Adjournment 35 TOWN OF ENFIELD TOWN OF ENFIELD TOWN BOARD MINUTES SEPTEMBER 1, 1993 The regular meeting of the Enfield Town Board was called to order at 7 : 30 p.m. at the Enfield Community Building, Enfield Main Road, Ithaca, New York 14850 , with the following members present : PRESENT: Robert Linton, Deputy Town Supervisor Pat Dougherty, Councilwoman Donald Lovelace, Councilman Linda VanNederynen, Councilwoman EXCUSED: Jean Owens , Supervisor OTHERS PRESENT: Betty F. Poole, Interim Town Clerk Ronald Updike, Highway Superintendent M. Clyde Hubbell , Town Historian John Smith, Cemetery Committee Daniel Winch, T. C . Board of Representatives MEDIA PRESENT: Jeff Stimson, Ithaca Journal Reporter PLEDGE OF ALLEGIANCE The Deputy Town Supervisor led the assemblage in the Pledge of Allegiance to the American Flag. APPROVAL OF MINUTES OF THE AUGUST 4, 1993 TOWN BOARD MEETING RESOLUTION: Motion by: Councilman VanNederynen_ Seconded by: Councilman Dougherty RESOLVED, that the Town Board of the Town of Enfield hereby approves the minutes of the August 4 , 1993 Regular Town Board Meeting as written. Carried Unanimously • PRIVILEGE OF THE FLOOR No one in attendance wished to speak. 36 COMMUNICATIONS Community Youth. Services : Deputy Supervisor Linton read a copy of a letter from Janice M. Johnson, Coordinator of Community Youth Services for the Tompkins County Youth Bureau. She commended Jessica Conners and others on their_ production of the Enfield Summer program and the work they are doing for the Enfield teens . Marnie Kirchgessner commented that a representative from the Youth Bureau was present at the production and was extremely impressed with how many older teenagers were involved with the program. She was very happy with the response the camp received this year and this ties in with the request for additional funds for summer camp this year by the Council in order to facilitate the increase in involvement with the camp . Letter From Town of Chester Deputy Supervisor Linton stated that he believed that this letter was in response to a resolution which was passed by the Board and forwarded to the Town of Chester, supporting their efforts in getting the State to recognize the problems with a camp located in their township . They are thanking the Town of Enfield for their support . COMMITTEES County Board of Representatives Tompkins County Board of Representative Dan Winch spoke regarding the expected approval of excess funds to Enfield for youth services . He stated that his position has always been that for every dollar we spend on youth services is money well spent . He further stated that at the County level , it is pre-budget season and that they will have a tough time putting together a budget as are others . He expressed his concerns with the CHIPS funding as well as public works budgets . Dog Warden As Lorraine Bard was not able to attend the meeting, there was no Junk Car Committee Councilman Dougherty gave a synopsis of her findings on the first twr5 questions posed in the Junk Car Survey, which had been received up to this point . There were 82 people who had responded. 37 ENFIELD T.B. MINUTES 3 SEPTEMBER 1, 1993 • Highway Superintendent Ron Updike stated that he had heard that if someone turned in a survey which was not signed, it would be counted differently in the results . Councilman Dougherty responded by say that she had not heard anything about that however the 82 she looked at , there was only one which did not give their name. She also stated that she would like the envelopes for address purposes and asked the Town Clerk to retain them for her . Town Historian Jack Hubble asked what assurances we had that these figures would not be quoted in the Ithaca Journal . He felt that if they were, this could sway any future residents who might answer the survey . Deputy Supervisor Linton reassured the Board and those in attendance that what Pat just stated is only a preview and the information is not official . He also asked the Ithaca Journal reporter to qualify any information before it is printed. He asked the reporter to hold off printing any numbers until after all of the surveys are in and tallied. It was suggested that someone should move to hold a special "Junk Car Committee" meeting in order to finalize the survey results and: put it in reportable form. This meeting should be held after the deadline for the survey . RESOLUTION: Motion. by: Councilman Lovelace Seconded by : Councilman Dougherty RESOLVED, that the Town Board of the Town of Enfield hereby directs the Enfield Junk Car Committee to hold a meeting in order that they may discuss the final results of the survey and that they prepare a report to submit to the Town Board at their October Town Board meeting and be it further, RESOLVED, that the Enfield Junk Car Committee will meet at 7 :00 p .m. on Wednesday, September 22 , 1993 at the Enfield Community • Building and that said meeting will be open to the public . CARRIED UNANIMOUSLY Discussion followed regarding the procedure for consolidating the survey results and method-s being used. 38 ENFIELD T.B. MINUTES 4 SEPTEMBER 1, 1993 • Enfield Community Council Marnie Kirchgessner distributed minutes of the last Enfield Community Council meeting and their financial statement as of August 31 , 1993 to the board . Marnie mentioned the fact that some of Justice Townley' s memorial fund checks were made payable to the Enfield Community Center rather than the Enfield Community Council . His wife, Bonnie Townley, had suggested that the funds from the donations be used for something for the courts . Marnie stated that there was a slight problem in that the Enfield Community Center has nothing to do with the Enfield Court system and that possibly the checks should have been made payable to the Enfield Communitv Center. She has approximately $110 . 