HomeMy WebLinkAbout1992-02-05 24d February 5, 1992 The Public Hearing of Local Law #1 of 1992 - on Providing for the use of Agricultural Assessments set Forth in Section 305 of the Agriculture and Markets Law in the Special Ad Valorem Levy for the Enfield Fire District was called to order at 7 :30 pm with the following members present : Elected Officials: Other Officials: Supervisor Jean Owens Town Historian M. Clyde Hubbell Councilman Linda VanNederynen Town Clerk Jean Scofield Councilman Robert Linton Town Justice Dale Townley Councilman Pat Dougherty Highway Supt. Ronald Updike Councilman Donald Lovelace Greg Kirchgessner stated that if we allow a reduction of fire taxes for the agricultural exemption, the homeowners would be paying for the fire protection. Councilman Linton responded that the law would provide for the inequity on land assessments on agricultural property. There is approximately $2,700 ,000 exempt agricultural assessments based on the 1992 tax base. The tax rate based on this years base would increase approximately $.05 per thousand. Y There was a comment that the fire tax in Ulysses is $.568 per thousand. Enfield has the highest tax rate. Greg Kirchgessner felt that people do not understand the law and hoped that the town board would not act hastily. Rick Chase was concerned that there may be more than 3% of agricultural exemptions that will be eligible. The Public hearing was closed at 8i05 pm. The regular meeting of the Enfield Town Board was opened at 8 :05 pm. PLEDGE OF ALLEGIANCE MINUTES OF THE JANUARY MEETINGS The minutes of the regular Town Board meeting of January 8, 1992 were corrected to state that the inquiry to Ashley Miller on the classification of Enfield Creek was from Councilman Lovelace not Councilman Linton. Councilman Lovelace made a motion to accept the minutes with the correction. Councilman Dougherty seconded the motion. Motion carried. There were no corrections to the January 15, 1992 meeting with the Enfield Planning Board. Councilman Linton made a motion to accept the minutes as written. Councilman Lovelace seconded the motion. Motion carried. There were no corrections to the January 20, 1992 meeting for the Town Audit'. Councilman Lovelace made a motion to accept the minutes as written. Councilman VanNederynen seconded the motion. Motion carried. Mr. Morris stated that he would like to speak during Privilege of the Floor. He, as a taxpayer was shocked at his taxes increasing 29%4 He encouraged the Town Board to keep taxes low for the next year and keep up the good work. Supervisor Owens stated she will be studying the budget. Howard Dixson said he plans on opening a bed and breakfast in Enfield: He would like to know if there is any procedures he should follow. He was told to contact the Planning Board and the County Health Department. l k r •2-4 q Rick Chase question the progress on the chipping program he suggested. Highway Supt. Ron Updike stated he was not been able to give a complete report on it. Mr. Updike said he had a problem with tax payers paying for the chipper and then selling the service back to the taxpayer. Rick Chase presented a grant application on a recovery program for the NYS Dept. of Environmental Conservation. Supervisor Owens referred the matter to Highway Supt. Updike. John Smith asked for a leash law in Enfield. He stated that the SPCA hands are tied because of the lack of one. Supervisor Owens would put it on the agenda. Councilman Dougherty made a motion to put Privilege of the Floor back on the agenda. Councilman Linton seconded the motion. Motion carried. COMMUNICATIONS Supervisor Owens is accumulating resumes for the Conservation Advisory Council consisting of five members. They can accept as many as two in the age of 16 - 22 years of age. Supervisor Owens asked for a transfer of funds for the Workman' s Compensation insurance payment. Councilman Linton made a motion to transfer $2 ,493 from the Contingency Account to the Workman's Compensation account. Councilman Lovelace seconded the motion. Motion carried. The Town Historian M. Clyde Hubbell prepared a excellent scrapbook on Enfield in 1991 . It is presently being passed to town board members. Mr. Hubbell stated that the copy machine in the Town Hall needs servicing. It is not making archival copies . The security problem to the town vault is still not solved. The fan in the rest room could impose a fire hazard. Mr. Hubbell said he would like to be on the Town Board agenda each month: Mr. Hubbell said he would be at the town hall each Tuesday evening for people to look at . records. Councilman Linton asked Highway Supt . Ron Ul.dike to look at the fan in the rest room. Supervisor Owens will look into getting someone to look at the copier. Highway Supt . Ron Updike will check on the door plate for the records room. I COMMITTEES COUNTY BOARD OF REPRESENTATIVES Supervisor Owens attended the County Board of Representatives meeting. The 8% sales tax rate was approved and will be forwarded to the state for approval . The county plans on cutting $500 ,000 from the county budget. COMMUNITY BUILDING Greg Kirchgessner reported that the burner for downstairs will be less than $500 . The parts are on back order. There is a possibility of dirt in one of the fuel tanks . Plastic has been put on the windows , doors weatherstripped, and windows have been caulked. Rick Chase suggested that NYSEG do an energy audit on all of the • town buildings . Councilman Lovelace said an audit could be done, but money would not be available for this year. Councilman Lovelace made a motion for NYSEG to do an energy audit on both buildings . Councilman VanNederynen seconded the motion. Motion, carried. FIRE COMPANY Councilman Linton reported on the meeting with the Enfield Volunteer Fire Company Board of Directors. The Fire Department has allowed a Town Board member to be a liaison on the Board of Directors . Councilman Linton requested of the Fire Department that they submit monthly a list of bills paid and a report to the Town Clerk. Greg Kirchgessner stated he was pleased with the result of the meeting and Councilman Linton had given them good suggestions . Councilman Lovelace stated he would like to see the audit completed. Supervisor Owens will speak to the auditor. The Fire Department_ is having a chicken barbecue on Sunday, February 9, 1992 . 