SPECIAL MEETING WITH PUBLIC HEARING
The Special Meeting of the Enfield Town Board was called to order at
7: 40 pin with the following members present :

• The purpose of this meeting is to hold a public hearing which has been
duly advertised and consider the application of Raymond .and Yvonne Van
De Mark for an exception to the Town' s site development moratorium.
The Town' s moratorium resolution as passed November 15, 1989 and
subsequently amended, provides in part "Any party subject to or
aggrieved by such moratorium may apply to the Town Board for a special
exception, upon showing that his or her proposed site development
adequately addresses issues relating to health, safety, welfare,
environment, and the orderly development of the Town.. "
The proposed site development is located on Trumbull Corners Road, Town
of Enfield., Tax Parcel No. 17-1-3. 1, consisting df 10 rental lots of
approximately one (1) acre each .for double--w:i_de mobile homes.
Let the record show that the applicant submitted an Environmental
Assessment Form as required by the State Environmental. Quality Review
Act and regulations (fart 617 N. Y. C. R. R. Environmental Conservation to
the Tompkins County Health Department on September .14, 1989 with a copy
to the Town of Enfield. The Town had no jurisdiction over the action
at the time and did not within 30 days of September 1.4, 1989 as
required by Part 617. 6 (e) of the regulation , object to the
establishment of the Tompkins County Health Department as lead agency.
In accordance with Part 617. 3 (h) , "unle� s an involved agency formally
objects to the establishment of lead agency, no other involved agency
may later require the preparation of an ETS (Environmental Impact
Statement) in connection with the action.. "
The Tompkins County Health Department i�ssued a negative declaration of
environmental significance on March 15, 1990 which stated, "No
potentially large impacts -to the environment were noted during the
review proce S. The water supply appears adequate, and soil conditions
were observPId and. judged suitable for individual on-site sewage
systems. The impact on open space is mitigated by providing
approximately one-acre mobile home lots. Although the land is located
within an agricultural district, the impact on the loss of agricultural
resources is considered minor. "
The application for an exception. to the moratorium was referred by the
Town 'Board to the Town Planning Board on June 6, 1990. The Town
Planning Board held a public hearing on June 26, 1990 and. submitted the
following recommendation by resolution dat(;; July 5, 1990:
• "Bingham ma.d.e the motion that we not advise exemption. Webster
seconded. The vote as split: Van Nederynen, Rancic.h, Thompson against
Webster, Tanksley, Bingham in favor. The .count 3/3. "
"Tanksley, then made .a. motion that: If the Town Board decides to
approve the project that there be the following reservations:
1. That the project be approved for 1.0 units only
2. That each unit be placed: on minimum lot size of 1 acre
3. That street lights be installed
4. That fiberglass skirting be required
5. That an adoption of the regulations be presented to the planning
board and a plan for enforcement
6. Landscaping as describ,�d in the July 5th drawing

Bill Albt_!rn, Bzigineering Consultant for the Van De Marks distributed
drawings of the housing complex. A 60' wide road. will be built to town
specifications with 5 double wide mobile homes on each side of the

factory manufactured skirting instead. of J: iberglass skirting as it was
less expensive.
Marie Van De Mark spoke, She will be manager and partner of the park.

E. Plescia asked how the water supply is private? Answered: 2 private
wells will. be drilled on the land.
B. Rumsey asked about the traffic at the busy intersection and the
safety of children getting on the school bus. Answered: A 5 foot
gravel walk will. be put in for safety of the children.
It was asked who would be responsible for the supply of water?
Answered: The owner would. be responsible. There will. be 2 wells, one
with a water capacity of 50 gallons per minute.
It was asked what would happen to the remaining 150 acres? Answered:
If more than 1.0 units were to be put in thc--1 owner will apply for
additional sites: and. another 13nvironment�.-G Impact Statement will. be
done.
W. Riley asked who will construct and maint.ain the road.? Answered: it
will be maintained and constructed of oil. and stone by the owner.
Councilman Linton stated that if it is built to ,,town specifications it
could be dedicated to the town.
D. Marshall as ed where will the children 1.-)e picked up by the school
bus. Answered: on Trumbull Corners Road .
M- Williams, concerned that there is a PF--I-tar-p corner. on Trumbull Corners
Road stated that it would be hard to see a bus, asked if there were any
traffic studies done. Answered: rio study was done.