00 and Mrs . Townley also has some additional monies . Tompkins County Board Representative Dar_ Winch suggested that someone should contact the Town Attorney or the State Attorneys office regarding the di.spersement of monies from a memorial fund to see, if any, what the legal ramifications are since the checks were payable to the council in error. The Board suggested that the Town Supervisor should be the one to contact the appropriate counsel . Marnie went on to explain that the Tompkins County Youth Bureau has recalculated the way they disburse funds for the amount of reimbursement . This calculation is based on the number of children under the age of 18 . Because of Enfield' s growth in that age category in the last census , Enfield has come out ahead in the level of state reimbursement . It is not a large sum of money but it is an improvement . The Council received approximately $2 , 625 in additional rollover money used to match money from the PTA to provide bus transportation for summer camp and other needs . She further reported that the Summer Camp served 119 youth with an average daily attendance of 74 people . She also stated that • they have hired the staff for the After School Program which will start on September 8th. Deputy Town Supervisor Linton commented on the figures in the budget and Supervisor Owens has the estimated revenues for the youth program as being increased from $2 ,000 to $2 , 160 . He also noted that the Town money has been increased by about $200 . Deputy Town Supervisor Linton stated that he believes that the 39 ENFIELD T.B. MINUTES 5 SEPTEMBER 1 , 1993 State requires towns to have a "Preliminary" budget adopted by October 5 , 1993 and the meeting is not until the 6th. There will be a one day delay, however, he does not feel that the State will object . Enfield Fire Company Greg Kirchgessner distributed the 2nd quarterly report for the Fire Company as of 6/30/93 and went on to explain the report . He further stated that the next quarterly report will be due soon. Highway Superintendent Superintendent Updike reported on the various tasks the highway department has undertaken in the past month, namely VanDorn Road and new culvert pipes . He is hoping that VanDorn Road will be completed around the 15th of September however he cannot guarantee that date. He also reported that he had met with the Town of Newfield and they have agreed to renaming a portion of VanOstrand Rd as follows : The Town Line Road for approximately +/- . 51 miles has been renamed VanOstrand making VanOstrand run from Route 13/Millard Hill Road to Douglas Road. The Town of Newfield renamed their old VanOstrand Road to Short Road. Greg Kirchgessner asked if that would make a difference as far as fire protection. Highway Superintendent Updike responded that it is right on the Town Line Road between the houses the fire department covers on Townline Road and would be the same. There is no change in municipal ownership and therefore should not affect protection. Deputy Supervisor Linton noted that the resolution Mr. Updike has requested will be voted on later under "Unfinished Business Highway Superintendent Updike also reported on numerous projects the department has been working on such as the handicapped access to the Community Building . He stated that they discovered that there is a well casing outside and have some idea as to where it is located but asked the board' s concurrence for only putting half the concrete slab work in, as long as it meets required standards and code. Mr . Updike also reported on the current status of the CHIPS money and that he has not heard anything yet . County Board Representative Dan Winch reported that the County ENFIELD T.B. MINUTES 6 SEPTEMBER 1, 1993 has taken the position not to hold up work and to go ahead and use the funds . He stated that if there is a challenge and that. the challenge would come after the bonds have been sold and you cannot "unsell" bonds . The County figures that once the State has the money they will have to distribute the funds accordingly . He feels that if there is an overturning of the ruling and given the fact that there are so many town boards etc . . , they would be up in arms and that the State Legislature would have to rectify the expense. Councilman Dougherty asked if the leak by the door at the Town Hall has been repaired. It seems that when anyone walks in, they get rained on. Superintendent Updike stated that it was the eaves and possibly they could be plugged or have a leak. He assured Councilman Dougherty that he would check and see that is was corrected. Town Historian Town Historian Jack Hubbell reported on the One Room School House reunion which was recently held and that there was a very good turn out . The reunion was advertised as a "First Annual" and it is hoped that it will continue and grow. He went on to report that he had just learned today that there is a book, entitled "Death Benefit" in which there is quite a bit of information in it pertaining to Enfield. It mentions several families and one individual in particular who was convicted of doing away with people for insurance benefits . He encouraged everyone to read it if they got the chance. He also reported to the Town Board that he felt that the Town Hall lacks security. The door between the garage bays and the Town Hall room .is not secure. Discussion followed on a solution to corre-ct the problem. Highway Superintendent Updike stated that he has a key to that door and that he could lock it . This would secure the Town Hall area from the shop into the Town Hall office area . They would S still have the crash doors for an emergency exit . The Town Board directed the Town Highway Superintendent to take the responsibility for keeping the door secure. 