, 1994 Haefle's T. V., Inc. - Supervisor Owens Cable Commission working on Haefle's T. V. rate increase. Contract ends 12/94, Haefle has five year option to renew. Policy and Procedure - Requested June 1, 1994 Town Board Meeting. Councilman Dougherty Councilman Achilles requested that we talk about Policy and Procedure. I requested we start going through the budget process, little by little, suggested you go through with us how a budget is determined, reductions ma;;,.money appropriated, how you meet with people, etc., so the whole board would t Avts this information. Supervisor Owens - By the end of the month I will be sending a letter to each of the grc!ips affected by the budget, town officers, historian, community council, courts, etc., to get their input as to what they would like to see happen to their budget line and try to zubstantiate what it is they want the money for. Councilman Dougherty - I would like the town board members to have a more knowledgeable involvement in the budget process. Jon Hubbell's Retirement- Highway Superintendent Updike inquired whether he needed permission from the town board to advertise this position. Highway Supervisor Updike to advertise this position as a full time position. Highway Superintendent has authority to hire, doesn't need town board permission. Cake and coffee for a surprise retirement party for Jon Hubbell will be held Jon's last scheduled work day, at the Town Hall at 9:00 a.m. . 199 9 ENFIELD TOWN BOARD MEETING MINUTES July 6, 1994 • SCHEDULED MEETINGS- July 13th, 1994 Town Hall - Assemblyman Luster- 7:00-8:00 p.m. Enfield Community Building Meeting with lien Rd. residents 8:00 p.m. Meeting on Junk Car Law 8:30 p.m. Special Town Board Meeting 9:30 p.m. ADJOURNMENT- Motion made by Councilman Achilles, seconded'by Councilman VanNederynen for adjournment.
