WEDNESDAY- JANUARY 5th, 1994 The regular meeting of the Town Board of the Town of Enfield was called to order at 7:50 p.m. at the Enfield Community Building, 182 Enfield Main Road, Ithaca, N. Y., 14850 with the following members present: Present: Supervisor Jean Owens Councilman Garry Achilles Councilman Carl Newhart Councilman Unda VanNederynen Councilman Pat Dougherty Others Present: Town Clerk Alice Laue PLEDGE OF ALLEGIANCE The Town Supervisor led the assemblage in the Pledge of Allegiance. APPROVAL OF MINUTES - The Town Supervisor asked for any additions or corrections to the December 1, 1993 meeting. Supervisor Owens stated that the Volunteer Recognition awards handed out or mailed totaled 175. Mobile Home Law rejected by the state because of language and will be sent back to the town attorney. RESOLUTION: Motion by: Councilman Van Nederynen Seconded by: Councilman Newhart Resolved, that the Town Board of the Town of Enfield hereby approves the minutes of the December 1, 1993 regular Town Board meeting. CARRIED UNANIMOUSLY 123 COMMUNICATIONS - H. U. D. David Carlson, Karl Heck, Ms. Builderback, Director of Better Housing, were present. Mr. Carlson addressed the Enfield H. U. D. grant which has been approved. First Stop is paper work. No cost to town. Work open to bids. Creditable contractors, lowest responsible bidders. County doesn't contract, people contract, contract signed between homeowner and contractor. No money paid until all are happy. On site inspections. PRIVILEGE OF THE FLOOR- Roger Laue commented on the good job Highway Superintendent, Ron Updike and the highway crew were doing on snow removal. He also commented on the quality of the tax bills. Tax bills could be easily mistaken for junk mail and there was nothing personal privacy to these bills. Janet Morris complained about the handling of her dog complaint by dog control warden. Dog law referred to Public Safety Committee. COMMITTEES- County Board Reu_r2se_ ive Dan Winch commented on the H. U. D. program and is pleased that the Town of Enfield is participating in this program. He also commented on rapport the highway department has with neighboring towns and county. Towns have a gentlemen's agreement. Dqg Warden Lorraine Bard reported that for the 1993 year she had handled, 73 complaints, 73 pick ups, 34 dogs lost, 67 dogs found (sometimes sighted), 59 impounded, 19 adopted, 14 euthansied, 4'tickets served. Works more by working things out. gunk Car Committee- Junk Car Meeting, Wednesday, January 26, 1994 at the Enfield Community Building at 7:00 p.m.. Open to the public. Enfield QommUnity Council - No report. 124 Enfield Volunteer Fire Company - Dennis Hubbell. There would be an annual activity report next month. Forty calls for the 1993 year, mostly rescue calls, some mutual aid. Re-organization of Board of Directors. Alternate delegates to Town Board meetings, next month Marty Schrieber would be the delegate). HighwaSUWrintendent- Christmas trees chipped January 20th, weather permitting. Trees to be left at old town barn building. Town Historian - No report. Planning g CommiM- Town- No report County- No report Cemetery Committee - Roger Laue reported the committee would be meeting in January or February. Commemorative Qom iln ttaa - No report. Councilmen would like to see reports from dog enumerator,, building inspector, etc., also. UNFINISHED BUSINESS - DOG CONTROL CONTRACT- Two contracts, S. P. C. A. $5652.00 and Lorraine Bard, present dog warden,$5652.00. Lorraine Bard reported that her building accepted by state. Less dogs, two towns, Enfield and Hartford. Verbal statement from Dr. Mitch given more than-thirty day compliance. Councilman Dougherty - concerned with compliance, what if compliance isn't met, why didn't other towns stay? Contract would be returned. Contract is paid on a monthly basis. Councilman Van Nederynen - Public Safety Committee should set fees. RESOLUTION: s Motion by: Councilman Van Nederynen Seconded by: Councilman Newhart 125 Resolved, that the Supervisor, Jean Owens, enter into Dog Control contract with Lorraine Bard. A vote on the resolution resulted as follows: • Councilman Dougherty - Nay Councilman Achilles- Nay Councilman VanNederynen- Aye Councilman Newhart - Aye Supervisor Owens - Aye MOTION CARRIED 10:00 - 10:10 p.m. Meeting adjourned for 10 minute break. 10:10 Meeting reconvened. APPROVAL CONTRACT ENFIELD COMMUNITY BUILDING RENOVATIONS- Contract available next month. Councilman Dougherty- What is going in space? ENFIELD COMMUNITY COUNCIL CONTRACT 1994 $1800.00 a month for 11 months for$19800.00. Pays for 3-4 adults- After school program that employs 1 adult and 1 or 2 helpers. Supervisor is to ask for public breakdown. RESOLUTION: Motion by- Councilman VanNederynen Seconded by- Councilman Achilles Resolved, that Supervisor, Jean Owens, enter into contract with the Enfield Community Council for budgeted amount. • CARRIED UNANIMOUSLY APPOINTMENT-Town of Enfield Planning Board. 