41 ENFIELD T.B. MINUTES 7 SEPTEMBER 1, 1993 PLANNING $OARD Town Planning Board - No one was in attendance . County Planning Board - No one was in attendance. Public Safety Committee Councilman VanNederynen reported that she had spoken briefly with Greg Kirchgessner regarding the Fire Committee's program to inspect various properties within the Town to determine accessibility for emergency vehicles . They agreed that the Public Safety Committee along with the Fire Company will work together on this program. Highway Superintendent Updike stated that he had spoken with Jack Miller , T.C . Fire and Disaster Coordinator, and asked him how we can better number the houses and make them clear to any emergency vehicle which might be called to a particular residence and to help them identify it . He also stated that the subject of "911" came up and since the fire on Danby Road recently, there has .b_ee.-n a resurgence of talk about trying to get the 911 system in the Tompkins County area. Jack_.M-ill-e-r to-ld him that with the phone systems now, a-nd if -there are no duplicate road names within a p-articular 273 , 257 , 387 , etc. , and if they can keep duplicate names out of those areas , the new systems would display numbers and addresses at Fire Central . Greg Kirchgessner responded to Councilman VanNederynen=s comment about the program and that the Fire Company would make recommendations to the homeowners , i . e . removing limbs to enable a better view of the residence. This is what they are looking at at this point . Councilman VanYederynen suggested displaying house numbers prominently on mailboxes etc . . . She also stated that they would like to keep communications open between the Code Enforcement Officer, House Enumerator, Fire Company and any other pertinent persons who might be involved. . Cemetery Committee John Smith spoke about various activities the committee has been dealing with recently. He mentioned several letters he had received where people are writing to inquire about numerous sites of relatives which might be buried in the cemeteries . He reported that he went to Budd Cemetery to remove the old fencing which will take some time as there are large posts which 42 ENFIELD T.B. MINUTES 8 SEPTEMBER 1 , 1993 0 are difficult to remove. They have installed the new fencing which looks very nice . MONTHLY BILLS Councilman Dougherty asked if everything was ready for the primary. Betty Poole, Interim Town Clerk, stated that the Tompkins County Board of Elections has the responsibility of notifying the election inspectors and that the Town Clerk notifies the election custodians regarding the machines . She further stated that this has all been taken care of and that everything is in place. Councilman Dougherty asked the Board if it would be possible to amend the list of bills to be paid to include two bills which she had presented to the Town Clerk prior to tonight ' s meeting . These bills represent the printing of the Junk Car Survey and the printing of the address labels . The two bills , one for PIP Printing in the amount of $480 . 00 and the other for Seneca Computer Services for $38 . 75 , totalling $518 . 75 . These would be added to the General Fund Account bills presented this evening. RESOLUTION: Motion by: Councilman Lovelace Seconded by: Councilman VanNederynen RESOLVED, that the Town Board of the Town of Enfield hereby approves for payment Warrants 9-93 , as amended, for the following amounts : GENERAL FUND -----------------------$ 6,842 . 54 HIGHWAY FUND -----------------------$ 9,354. 49 Carried Unanimously RESOLUTION: Motion by: Councilman Lovelace Seconded by : Councilman • VanNederynen RESOLVED, that the Town Board requests a 10 minute recess at 9: 10 p.m. and will resume at 9 : 20 p .m. Carried Unanimously Deputy Town Supervisor Linton reconvened the meeting at 9 : 29 p.m. 43 ENFIELD T.B. MINUTES 9 SEPTEMBER 1 , 1993 • UNFINISHED BUSINESS Volunteer Reco_g.niti-o-n Deputy Supervisor Linton read a letter from Penny Boynton, Chair of the Tompkins County Youth Board, informing the Town that Marnie Kirchgessner has been chosen for a Youth Service Award. This award is designed to honor individuals who make positive changes in the lives of children, youth and families and/or the conditions that affect them in Tompkins County. They encouraged the Town and Enfield Community Council to honor Marnie in any way appropriate. Deputy Supervisor Linton remarked that Supervisor Owens had mentioned to him the possibility of some sort of recognition function. Councilman VanNederynen referred to the August Town Board minutes in which it was suggested that a get together with punch and cookies or something along that line to honor all who volunteer in