MINUTES 2 AUGUST 4, 1993 • TOWN OF ENFIELD TOWN BOARD MINUTES AUGUST 4, 1993 The regular meeting of the Town of Enfield Town Board, held at the Enfield. Community Building , 182 Enfield Main Road, Ithaca, NY was called to order at 7 : 35 p.m. with the following members present : PRESENT: Jean Owens , Supervisor Pat Dougherty, Councilman Linda VanNederynen, Councilman Donald Lovelace, Councilman EXCUSED: Robert Linton, Councilman OTHERS PRESENT: Ronald Updike, Highway Superintendent M . Clyde Hubbell , Town Historian Betty F . Poole, Interim Town Clerk John Smith, Cemetery Committee PLEDGE OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance to the American Flag. APPROVAL OF MINUTES OF THE JULY 7 , 1993 REGULAR TOWN BOARD MEETING RESOLUTION: Motion by : Councilman VanNederynen, Seconded by Councilman Dougherty RESOLVED, that the Town Board of the Town of Enfield hereby approves the minutes of the July 7 , 1993 Regular Town Board Meeting as written. Carried Unanimously PRIVILEGE OF THE FLOOR No one in attendance wished to speak. • COMMUNICATIONS Supervisor Owens reported that she had received information from Robert Mulvey, Attorney for the Town, regarding cemetery bank accounts . He has suggested that the Town should not combine the cemetery "Trust Fund" accounts with the other cemetery account . At a previous meeting a motion was made to combine the two cemetery accounts in to one to be known as the "Enfield Cemetery Trust Fund" . Attorney Mulvey stated that funds specifically set aside 24 ENFIELD T.B. MINUTES 3 AUGUST 4, 1993 for the care of a particular plot were accepted by the town for • that purpose and are not to be combined with any other funds . He suggested that any additional funds the Town receives should be incorporated in the Enfield Cemetery Trust Fund. Supervisor Owens also reported that she had received a letter from Tompkins County Board Representative Beverly Livesay regarding illegally dumped trash along town, county and, state roads and the procedure for clean-up and disposal . The letter essentially states that in the event the Solid Waste Investigator is unable to identify the perpetrator , the municipality will be responsible for the removal of the trash . The County will waive the disposal fee at the County Transfer Station to the municipalities for such purpose . COMMITTEES Tompkins County Board Representative Dan Winch, County Board Representative was unable to attend the Town Board Meeting as he had a previous commitment . Junk Car Committee Supervisor Owens stated that the committee has met twice within the month. She also reported that Councilman Dougherty , Councilman Lovelace and herself met this past Saturday to develop a questionnaire to be circulated to town residents . She also wanted to thank Bonnie Griffin for her efforts in assisting them with the survey . Supervisor Owens solicited comments from the Board. Councilman Lovelace noted that three paragraphs from Supervisor Owen' s notes had been omitted from the "proposed" survey and asked if they were going to be incorporated in the "final" cop_ . Councilman Dougherty responded by saying that they had been retyped and that she did not even make any comparisons . The only thing she did was check the phone numbers . She asked that she get a copy of Supervisor Owen' s original notes and that the omitted paragraphs be noted so she could correct the error on her computer disk. • Supervisor Owens remarked that she was not totally comfortable as to how the questionnaires were going to be handled when they were returned. She had talked to Councilman Linton regarding this and he suggested that because of the significance and importance of the responses that it would be worthy of the entire Town Board to sit down and review them. Councilman Dougherty stated that since she had a computer she would 17 ENFIELD T.B . MINUTES 4 AUGUST 4 , 1993 • be willing to pick up the survey and enter them in her computer and compile the data . Supervisor Owens responded by saying that it is a more formal and proper procedure to have the Town Board open and review them as a board. It would be more appropriate, in her opinion, for the surveys to come directly to perhaps the Town Clerk, who is the official record keeper of the Town. Once gathered, the Town Board would be able to open the surveys and review the comments as a whole. Then at that time the data could be compiled. Councilman VanNederynen commented that there are all sides to this issue that may say well , these are all going to Councilman Dougherty and we know where she stands. . She feels that to protect the Board from controversy, someone outside of the Board and the committee should receive them. Supervisor Owens went on to say that she had been exploring the possibility of using the Enfield Community Council 's Bulk Mail Permit . John Smith responded by saying that if the Town did use their permit , the Community Council ' s name would have to be put on the survey as the sender . Several Board members expressed their concern over using the Council 's permit as this is a sensitive issue within the town and should be under the auspices of the Town Board. John Smith stated that he had spoken with someone at the post office to inquire about the cost of the Town of Enfield obtaining their own bulk mailing permit . There would be an initial sign up fee of $75 . 