Mobile home parks are not assessed to the average
assessment. Home owners will have to assir>t with additional taxes.
D. Marshall stated that $60 -,$70, 000 homes are not considered low-
income housing. Answered: the homes wil..l be available in the $35-
45, 000 range, '�
It was sked what will be the rental cost of the lots? Answered: The
rental will be in the $160-180 per month range.

P. Hubbell asked why are we Subsidizing low income housing?
L. Riley asked does the passing or accepting these 10 units have any
bearing on subsequent applications for more units?

does not. Owners must reapply for additional units.

Mr. Brooks as if it was possible that there will be 150 units?
Answered: it depended on water, sewage, etc..
It was asked if the owners would lose incentive to maintain once the
homes were sold. Answered: no, the profit would be in the lot rental .
S. Tanksley stated that the location of the project is a distance from
schools, police, and fire prc)-1,(*-'-1ction was not a good location for low-
income housing.
Bill Albern stated that the project was started before the moratorium.
D. Mar-shall presented a. petition to the Town Board with 144 signatures
from locations near the Site as---,king, not `? rant an exception.

H. Dixson asked if they had checked on the wetlands situation? Bill
Albern stated that he was not aware of any wetlands. The. drainage does

D. Marshall stated, that the ].and drains into the creek and into the
wetlands. Councilman Linton suggested that the town should consult
with Mr . Raymond about the aquafers.
W. Riley expr(--issed concern over the appearance of the appearance of the
park as Sandy Creek Trailer Park is not a pleasing site.
It was asked why bring up that Sandy Creek will be improved? Marie Van
De Mark stated she is employed by Sandy Cron and hopes to be able to
improve Sandy Creek in later years.
H. Amberge asked if there was a ban of dirt bikes, ATV' s, snowmobiles,
etc. ? Answered: yes.
• It was asked if the rules and regulations would be passed on to a
prospective new owner? Answered: it would depend an the Town Board.
D, Marshall asked. if there would be a way that someone could put in a
single-wide trailer? Answered: no, the cod(:-! enforcement officer would
enforce.
Councilman Linton asked. if home: , could be put on a more solid
foundation other than piers. C. Binghain stated that it was discussed
by the planning board. The cost would be high and it would be hard and
expensive to move trailers. Marie Van De, Mark said that if the homes
were on a permament f oundat! on on rented property, ' the banks would not
finance.
It was asked about the life expectancy of the homes. Marie Van De Mark
said that most are financed for 30 years and are expected to last that
long.
What is the size to be allowed in the park? Answered: no smaller than
24' x 40' .
It was asked what can the town do if owner does not enforce rules? The
Town' s Code Enforcement Officer would invoke- citations and fines.
R. Brown asked if the town has a (:-.ode erifnrcement officer? Yes, Roger
Rumsey.
It was noted that the Town Planning Board did not make a recommen-
dation. It was a split vote. 3 for, 3 against. G. Endres was absent,
but was against and X. Shapiro was also absent and was against the
project. There are 8 members total.
C. Bingham read letter from Gene Endres, co-chairman, who was against
the exception.
It was asked if someone could sue the town if there was an accident on
the road from the park or if the wetlands were affected? Answered: no,
not llkley.
C. Bingham read a letter received in response from a telephone call to
the Army Corp of Engineers. It stated that that there was a
possibility of wetlands on the property.
Asked where does it go from here? Answered: the public hearing will be
closed and the Town Board will. discuss the issue and make a decision.
It was asked what control does the town have over increase in units?
Answered: the process will start all over again.
It was questioned about dog control. It was stated that Enfield does
have a dog ordinance law.
Councilman Linton made a motion to close the public hearing.
Supervisor Gray seconded the motion.
It was asked what the vacancy rate is at at Sandy Creek. Answered:
approximately 10%.
Hearing closed.
Councilman Linton questions Mr. Albern. Are septic systems approved by
the Tompkins County Health Department? Answer: yes. Can you document
the 50 gallon per, mi.iiute wel.'I '? Answer: no, well. # 1. is reportedly 20
gallon per minute.
Councilman Linton made a motion to not grant the exception until
further information is available. Councilman Kraft seconded the
motion.

1. Traffic study
2. Reconsider minimum lot size
3. Consult with Cornell Univ. Water Resources and/or Army Corp
of Engineers
4. Look at foundations, instead of piers
5. Provide open. space and water supply for fire protection
6. And whatever else the Planning Board feels i5 necessary. •

Councilman Mente seconded the motion. Motion carried. Meeting