the Enfield community be organized. The Board designated Supervisor Owens to follow up on the event and report back to the Board at a future date. Town Historian Jack Hubbell stated that he had approached Supervisor Owens on the issue of lowering the flag on the Town Hall at half mast upon the death of any elected town official while in office, as he did the day of Town Justice Dale Townley' s funeral . Councilman VanNederynen suggested that the volunteer recognition event be put on the October agenda as a follow up. Marnie suggested that possibly the Fall Festival would be a good forum to hold this event . Discussion followed regarding the numerous people in the Enfield area who do volunteer work and do not get recognized, such as the • people who work in the cemeteries , the historian, the volunteer firemen, etc . Deputy Supervisor Linton stated that possibly they would have more ideas at the next meeting . 44 ENFIELD T . B . MINUTES 10 SEPTEMBER 1 , 1993 • Dog Enumerator RESOLUTION: Motion by: Councilman Dougherty Seconded by : Councilman VanNederynen RESOLVED, that the Town Board of the Town of Enfield hereby approves the appointment of Martin Schreiber of 547 Enfield Center Road, Ithaca, New York as the Town of Enfield Dog Enumerator effective September 1 , 1993 and be it further RESOLVED, that Mr. Schreiber be paid $1 . 00 per dog enumerated plus mileage to perform said enumeration. Carried Unanimously Renaming of Portion of Townline Road RESOLUTION: Motion by: Councilman VanNederynen Seconded by: Councilman Dougherty RESOLVED, that the Town Board of the Town of Enfield hereby accepts the renaming of the Town Line Road as frl'llows : The Town Line Road for approximately +/- . 51 miles renaming that portion of VanOstrand and making VanOstrand run from Route 13/Millard Hill Road to Douglas Road. Carried Unanimously NEW BUSINESS TENTATIVE Budget Deputy Town Supervisor Linton noted that the Board has received the Tentative Town Budget and will need to be adopted at the October Town Board Meeting . This is for informational purposes and the Board should review the material and be ready for the next meeting. Town Justice Vacancy • Supervisor Owens has informed Deputy Supervisor Linton that the Honorable Roger Rector , Justice for Town of Ulysses , has agreed to fill the vacancy in the Enfield Town Justice position until December 31 , 1993 . 45 ENFIELD T.B. MINUTES 11 SEPTEMBER 1, 1993 • RESOLUTION: ' Motion by: Councilman Lovelace Seconded by : Coun-c.il.man VanNederynen WHEREAS, a vacancy has occurred as a result of the untimely death of the Honorable Dale A. Townley, Town Justice for the Town of Enfield and WHEREAS, the Town of Enfield is in need of a Town Justice to replace Justice Townley until a new Town Justice is elected and sworn in January 1 , 1994 and WHEREAS, The Honorable Roger Rector served as Interim Town Justice for the Town of Enfield honorably in 1992 and has agreed to serve again, now therefore be it RESOLVED, that the Town Board of the Town of Enfield hereby approves the appointment of Honorable Roger Rector, Town Justice of the Town of Ulysses to serve as Interim Town Justice for the Town of Enfield for an interim period from September 1 , 1993 to December 31 , 1993 and be it further RESOLVED, that the Town of Enfield agrees to pay the Honorable Roger Rector an annual salary rate of $8 , 000 prorated from September 1 , 1993 to December 31 , 1993 and be it further RESOLVED, that this appointment is contingent upon the Town of Ulysses' Town Board approval at their next Town Board meeting and upon the approval of Administrative Judge Robert Coutant of the Sixth Judicial District and the Office of Court Administration of the State of New York. CARRIED UNANIMOUSLY Community Building Renovations Deputy Town Supervisor Linton stated that he is not familiar with this item . He is aware, however, that the building is in need of a new roof . • Councilman. Lovelace stated that he is only aware that Supervisor Owens has been looking in to some monies, grants , etc . to work on the renovation of the Community Building. Deputy Supervisor Linton suggested that this item be put on the October Town Board agenda . 46 ENFIELD T .B . MINUTES 12 SEP`rEMBER 1 , 1993 • Three Party Custody Agreement The Town Board unanimously suggested that this item be on the October 1993 Town Board Agenda as they do not have sufficient information and would not be able to vote on. the agreement until more information is made available to them and that they receive a copy of the agreement proposed. Support Workers Compensation Insurance Regulation Deputy Supervisor Linton briefed the Town Board on a letter received from Assemblyman Martin Luster regarding the Wicks Law. This proposed Governor' s Workers ' Compensation Managed Care Bill would begin the process of treating workers injured on-the-job through Health Maintenance Organizations (HMOs) or other managed care facilities . He is requesting a letter of support from local municipalities be sent to the Honorable Ralph J . Marino and the Honorable Mario Cuomo . Discussion followed on the floor. . RE130LUT I ON: Motion by: Councilman VanNederynen Seconded by: Councilman Dougherty RESOLVED, that the Town Board of the Town of. Enfield hereby authorizes Town Supervisor Jean Owens to send a letter of support regarding Worker' s Compensation insurance regulations to the respective persons on behalf of the Town Board for the stated purpose.
