The Special Meeting on the Proposed Cellular Tower was called to
order at 7:40 pm in the Enfield Community Building with the
following members present:
Elected Officials: Other Officials,--
Supervisor Etta Gray Town Clerk Jean Scofield
Councilman Robert Linton
Councilman Donald Lovelace
Councilman Andrew Kraft
Councilman Onale Mente
A letter was read from Ezra Cornell urging the town to not approve
® or refer to further environmental review.
Steve Goggin stated that the assessment will be based on actual
cost on construction_ Amount to be raised by taxes to town would
be approximately $300 - 1,400.
ENVIRONMENTAL ASSESSMENT FORM
Ashley Miller questioned answer 49 4- migratory birds. She felt
evidence showed it affected migratory birds. Board polled - no
change.
Various citizens asked questions on Town Board decisions; There
were no changes.
There was one potential large impact, Question II , #1 bullet -
proposed land uses, or project components obviously different from
or• in sharp contrast to current surrounding land use patterns, _
whether man-made or natural:
There will be a visual impact on this 350' tower.
PART III
The decision of the town board is irreversible.
Supervisor Gray made a motion to accept Attorney Egans' importance
of impact (copy attached) . Councilman Mente seconded the motion.
Motion carried.
DETERMINATION OF SIGNIFICANCE
Councilman Linton made a motion to accept A - a negative.
declaration. Councilman Kraft seconded the motion.
Discussion:
Councilman Linton thought the impact was important but not great
enough to make a positive declaration.
Councilman Lovelace felt owner should be able to do with his land
what he wants-
Supervisor Gray felt that impact was to important to made a
negative - felt citizens worries and concerns should be primary.
Councilman Mente felt that the tower could be dangerous for people
and she is for the people.
Councilman Kraft doesn't feel impact will be that great.
Roll call vote: Supervisor Gray - no, Councilman Mente - no,
Councilman Kraft - yes, Councilman .Linton - yes, Councilman
Lovelace - yes. Motion carried.
Councilman Linton made a motion to change the wording of narrative
at end of statement and add the following "to make it consistent
with vote" . Councilman Lovelace seconded the motion. Roll call
vote: Supervisor Gray - no, Councilman Mente -- no, Councilman
Kraft - yes, Councilman Linton - yes, Councilman Lovelace - yes.
Motion carried.
Councilman Linton made a motion to re-adopt and re-affirm the
motion on negative declaration. Councilman Lovelace seconded the
motion. Roll call vote: Supervisor Gray - no, Councilman Mente no, Councilman Kraft - yes, Councilman Linton - yes, Councilman
Lovelace - yes. Motion carried. (Negative declaration attached. )
Councilman Linton made a motion to adopt the following resolution.
Councilman Kraft seconded the motion.
WHEREAS:
This action is the consideration of an application for a
special exception to the Site Development Moratorium (Local. Law
adopted by the Town of Enfield September 5, 1990) for the
construction of a 350 foot tower for mobile cellular telephone
communications to serve Ithaca and surrounding areas, to be located
south 3,000 feet of Eddy Farm, 544 Bostwick Road, between Colegrove
Road and Teeter Road, in the Town of Enfield, Tompkins County, New
York..
This a Type I action. The Town Board of the Town of. Enfield
as lead agency in environmental, review for consideration of the
special exception to the Site Development Moratorium made a
negative determination of environmental significance on December 3,
1991.
The Town Board at a public hearing held November 2.0, 1991,
has reviewed and considered the materials submitted for the record
by the applicant, including the Full Environmental Assessment Form,
drawings, reference articles, photographs, and presentation by
applicant's agents and expert consultant; has reviewed and
considered the comments given and materials submitted by the
Public, including petitions and other materials presented at the
Public hearing.
THEREFORE IT IS RESOLVED:
That the Town Board of the Town of Enfield grants and hereby
does grant a special exception to the Site Development Moratorium
because it does not create issues relating to health, safety,
environment, welfare, and the orderly development of the Town and
because of these reasons in this instance the Town does not feel
that individual property rights can be denied. On condition that
the tower be no higher than 350 feet , and that it. have v blinking
red light, not a strobe light, that no sharing, subletting, er
assignment of use of the tower to other users, types of uses or
signals shall be permitted, that within six (6) months at end of
use by the applicant for cellular mobile telephones that the tower
must be taken down and no alternative or subsequent use permitted,
without the town's consent. The applicant will provide mitigation
remedies in the event of interference caused by proposed tower to
television reception in the vicinity of the tower and further
guarantees that there will not be ,a permenent generator at the
tower site and the applicant further agrees to remit an application
fee of $1,000 to the Town of Enfield.
k Roll call vote: Councilman Kraft - yes, Councilman Linton - yes,
Councilman Lovelace - yes, Councilman Mente - no, Supervisor Gray no. Resolution passed.
Councilman Kraft made a motion to adjourn the meeting. Councilman •
Mente seconded the motion. Motion carried. Meeting adjourned at
11:50 pm.
