TOWN BOARD.MEETING MINUTES
WEDNESDAY, JANUARY 4, 1995
6:30 P. M.
The regular meeting.of the Town.Board of the Town of Enfield was held
Wednesday., January 4th,1995 at.the Enfield.Community Building,. 182 Enfield Main
Road, Ithaca, N. Y., at 6:30 p.m.. Supervisor Owens presiding.

Supervisor Owens led the assemblage in the Pledge of Allegiance to the flag.
APPROVAL OF THE MINUTES:
Motion made by Councilman Achilles and seconded by Councilman
VanNederynen that the Town Board of the Town of Enfield approve for adoption the
December 7th minutes of the regular Town Board meeting of the Town of Enfield and
the minutes of the December 7th, 1995 Public Hearing.

Letter responding to our concerns of clean up of illegal dumped materials along.our
highways. Instituting a pilot illegal clean up program.
Letter inquiry if the Town of Enfield is interested in sponsoring a community wide
reuse event, i.e. garage sale.
• SPRAGUE INSURANCE:
Letter presenting premium saving ways. Also, asking,town to redommission with
them as our insurance agent.

Letter from Town of Enfield residents living on Gray Rd., S. VanDorn Rd. and
Colegrove Rd. opposing proposed Gravel Mining Project in their residential area
of
Enfield. As homeowners in the immediate vicinity of the proposed operation,

must be answered before the mining starts. The DEC will be reviewing the application
in the next week or so.
What assurances can the town board provide that road maintenance will be
adequate for the impact of the additional hauling of gravel over the various town road

Section B of the application,about pollution control does not address the significant
noise, dust level and ground vibrations that will be added to the area or the potential
impact on private wells in the vicinity. Is there anything the board can do about this?
We are, again, worried about property damage and our well being, especially in the
light of negative impact of the cellular telephone tower constructed in our area on a
site off Bostwick Road.

Reclamation methods noted in Part B of the application notes that the owner of the
mining area will be stripping top soil from unidentified areas other than the mined
area. Are there regulations enforce in the town that monitor this additional stripping of
• the land and what impact will this have on our roads and culverts of the residential
area?
We.also ask you as an elected board of the.town-to ask the DEC to follow its own
guidelines of public notice. To our knowledge only one published notice appeared in
the Ithaca Journal on November 17th, 1994. Major changes to the Map Land
Reclamation Law were inacted by the New York State Legislature and took effect
September 1, 1991. Specifically, public notice applications for mines of five or more
acres continue to be classified as major projects and are subject to the major permit
requirements of the Uniform Procedures Act. The most recent requirement is that all
major permit applications must be published, at the expense of the applicant, for a
period of not less than thirty days in a newspaper of local circulation. As long time and
new residents of the area in question, we appeal to you to answer these questions in
an immediate and timely manner. We feel that the special character of this area which
is extremely close to Treman State Park is in real jeopardy from the lightly monitored
commercial mining operation. We look forward to you response. thank you for your
time and consideration.

COMMUNICATIONS- Councilman Dougherty
Solid Waste Division - LetbDr from Thomas Richardson, in regards to
municipalities that wish to assume the cost of drop off centers. Are we contemplating
this. Supervisor Owens - We haven't discussed this and I am not sure of the county's
response to the Rural Affairs Committees recommendation. Premature.
Tompkins County Inter municipal Cable Television Commission - Letter, John
Grove should have a copy of our franchise agreement. Assessment for Town of
Enfield would be $25.00. Supervisor Owens - Town not a part of this association.
Councilman Dougherty, if we don't belong, how can they assess us? Supervisor
Owens, they cant. We don't belong. They are trying to encourage the town to be part
of this organization.
RECOMMENDATION: Councilman Dougherty
That all contracts be presented in advance of renewal time (four to six weeks) so
that board members can review them. Youth Bureau needs to present their contract
further in advance than two weeks before due. Board should refuse to sign them until
sufficient time for review have been given.

COMMITTEES -
Tompkins County Board of Representatives - Peter Meskill
County is quiet. It is his understanding that the Town of Enfield concerns about •
Solid waste, bridges, roads, Sheriff's Department, etc. are concerns found all over the
county.
Solid Waste Recycling Drop Off Center- That is way Solid Waste Budget is built at
this time for 1995.
PRIVILEGE OF THE FLOOR:

How is town moving along on issues of Junk Car Law and what is being done about
enforcement?
Supervisor Owens - A Organizational Resolution tonight establishes the Office of
Assistant Fire and Code Officer. Code Enforcement officer is looking at
recommendations of how we would pay that officer. What job description would be.
Supervisor Owens asked the Fire and Code Committee to meet with the Fire and
Code Officer.
Shirley Hubbell - Harvey Hill Rd.
Letters regarding Junk Car Law go to who? Supervisor Owens, Code Enforcement
Officer.
GRAVEL MINING PROJECT:
Residents, Dena Wickstrom, 161 Gray Rd. Dan Fish, Colegrove Rd., Nicole McGurk,
Colegrove Rd., Norman Pure, S. VanDorn R.d, Charles McGurk, Colegrove Road,
expressed the following concerns about gravel mining project proposed for Corner of
Cray and S. VanDom Rd.
Some residents live less than 500' from proposed project, increase in noise level,
heavy truck traffic on town roads not build for this type of traffic, safety and health
concerns to residents, their families and pets. Condition project acreage will be left in
after mining is finished. DEC didn't follow procedures they wrote, public notification.
Affect on shallow wells, ground water level, residents not approached. Can permit be
stopped? Mining can be started on a provisional permit, is there any way decision
can be stopped. Open pit mining visible from main road, eye sore to all town residents
if pits are left open after mining stops. Is there bonding for fixing roads?
Town Concerns-
Damage to small low traffic roads that surround site, safety of residents, property,
children and pets living close to site, project proximity to Robert Treman Park, Not fair •
for taxpayers to pay for road repairs caused by heavy truck traffic on town roads used.

Councilman concerned about liability of lawsuits against the town. Repercussions.
Owe it to residents that we ask for more time and information. All parties involved
need to work in a friendly neighborly way.
•CONSENSUS :
Consensus of the Town Board is that a letter be written to DEC expressing
residents and town's concerns, ask for additional time to look at testing results and ask
DEC to follow the procedures they wrote.

Code Enforcement/Junk Cars- Supervisor Owens
Roger Rumsey, Code Enforcement Officer, is putting,job description ad for
newspaper together for assistant asking for interested applicants to contact him.
Discussion of how residents need to be informed about Junk Car Law followed.
Junk Car Law to be published in community newsletter and names of car haulers to be
"included.

Calls to date 221. New members are R J Switzer, Jay Newport, Ron Clark, John
Mainville, Brian Jackson and George Laue.
Highway Superintendent - Ron Updike
Speed Limit- Enfield Elementary School - Letter from Regional Director of
Transportation stating if flashers are put up at school, State and school district won't
maintain, will be up to to town to maintain. Highway work permit papers to be
completed for town to work in state's right of way included with letter. This is a method
of making sure town workers are covered under insurance. State willing to waiver fee
if town wants to do this. Town would have to obtain a$1,000.00 bond to do this from a
bonding agent. Suggestion made that town ask for State Police patrol of this area,
issue ticket, use this avenue first. Town would have to foot bill, since we don't have a
high number of students walking. Flashing lights only good during school hours. Not
responsible for children returning to school after school hours.

PERLAITS
1. No permit shall be required for the following works undertaken where the
• state does not own fishing rights or where the stream is not on other lands owned by
the state:
a. Stream crossings, provided the disturbance of the bed
or banks is limited for fifty (50) feet above and below the
crossing.
b. Channel clearing or realignment of streams that involve less
than one hundred (100) lineal feet of stream in any mile of
length.
Notification
Notification shall be given to the local permit agent 24 hours
before undertaking work covered by this memorandum for
which no permit is required.
andarda of Performance
All work shall meet the following standards:
a. The project shall not obstruct the upstream or downstream movement
of fish. (Culverts and the floors of box culverts and bridges shall be, as
nearly, flush with the stream bed.)
b. Sufficient flow of water shall be maintained at all times to sustain
aquatic life downstream.
c. Any culvert, box culvert or bridge floor shall be designed to provide
a V or dish-shaped channel, to concentrate flow during periods of low
water and facilitate the movement of fish.
d. Disturbance of the streambed shall be kept at an absolute minimum,
and the stream bed shall be returned as nearly as possible to its original
condition, or better.
(Where possible, in modifying a stream bed, the center line shall be
8 to 12 inches lower than the toe of the channel bank, to concentrate
the flow of water.)
e. Where work necessitates disturbing banks, they shall be returned to
original condition or they shall be graded to a I vertical to 3. horizontal slope,
and rip-rapped or planted with suitable grasses, trees and shrubs so as
to prevent erosion. All tree and brush removal shall be kept to a minimum.
f. Any dike or cofferdam required to facilitate construction shall be erected
in such a manner that stream flow will not be sufficiently reduced to
endanger fish life downstream and such dike or coffer dam shall be
erected of materials that will not contribute substantially to the turbidity
or siltation of the stream

g. During the project, care shall be taken to prevent or reduce to a
minimum any damage to any stream from pollution by debris,
sediment, or other material, or from the manipulation of
equipment and/or materials in or near such streams. Water that
has been used for washing or processing, or that contains oils or
sediments that will reduce the quality of the water in the stream shall
not be directly returned to a stream. Such waters will be diverted
through a settling basin or filter before going directly Into the stream.
h. If water is taken from a stream for construction purposes and an
impounding structure is necessary, such structure shall be erected
in a manner causing the least possible disturbance to the stream.
i. In all cases involving in a stream, every effort should be made to
return the stream to the highest possible standard for aesthetic value,
water quality and fish habitat.
2. All other work falling within the jurisdiction of Conservation Law, Title 5 of
Article 15 shall be carried out only after complying with Part 608 of Codes,
Rules and Regulations of New York State and obtaining the necessary permits
for the proposed work.
NOTE: Emergency Work - See: Part 608.8 (Codes, Rules and Regulations
of the State of New York)
NOTE: Excavation or fill of navigable waters is not covered under this
Memorandum, and a permit is required. See: Part 608.4 (Codes,
Rules and Regulations of the State of New York)
NOTE: Construction, reconstruction or repair of dams and docks may
require a permit. See: Part 608.3 (Codes, Rules and
Regulations of the State of New York)
Review of Public Works Plans
1. It is understood by both parties that the Town of Enfield will keep the
Department of Environmental Conservation informed, through the Ioc:al
permit agent, of all plans and specifications of proposed works that are
covered by this Memorandum, and shall make such plans available on
request at the Town Clerk's offices. The local permit agent may make such
recommendations as may be pertinent for the preservation of water quality that
will be consistent with the best interests of the public. All such recommendations
shall be within the framework of acceptable engineering practices. •
2. It is further understood by both parties that the local permit agent, upon such
notice from the Town of Enfield, will complete his review and make known his
recommendations,,so as to facilitate the project.

