HomeMy WebLinkAbout1993-11-17 87 TOWN OF ENFIELD TOWN BOARD MINUTES The Special Town Board Meeting of the Enfield Town Board was held on Wednesday, November 17 , 1993 at 7 : 30 p .m. at the Enfield Community Building, 182 Enfield Main Road, Ithaca, NY , with the following members present : PRESENT: Jean Owens , Supervisor Robert Linton, Councilman Pat Dougherty, Councilwoman Donald Lovelace, Councilman Linda VanNederynen, Councilwoman OTHERS PRESENT: Betty F . Poole, Interim Town Clerk Ronald Updike, Highway Superintendent Alice Laue, Town Clerk-Elect Gary Achilles , Town Councilman-Elect PLEDGE OF ALLEGIANCE Supervisor Owens led the assemblage in the Pledge of Allegiance to the American Flag. INSURANCE PRESENTATIONS Mr . John Congdon of New York Municipal Insurance Reciprocal - Wright Municipal Management made his presentation to the board and explained the differences in his company as opposed to other companies . Mr. Luciano Lama of L .A. Lama Insurance made his presentation to the board. Mr. Jeff Farmer of Sprague Insurance Company made his presentation to the board . The Town Board discussed the differences in the proposals and the Supervisor asked the board to review all of the documentation and to be prepared to address it at the December Town Board Meeting . JUNK CAR LAW iSupervisor Owens commented on the "Draft" Junk Car Law which was developed by the Junk Car Committee and with the guidance of the Town Attorney, Bob Mulvey . Councilman Dougherty noted that under Section 2 , Legislative Intent , down to line 9, the last word on the line, the work state should be changed to town . She also noted that in Section 13 , Fencing, the sixth line down should read, not nearer than fifty feet from the "edge of the public highway right of way" . Also in 88 the second paragraph, fourth line down where it refers to legislative body, and in the past the word "legislative body" was changed to "Town Board"' . Councilman Linton stated that he had some modifications he would like to suggest . He stated that the resolution that was passed by the Town Board to bring this copy to the Attorney and to the Town Board required that there be an appeals procedure in it . Councilman Lovelace stated that it is in the proposed local law however it was not actually an appeals that they were looking for but a way to keep the junk cars or other vehicles so they put in a waiver in order that people could keep rebuildable classics, seasonal vehicles , etc. Councilman Linton went on to say that they are good provisions but what he was concerned about and the reason he put it in the resolution was an appeals procedure for people that were issued an appearance ticket to go in front of an appeals board in order that they may state their case before they are to appear in court . This is the kind of appeals procedure that he thought would be spelled out in this law. It was suggested that a "Section 17" be added to accommodate the appeals process which Councilman Linton has suggested. Councilman Linton also stated that there is no provision in the proposed law which covers inside storage of junk cars . There is no exemption or provision for those types in here. If you read this , you would find that even though your cars are inside a building or garage, they are going to be counted in the number of vehicles that brings you in violation. He feels that there should be an exemption for any vehicles that are kept inside a building. He feels that a provision regarding enclosed storage should also be added. Councilman VanNederynen suggested that a section be added to incorporate the appointment of a Junk Car Enforcement Officer . It was suggested that the Town Attorney be involved in adding these provisions . Supervisor Owens will report back to the Town Board at the December meeting with the additions noted. ENFIELD BAPTIST CHURCH • Supervisor Owens introduced Matt Steele who would like to address the Town Board. He stated that their church is growing and would like to put on an addition. One of the problems they are facing is that they do not have any plumbing . They would like to "modernize" with the addition as well as bathrooms and a kitchen. The Health Department states that they do not have enough property to put in a septic system. What they would like to do 89 ENFIELD SPECIAL T.B . MINUTES 3 NOVEMBER 17 , 1993 would to be to tie in to the Town' s sanitary sewer system at the Town barn. They would pay for any costs involved with that proposal . He went on to explain what materials and such would be used and responsibilities for maintenance and costs . They would also be willing to absorb any cost in expanding the present system, if need be. He is requesting the approval from the Board. Discussion followed on the floor regarding a public entity and private entity . There would be a question of the separation of church and state . Councilman Linton suggested that they contact the Health Department to get their specifications . He seems to think that the property located across the road from the church would be ideal . It would seem that there would be enough fall from the church to across the road to accommodate a system to meet their needs . Supervisor Owens will check with the Albany leg-al counsel to see if there would be any conflict regarding the church and state issue. She will report to back to the board . Also Matt Steele will pursue their options with the health department and also report back to the board. CONSIDER AWARD OF BID FOR REPLACEMENT OF ENFIELD COMMUNITY BUILDING ROOF Supervisor Owens stated that she spoke with several contractors and an engineer Dan Walker regarding the building's renovation etc . Highway Superintendent Ron Updike opened the bid and read the bid proposal from Charles Hubbell Construction, Inc . in the amount of $43 , 734 . 00 . If a performance bond is required, add $2 , 186 . 70 to above estimate . • Supervisor Owens will place the item on the December agenda. SET DATE FOR PUBLIC HEARING TO CONSIDER 1994 CONTRACT WITH THE ENFIELD VOLUNTEER FIRE COMPANY RESOLUTION: Motion by : Councilman Linton Seconded by: Councilman Dougherty RESOLVED, that the Town Board of the Town of Enfield hereby authorizes and directs the Town Clerk to advertise for a public hearing to consider the 1994 contract with the Enfield Volunteer 90 ENFIELD SPECIAL T. S . MINUTES 4 NOVEMBER 17 , 1993 Fire Company . Said public hearing is to be held at the regular town board meeting on December 1 , 1993 at 7 : 30 p .m. CARRIED UNANIMOUSLY ADJOURNMENT RESOLUTION: Motion by : Councilman Linton Seconded by : Councilman VanNederynen RESOLVED, that the Town Board meeting was adjourned at 10 : 25 p .m.