00 which enables you to place an imprint on the items You are mailing rather than using individual postage stamps . Then there would be an annual fee of $75 . 00 , which you would pay only if the bulk permit was needed. There is a minimum of 200 pieces to mail in order to use the permit . Supervisor Owens asked for a motion regarding obtaining the bulk mail permit under the Town Board's name and the distribution of the survey. Councilman Dougherty also stated that a copy of the junk car law will accompany the survey for the residents to review. RESOLUTION Motion by: Councilman VanNederynen, Seconded by Councilman Lovelace RESOLVED, that the Town Board of the Town of Enfield hereby authorizes the expenditure of $150 . 00 for the purpose of obtaining a bulk mail permit which includes an initial sign up fee of $75 . 00 28 ENFIELD T..B. MINUTES 5 AUGUST 4 , 1993 and an annual fee of $75 . 00 for 1993 and be it further RESOLVED , that the Town Board authorizes the Junk Car Committee to proceed with the survey development and distribution. Carried Unanimously Enfield Community Council Rose Pelligrino reported on the Council ' s pre-school program and that 5 families have committed. The school will be open three days per week in the mornings . She also reported that the summer camp will be ending soon and has operated within their budget . There will be a performance at the Grange on Wednesday , August 11 , 1993 and she encouraged all to attend. She further stated that they are in the process of recruiting staff for than After School Program. They are trying to retain some of the summer school staff however an ad will need to be published to fill vacancies . They are putting an ad in the Enfield Community Council newsletter as well . They would like to put a preference on hiring Enfield residents if at all possible . There will be the need for a new director as Pat is leaving . She went on to say that the deadline for any information anyone would like to have in the newsletter is August 15th and should be directed to Jessie Connors , 1029 Bostwick Road. She also reported that the Council ' s meetings are held the 3rd monday of every month at 7 : 30 at the Community Building . Enfield Fire Department As no one was present from the Fire Department , there was no report . Highway Superintendent Highway Superintendent Ron Updike reported that they repaired the Hines Road bridge which took about a week . He thanked the County f'or supplying a welder truck and welder . They also installed some culvert pipes for new town residents on Harvey Hill Road and. VanDorn Road. He also has talked with Mr . Tudi Sr . regarding the possibility of changing the one leg of VanOstrand Road which goes out to Millard Hill to Tudi Road or some other name and have VanOstrand Road go straight through to Douglas Road. That is the way it is mapped with the our road inventory with the state . Mr . Tudi has no problems with renaming the one small section of road. He is going to try to attend the Newfield Town Board meeting and 31 ENFIELD T. B . MINUTES 6 AUGUST 4 , 1993 see if they will agree with the proposed change. If so then s will bring it back to this Town Board. Ron reported that he has gotten notification that the Town of Enfield, had won it ' s case in court regarding the CHIPS money however it will be appealed. He was informed that the money will be available however they can not give a definite date. He was told that he could go ahead and do the work and apply for the reimbursement . He called Mr. Bartilota, who is the area representative and asked if we went ahead and did the work and submitted the paperwork for by September 15th for reimbursement by December 15th, would we have the money, He said he did not know and the chances are we would not . He is asking the Town Board for their opinion on what to do . We are talking around $30 ,000 . We will be able to carry it over to 94' if we do not use it however it is more money than we have in the contingency fund to pay the bills . Supervisor Owens stated that she is conservative on the issue. She "likes to see the money in hand. Ron replied that we have to spend it before we get it however they can not guarantee we will get it within this calendar year . Supervisor