2G 7J Suzanne Siegard submitted, a proposal to the Town Board. She would like to do a report an the Fire Department . HIGHWAY DEPARTMENT Highway Supt. Ron Updike reported that there was a pipe from the septic tank to the dry well broken. It is now repaired and seems to working fine. The Highway Department are now doing the standard winter work. Supt . Updike stated that in order for the town to participate in county services, a resolution needs to be made by the Town Board. Councilman Linton made a motion to adopt a resolution for authorization to participate in cooperative purchasing of highway services with Tompkins County as follows : WHEREAS, the Office of the State Comptroller has ruled that counties may no longer extend their bids for public work (services) to political subdivisions , and WHEREAS, General Municipal Law Section 119-0 provides for municipalities entering into cooperative purchasing agreements to jointly bid needed services, and WHEREAS, General Municipal Law, Article 5-G, Section 119-0 states that "any agreement entered into hereunder shall be approved by each participating municipal corporation or district by a majority vote of its governing body," now therefore be it RESOLVED, That the Town of Enfield be hereby, authorized t,o participate with Tompkins County in the cooperative purchasing of the following highway services : 1 . Vegetation Control 2 . Bituminous Material 3 . Cold Recycling of Bituminous Material FURTHER RESOLVED, that the Town of Enfield reserves the right to reject any or all bids . Councilman Dougherty seconded the motion. Motion carried. MONTHLY BILLS Councilman Linton made a motion to pay General Fund Warrant 2-92 for $44,203 . 91 and Highway Fund Warrant 2-92 for $7 , 446.59. Councilman Lovelace seconded the motion. Motion carried. OLD BUSINESS ATTORNEY FEES Councilman Linton made a motion to set attorney fees at $90 per hour and hereby direct any use of the town attorney be authorized by the Town Supervisor. Councilman Lovelace seconded the motion. Roll call vote:, Councilman Dougherty - abstained, Councilman Linton - yes, Councilman Lovelace - yes, Councilman VanNederynen - yes, Supervisor Owens - abstained. Motion carried. TRASH CLEAN-UP DAY The Trash Clean-Up Day has not been set up yet by the county. Councilman Linton made a motion to authorize Supervisor Owens and Highway Superintendent Updike to research, organize, and conduct Trash Clean-Up Days. Authorized expenditures include the cost of dumpsters, part-time highway employees and advertising expense. Councilman Dougherty seconded the motion. Motion carried. JUNK CARS Councilman Linton made a motion to appoint a committee consisting of Councilman Dougherty, Councilman Lovelace, and Supervisor Owens to research the possibilities . Councilman VanNederynen seconded the motion. Motion carried. b • -5- NEW BUSINESS APPOINTMENT TO COUNTY YOUTH SERVICES BOARD Carol Barrier 's resignation from the County Youth Services Board was received. Councilman VanNederynen made a motion to appoint Judy Paskin to serve on the County Youth Services Board. Councilman Lovelace seconded the motion. Motion carried. APPOINTMENT TO EQUAL OPPORTUNITY CORPORAT"ION BOARD Councilman Linton made a motion to appoint Supervisor Jean Owens to the Equal Opportunity Corporation Board. Councilman Lovelace seconded the motion. Motion carried. LETTER OF SUPPORT - CHIPS FUNDING A letter to the State Representatives was presented to Town Board members to sign to urge the continuation of CHIPS highway funding by Supervisor Owens . PERSONNEL COMMITTEE CHARGES Supervisor Owens charged the Personnel Committee with Health Care Cost Review and what other options for health care are available. She also charged the committee with review of the alcohol policy. STATE FUNDING ASSOCIATED WITH COUNTY YOUTH ,SERVICES PROGRAM Councilman Linton made a motion to authorize Supervisor Owens to the State Funding Association with County Youth Services Program. Councilman Dougherty seconded the motion. Motion carried. LOCAL LAW # 1 OF 1992 Discussion: Councilman Dougherty commented that she did not understand the proposed law and felt unqualified to discuss it . Councilman VanNederynen made a motion for a resolution to adopt local law #1 of 1992 on Providing for the Use of Agricultural Assessments Set Forth in Section 305 of the Agriculture and Markets Law in the Special Ad Valorem Levy for the Enfield Fire District WHEREAS, a public hearing has been held on proposed. Local Law # 1 of 1992 , and all interested persons provided an opportunity for public comments , NOW THEREFORE BE IT RESOLVED, that Local Law # 1 of 1992 , providing for the use of Agricultural Assessments set forth in Section 305 of the Agriculture and Markets Law in the Special Ad Valorem Levy for the Enfield Fire District, be and hereby is adopted, and it is further RESOLVED, that the Town Clerk shall file one certified copy thereof in the office of the Town Clerk, and shall file three certified copies in the office of the Secretary of State. Councilman Linton seconded the motion. Motion carried. Councilman Lovelace made a motion to adjourn the meeting. Councilman Linton seconded the motion. Motion carried.
