The Special Meeting of the Enfield Town Board and the Enfield Planning
Board was called to order at 7 : 30 pm with the following members of
attending:

Supervisor Owens thanked members of the Planning Board for attending.
She explained the process of the Planning Board developing Policy and
Procedures to bring to the Town Board and a Public Hearing .
Caroline Bingham stated that a policy is varied for different types of
meetings . She said the Planning Board came with a plan for a Public
Forum (Circuit Rider Program) . She felt that planning should go
public.
Councilman VanNederynen commented on the Site Plan Review that was on
top of the Town Board request list .
Sue Webster asked what the Town Board expected of the Planning Board.
Councilman Linton stated that no one is trying to take over. The Town
Board is trying to make sure the Planning Board is complying with the
law.
The Planning Board agreed to follow Roberts Rules of Order. Caroline
Bingham said she understood that each January the Town Board would
like a list of officers and that they operate by Roberts Rules of
Order and a list of meeting dates and times . Caroline Bingham asked
if the Planning Board have jurisdiction over the Site Plan Review and
Subdivision regulations. Supervisor Owens asked if copies of the
resolution answered the question. It was answered - yes .
Caroline Bingham said the Subdivision regulations are about completed
and would like to complete them to present them to the Town Board.
It was stated that the Town Board gave the Planning Board four points
to include with the Site Plan Review Law.
Councilman Linton explained to the Planning Board that the Circuit
Rider Program would bring the Planning Board expenses over budget and
should be requested for the next year' s budget . Caroline Bingham said
the Planning Board needs public input and the Circuit Rider Program
could do this .
Councilman Dougherty said she thought that the Planning Board could
have worked with direct suggestions from the public on site plan
review .
Caroline Bingham said that the Community Council newsletter is sent
out three times a year . Possibly an article on Site Plan Review could
be in it .
Supervisor Owens asked if the Site Plan Review was almost ready for
public review. Councilman Linton commented that Deerfield Park had to
have a set of rules for the Park to be approved by the Town Board.
Caroline Bingham said the original site plan review was taken from two
documents .
Councilman Linton said he had spoken with James Mason about why the
County charge the towns for the Circuit Rider Program. James Mason
told him it was because of budget constraints at the County level .
Without the Circuit Rider Program the County would have to lay off
people. Councilman Linton stated that the county supplies many
services for the city of Ithaca but cannot offer any service to
Enfield.
Councilman Dougherty commented that the whole town would never be in
,agreement . A public forum should be held and advertised in the
Enfield Community Council Newsletter .
Mike Williams said that the mobile home park regulations are almost
completed. Caroline Bingham commented it is now in the hands of the
lawyer . Supervisor Owens said that the public should be informed
before a document occurs . Councilman Lovelace said an informational
meeting should be scheduled with a stipulation that this was not a
finished document (mobile home ordinance) .
Councilman Linton asked why introduce a separate ordinance when it can
be included with the Site Plan Review Law. Councilman VanNederynen
suggested a timeline be set for the Site Plan Review Law to include
public forums , presentation to the Town Board, and public hearings .
Mike Williams asked if the mobile home ordinance could be attached to
the Site Plan Review Law? Councilman Linton answered - yes .
Councilman Lovelace stated that people should be informed that the
mobile home park ordinance would be part of the Site Plan Review Law.
Caroline Bingham asked how the Town Board wants the Planning Board to
deal with a Master Plan. It was answered that the Site Plan Review
Law should be completed. Caroline Bingham said the Planning Board is
in the process of producing an official map .
It was asked if the Planning Board. could meet with the Town Board on a
regular basis . It was answered yes , they, should meet together twice a
year.
Mike Williams made a motion for the Planning Board to take a break for
an executive session. JoElla Moore seconded the motion. Motion
carried.
Supervisor Owens reconvened the meeting . Caroline Bingham announced
that David Thompson is resigning from the Planning Board. Mart-in
Shapiro has not attended the past several Planning Board meetings .
A developer, Berkshire County Development Trust is developing Miller' s
Crossing (Buck Hill Road, Weatherby Road, and Harvey Hill Road area) .
Berkshire has bought. 180 acres . They have no plans for roads , etc.
The developer plans on developing 28 lots . Subdivision approval was
given to Berkshire County Development `trust by the Planning Board for
subdivision. The developer is not meeting restrictions set by the
Planning Board. Caroline Bingham upon discussion with the lawyer,
wrote the developer a letter sent with a return receipt .
A letter was received from the Berkshire lawyer requesting a meeting
with the Planning Board and the Town Attorney. Caroline stated she
wanted the Town Board to be aware of what was happening.
A joint meeting was scheduled with the Planning Board on November 18,
1992 at 7 : 30 pm in the Community Building .
Councilman Linton made a motion to adjourn. Councilman VanNederynen
seconded the motion . Motion carried. Meeting adjourned at 9: 50 pm.