Owens explained the process . Even if the Town is guaranteed they get the money and if we do not get the money before next year, it indicates that you have a $30 ,000 expenditure without the revenues . If we buy the materials we certainly have to pay the bills for those materials . The consensus of the Board is to hold off on spending any money at this time and directed Ron to check with Assemblyman Luster's office, Syracuse and Albany to see when we could anticipate the monies becoming available . He is to report back to the Board. Historian Town Historian, M. Clyde Hubbell reported that there is going to be a reunion on August 28 for 1 and 2 Room School Houses at the Grange at 2 : 00 p .m. He also stated that he had asked Assemblyman Luster if the State was going to continue funding SARA and he said they were. He said that Mr . Luster also commented that if the Town applies next year for a grant he would appeal to the respective departments on the Town' s behalf which may or may not be a benefit however he did offer his assistance . Planning Boards Town of Enfield Planning Board - No one was in attendance 32 ENFIELD T. B . MINUTES 7 AUGUST 4 , 1993 representing the Town Planning Board. • County Planning Board - Rick Chase was unable to attend the last meeting and therefore had no report . Public Safety Committee Councilman VanNederynen stated that the committee has not met as she was out of town and therefore had no report . Cemetery Committee John Smith reported that he is still in possession of a check which was donated to Enfield for cemetery use. He would like to know if there is an account that he could put it in, possibly the general fund. This way the .funds could be available for general expenses . If it turns out that the money is not for general expenses then it could be transferred to the trust fund for the cemeteries . Councilman VanNederynen asked why there was not a separate account for the operating expenses for the cemeteries? Supervisor Owens stated that the account is now presently titled the "Trust" fund and further stated that the Town could simply put it under general revenues and then transfer the monies . Mr . Smith explained that last year the Town put the molaey in the General Fund. It stayed there until the end of the year and subsequently transferred to the Cemetery account. He wants the money available if needed. Supervisor Owens wanted it noted that Helen Smith, .John' s wife, has painted all of the signs for all of the cemeteries and has done a very nice job. Mr . Smith asked the status of the payment of dues for the New York State Cemetery Association of which he believed was approved at either the June or July Town Board Meeting . He has not heard anything from the association and is concerned as to the payment being made. • Supervisor Owens will check to ensure that payment has been made and report to Mr . Smith. Dog 'Warden Report As Lorraine Bard was not able to make the meeting there was no report . 33 ENFIELD T.B. MINUTES 8 AUGUST 4 , 1993 Monthly Bills RESOLUTION: Motion by : Councilman Dougherty, Seconded by: Councilman Lovelace RESOLVED, that the Town Board of the Town of Enfield hereby approves for payment Warrants 8-93 for the following amounts : GENERAL FUND-----------------$17 , 960 . 94 HIGHWAY FUND-----------------$ 6 , 611 . 06 Carried Unanimously Councilman Dougherty asked for clarification on the status of the dog licenses . Supervisor Owens and Betty Poole reassured her that there is still some minor problems with NYS Ag & Markets getting previous renewals in their computer however this will take at least 4 or 5 months for them to be entered and to get the licenses updated. Hopefully they will be brought up to date soon. Further discussion followed regarding the dog license procedure as well as the Mobile Home Ordinance. It was suggested that these items be discussed with the Town Board after the meeting . Unfinished Business None New Business Supervisor Owens asked if the Board would be willing to authorize a "Volunteer Recognition Affair " . There are a.lot of volunteers in the Enfield community who do alot with the youth, the food distribution programs , fire company and so on, who should be recognized for their support in some way . She further stated that most of the food would be provided. Councilman Lovelace asked what amount of money were wn talking about? Supervisor Owens responded less than $100 . 00 . 34 ENFIELD_ T.B . MINUTES 9 AUGUST 4 , 1993 Councilman VanNederynen suggested a type of a volunteer night • ceremony to recognize them with a certificate and punch and cookies . Possibly some of this could be donated. Councilman Dougherty also thinks that people should be recognized for the things that they do and thought that some form of recognition was a good idea .