2 6 RESOLUTION- Motion by: Councilman Newhart Seconded by: Councilman Dougherty Resolved, that the Town Board of the Town of Enfield appoint Virginia Bryant to the Planning Board. CARRIED UNANIMOUSLY APPOINTMENT: Small Cities Review Board RESOLUTION: Motion by: Councilman Achilles Seconded by: Councilman Newhart Resolved, that the Town Board of the Town of Enfield appoint to the Small Cities Grant Review Board: Town of Enfield Supervisor Tompkins County Representatives Director Tompkins County Planning Department Tompkins County Board of Representatives Director Better. Housing Councilman Dougherty Councilman VanNederynen CARRIED UNANIMOUSLY APPOINTMENT: Record Advisory Committee RESOLUTION: Motion by: Councilman Achilles Seconded by: Councilman VanNederynen Resolved, that the Town Board of the Town of Enfield appoint a Records Advisory Committee consisting of the following: Town Attorney - Richard Mulvey Town Historian - M. Clyde Hubbell Town Supervisor - Jean Owens • Records Management Officer Representative - Virginia Bryant Records Management Officer - Town Clerk, Alice Laue, Chair CARRIED UNANIMOUSLY 127 MONTHLY BILLS: Resolved, that the Town Board of the Town of Enfield approves for payment warrants 1 - 22 and warrants 1 - 1.0 for the following amounts. General Fund-$20,908.98 Highway Fund- $649.64 CARRIED UNANIMOUSLY ORGANIZATIONAL RESOLUTIONS - RESOLUTION: Motion by: Councilman Newhart Seconded by: Councilman Achilles Resolved, that the Town Board of the Town of Enfield adapt the Organizational Resolutions as amended. Town Board meetings to start at 6:30 p.m. CARRIED UNANIMOUSLY NEW BUSINESS - H. U. D. RESOLUTIONS - Motion by: Councilman Newhart Seconded by: Councilman Achilles Resolved, that the Town Board of the Town of Enfield adapt the resolutions presented by H. U. D. CARRIED UNANIMOUSLY APPOINT TOWN CLERK RECORDS MANAGEMENT OFFICER - 128 RESOLUTION: Motion by: Councilman Achilles Seconded by: Councilman VanNederynen Resolved, that the Town Board of the Town of Enfield appoint Town Clerk, Alice Laue, Records Management Officer. CARRIED UNANIMOUSLY AMEND BUDGET- RESOLUTION - Motion by: Councilman Achilles Seconded by: Councilman Newhart Resolved, that the Town Board of the Town of Enfield amend the 1993 budget. $8486.95 to be added to line DA 511104. CARRIED UNANIMOUSLY ASSOCIATION DELEGATE AND ALTERNATE - RESOLUTION - Motion by: Councilman VanNederynen Seconded by: Councilman Dougherty Resolved, that the Town Board of the Town of Enfield appoint Supervisor Jean Owens as association delegate and Town Clerk Alice Laue as alternate delegate. CARRIED UNANIMOUSLY 129 PUBLIC HEARING - RESOLUTION: Motion by: Councilman Achilles Seconded by: Councilman • Van Nederynen Resolved, that the Town Board of the Town of Enfield hereby direct the Town Clerk to advertise for a special Town Board Meeting to be held Wednesday, January 19th, 1994 at 6:30 p.m. for the purpose of an annual audit of the Town books for the 1993 year. CARRIED UNANIMOUSLY PRIVILEGE OF THE FLOOR,- Councilman Dougherty asked about the Cellular phone contract. Respectfully submitted, Alice e Town Clerk 130 ENFIELD TOWN BOARD MEETING SPECIAL TOWN BOARD MEETING MINUTES WEDNESDAY, JANUARY 5TH, 1994 The special public hearing meeting on the Junk Car Ordinance was called to order at 7:10 p.m. at the Enfield Community Building, 182 Enfield Main Road, Ithaca, New York, 14850 with the following members present: Present: Supervisor, Jean Owens Councilman, Pat Dougherty Councilman, Garry Achilles Councilman, Linda VanNederynen Others Present: Town Clerk, Alice Laue Supervisor, Jean Owens called the public hearing on the Junk Car Ordinance to order at 7:10 p.m. A legal notice was published concerning this hearing. We are looking at Local Law A, 1994, at this time. A local law providing for the regulation of automobile junkyards in the Town of Enfield. Anyone who hasn't gotten hold of a copy, certainly help yourself to the ones here. This is a public hearing where we are asking if anybody has any issues or concerns about the law to please voice them, we are not prepared to take any action on the law tonight, because we have to listen to the public and refer that to the Junk Car Committee. Councilman Dougherty We aren't going to take action tonight? "Supervisor Owens - On this law/ Councilman Dougherty - Yes. Supervisor