HomeMy WebLinkAbout1991-08-14 -20 i August 14, 1991 PUBLIC HEARING ON PROPOSED SITE PLAN REVIEW LAW The Public Hearing on the Proposed Site Plan Review Law was called to order at 7:40 pm at the Enfield School Gym with the following members present: Elected Officials: Other Officials_ Supervisor Etta Gray Town Attorney Shirley Egan Councilman Robert Linton Town Clerk Jean Scofield Councilman Onale Mente Councilman Donald Lovelace Absent: Councilman Andrew Kraft Supervisor Gray opened the hearing for interested town citizens to voice their feelings on the proposed law. Attorney Jim Hickey spoke for the people opposed to the proposed law. He stated that "people will not have the liberty to do what they would like to do. The law will only be protecting the town from mega developers --- only mega developers will be able to afford to abide by the law. " A petition was presented by Mr. Hickey protesting the law. It was signed by 652 residents of the town. Bruce Lott spoke against the law. "Site Plan Review Law is worse than zoning. Enfield should stay exactly like it is. " Ezra Cornell - "The proposal for the Site Plan Review Law should be approved. Neighbors of his stated that when they were presented with petitions they were told it was zoning. The law will insure financial integrity of the town. The Town should have a plan. The new developers should pay for the costs to the town for expenses of development - not the older residents of the town. " Jack Rumsey - "he was against the Site flan Review Law. " Dawn Achilles - "the people do not a Site Plan Review Law or a Planning Board. " Larry Saulsgiver - "He was concerned about a individual putting on an addition - concerned about radioactive dumping sites and other dumps - he is in favor of plan." Gene Endres, Secretary of Planning Board - Spoke on how the Ad Hoc Committee was started and later became a Planning Board. The Planning Board tried to come with a law that was for the people of the town. "People who do not have the money to fight against a development next to their home" . The concerns mostly environmental issues to the town. He supports the Site Plan Review Law. Steve Teeter, owner of a small trailer park on Applegate Road. He stated he was concerned regarding the requirement of 250 foot of road frontage. People with 30 feet of right of way with large lots cannot build on the lot. Mike Williams, member of Planning Board, stated that members of the Planning Board are totally volunteers_ He was in favor of the law. Caroline Bingham, co-chairman of Planning Board, stated that she heard people saying that they wanted Enfield to stay as it is. She stated "the town is not Enfield anymore, but a. part of Ithaca. The Planning Board is not stopping anyone who wants to put a mobile home on a lot - - but wants to help low income young people. If there is no planning in Enfield, the County or State will step in. The town people need to make up their mind to make Enfield. a thriving community.. Letters in support of the Site Plan Review Law were received by the Town Board from Michael Turbach and Lorna Cornell. They were read by Town Clerk Jean Scofield. Cindy Scheibe spoke in support of the Site Plan Review Law- , Jeff Brainard stated that the town has 1 , 245 parcels, 260 of those parcels are less than two acres. Under # 2. 6 of the Site Plan Review Law, owners with less than two acres must follow Site Plan Review. People do not understand the law. Tom Gunning-Smith stated he was against restrictions to his property. The law does not stop large developers, as he has the money that the average homeowner does not have. He asked that the law be put up for public referendum. Monroe Payne - for the most part he stated he was in favor of Site Plan Review Law. He owns 25 acres of land. He stated he could put in 30 - 40 trailers on his property with individual wells and septic and ruin the property of his neighbors. Ashley Miller supports the Site Plan Review Law. The town needs planning. Debby 'Carpenter felt that the town does not need anymore regulations. • She was against the Site Plan Review Law. Steve Tanksley said the people who will benefit from the Site Plan Review Law are the people who plan on staying and raising a family not the developers. He was in favor of the Site Plan Review Law. Marnie Kirchgessner asked "where are the developers? The law will affect the single family homeowners. She was proud of Enfield and feels Enfield would change with the law. She asked what the town has done to make Enfield "prettier" , she was against the Site Plan Review Law. " Bob Carpenter was concerned that the Site Plan Review Law was not done by elected officials. He asked how an unelected official can write a law and who is the enforcement official - the Planning Board or the elected officials'? Eleanor Boisvert stated she came to Enfield because she wanted to live in a rural area. She said the people who will not benefit from the law will be the ones paying for it. Jane Bassett wants Enfield's rate of development (20%) to be orderly. Mark Sherman stated he was upset because the town board should have helped people understand the law. He was against the law. Brenda Smith stated she was in favor for planning for possible problems. She was concerned about use of land in Enfield. Bruce Lott stated that the law was not written by the people of Enfield but by the people of Coventry. Ann Wilson in favor of Planning Board. She felt that the lot size needs to be cleared up. Debbie Bell said she owns a piece of property that does not have 250 feet of road frontage. She would like the two acres lot size to be cleared up. Pete Moore says he likes the way Enfield has been for 20 years. He would like to see Enfield stay the way it is. Cathy Noyes said she hopes Enfield will continue to grow. She was in • favor of the Site Plan Review Law. George Head stated that developments already have laws they must abide by from the county and state. He was against the Site Plan Review Law. Tim Giles explained how a chemical company polluted water in the Owego area where he lived before. Joe Reynolds said he moved to Enfield to get away from restrictions. But he felt planning must be done to control growth. Gary Achilles - stated that there is not enough road frontage in the town to have development. He would like the law to be put before the voters. Eileen Bock supports the Site Plan Review Law. Carl Newhart asked about the legality of putting the Site Plan Review Law up for vote. He was against the law. Bill Fry stated that planning will offer protection to the residents of Enfield. Steve Gogin feels the town needs some type of planning effort. Jack Rumsey - stated if a person has enough money - he can beat the law. Cathy Noyes said she hopes Enfield will continue to grow. Caroline' Bingham said the Planning Board has meetings once a month. They are advertised in the Ithaca Journal. The public is welcomed.