Rescission of Memorandum of Understanding
If the required notification is not furnished or if in thel opinion of the Department
of Environmental Conservation, the Town of Enfield fails to conform to one or
more of the above standards or the recommendations of the permit agent, the
DEPARTMENT may unilaterally rescind this Memorandum of Understanding.
Such rescission shall be effective upon receipt of written notice by the Town of
Enfield.
It is the intent of the Memorandum of Understanding, through the mutual
cooperation of both the Department of Environmental Conservation and the Town
of Enfield, to facilitate Town of Enfield public works projects, preserve to the
fullest the duality of the water resources, and remain consistent with the best
interests of the public.
The resolution authorizing the execution of this agreement by the Town of Enfield
is made a part hereof.

the Equipment Reserve for the purctiase of a air flow mini-sett spreader.
Motion made by Councilman VanNederynen and seconded by Councilman
Achilles that the Town Board of the Town of Enfield approve the spending of
$1,465.00 Equipment Reserve funds for the purchase of an airflow mini-salt spreader.

Town will be receiving 50% reimbursement for wood chipper.
MONTHLY BILLS:
Motion made by Councilman Achilles and seconded by Councilman
VanNederynen that the Town Board of the Town of Enfield approve for payment from
General Funds warrants 1-29 in the amount of $40,265.32, Highway Funds warrants
1-14 in the amount of $4,797.11 and Small Cities Grant (HUD) warrants 1-3 in the
amount of $17,459.11 for a total of $62,522.50.

9.) Sick Leave Policy: All full-time Highway Employees will be granted eight
(8) hour as sick leave/month which may be accumulated to 120 days. Upon
retirement with ten (10) years of service, an employee shall receive one (1) hour •
pay for each sigh;-hour day accumulated for a maximum of 120 hours (three weeks).
10.) The current IRS mileage rate wilt be paid.to an employee or elected official for use
of a personal vehicle for Town business. The Highway Superintendent must give .prior
approval to Highway Employees while the Town Board approves all others.
11.) Health Insuiranw: Covcragc for full time Highway Employees who are presently
insured by the Town (family/ndividuat) Is provided by the Town. Any Highway
Employee hired as of 1/1193 on a full-time basis, will be.provided with single
(individual) coverage by the Town with the family coverage available through the
Town at the employees expense.
12.) Health Insurance: Coverage for full-time Highway employees retiring from the
Town having worked for the Town for at least 10 consecutive years, will be provided by
the Town upon approval of the Town Board. This coverage will be individual with the
option of family coverage at the retirees expense. Those retired as of Dec. 31, 1993
are exerript from this policy. Upon reaching age 65, retirees health care coverage will
become Medicare: Supplemental provided by the Town.

14.) The Planning Board shall adopt rules and regulations in respect to procedure
before it and in respect to any subject matter over which it has jurisdiction under Town
Law 272 or any other stature, after public hearing by the Planning. Board and subject
to the Town Board.
15.) The superintendent of Highways is authorized to purchase equipment, tools, and
implements during the year without prior approval of the Town Board.
16.) The superintendent of Highways is authorized to open competitive bids on Public
Works and purchase contracts required to be advertised.
17.) The Tompkins County Trust Co., the First National Bank of Dryden, and the MBIA-
Municipal Investors Service Corporation.
18.) Ail public officials are required by law to take the oath of office. This includes all
appointed as well as elected officials. If within 15 days of appointment or when office

Anticipates John Benson, Architect, will be at the February 1, 1995 Town Board

plan construction ideas, vault area, so we can apply for seconded SARA Grant.

Medicare Supplemental Insurance \ Have not moved retirees sixty-five years of
age, wanted to make sure they had ample time to understand what was happening.
No rash moves until coverage is continuous.

VanNederynen that the Town Board of the Town of Enfield hold a Joint Planning
Board Meeting with the Town Planning Board and Tracy Smith to be held February 21,
1995 at the Enfield Community Building.at 7:45 p.m.

Fire Disaster and EMS Advisory 3oard
Motion made by Councilman Achilles and seconded by Councilman Clark that the
Town Board of the Town of Enfield appoint Rich Neno and Carl Newhart to the Fire
Disaster and EMS Advisory Board as representatives for the Town of Enfield.