Owens - Usually when you hero public opinion, unless there is no public opinion, you have to take that into consideration before you adopt a law. Doug Reid's concerns - Asked if there would be a period when written comment would be accepted on this document. i Section 3 - Under definitions it says no longer intended or in condition for legal use on public roads, I interrupt this to mean that just because you take the plates off a vehicle doesn't make it a junk vehicle if its ready to go. 131 Will the law really solve the beauty problem when two of the ugliest wrecks that you can imagine are allowed. Section 5 - Application for a license, description of land, does this require a survey? Section 3 - What about farm equipment? Is farm equipment excluded? Ans,A,er - Yes. Section 14 - Established junkyard - I assume that's me, since I have had junk cars there for more than twenty years. Councilman Dougherty - Do you have a state license? Doug Reid - No, I am not a business. Councilman Dougherty - I think that is what an established junkyard is.. Doug Reid - Draft copy seems to be confused about whether it means, business or hobbyist, or both. Some wording here and there confusing. N. Y. State law definitely geared toward businesses, believe purpose of having this law was to take into consideration some of the concerns of a car hobbyist, such as myself. Councilman Dougherty - I think Section 14 of established junk car law is the same as N. Y. State law. I don't remember as that being changed. We kept about 85% of N. Y. State law. Doug Reid - What is the purpose of the fence? Is it the view? Prefer to put my things in writing. I would like to defend myself further in writing, I don't want to monopolize this meeting. Bill Mathers - Section 14 - Established junkyards, have sixty days to apply, if they don't apply within sixty days and are currently operating a junkyard do they forfeit that right? This is rather technical, but I think we need to cover it because this is going to be a really challenged piece of work. If it is in fact some how tied to the existing junkyards that are licensed by the state and comply with the state, I think we need to write that in some how so there is no miss understanding. Could we amend this to state that if they can provide proof that they are currently a licensed junkyard by the State of New York that we will accept that as evidence that they are okay to be licensed, and if not we won't consider them as an established junkyard? 132 Question is how do we establish who is a junkyard? I Mike Williams - Basically what we are asking is, if you have six junk cars in your yard and if you have had them over a year, does that mean you have an established junkyard and all you have to do is apply within sixty days and get your license or does it mean that if you have a state license to run a junkyard you automatically get a license? Reading this I don't understand the difference. What does an established junkyard mean? Councilman Dougherty - You have to be licensed through New York State. Mike Williams - That is what it means. Where does it say that. Councilman Dougherty - N. Y. State makes you fill out the same type of application we have. In order for you to become a legal junkyard you have to have a license from the State of New York and pay a fee when you initially become licensed and then you pay $100.00 a year to New York State. Under this you would pay $100.00 to N. Y. State and $25.00 a year to the Town of Enfield. Mike Williams - All you have to do in the definition section is clarify what the term established junkyard really means. Doug Reid - The fact that Enfield has not enforced any state junkyard ordinance since 1967 or when state law was passed I maintain that my selection of cars constitutes a junkyard which should be grandfathered and the fact that Enfield has not done any legal enforcement renders the fact that I do not have N. Y. State license irrelevant. Pete Moore - Section 3 - Pertaining to any other business. I run a garage and have twenty unlicensed cars on my property waiting for repairs, that means I can't park them at my place of business. Councilman Dougherty - No longer intended or in condition for use and yours are intended to be repaired. You don't plan on keeping these cars there for the rest of your life. Doug Reid - Neither do I, most of my cars are nearly ready to go. Councilman Dougherty - Do you have a garage? Doug Reid - Garage? I no longer am running a garage business at that location. I am saying your logic applies to him and it also applies to me. 133 Supervisor Owens - Are there any other concerns or questions. Resolution: .
