HomeMy WebLinkAbout1987-12-21 TOWN OF ENFIELD R.D. #5 ITHACA, N.Y. 148SO December 21, 1987 The Special Town Board Meeting regarding the Fire Protection Contract for 1988 was called to order at 7:30 pm with the following members present: Elected Officials: Other Officials: Councilman Laue Town Clerk Jean Scofield Councilman Lanning Councilman Scofield Councilman Linton Supervisor Gray A memo was read dated October 2, 1984 by Supervisor Gray to Roger Hubbell from Town Attorney Shirley Egan. Town Attorney Shirley Egan feels that the original contract with no .changes be adopted and any problems be discussed at a later date. Councilman Linton a m tips td�pt the contract with changes in pp 2 and except for pp 9,.4 ounce Aaue seconded the motion. Roll call was taken: Councilman Scofield - no, Councilman Laue - aye, Councilman Linton - aye, Councilman Lanning - no, Supervisor Gray - no. notion was defeated. Councilman Lanning made a motion to adopt contract with no changes. Councilman Laue seconded the motion. Roll call was taken: Councilman Laue - aye, Councilman Linton - no, Councilman Scofield - aye, Councilman Lanning - aye, Supervisor Gray - aye. Motion carried. Councilman Laue made a motion to adjourn meeting. Councilman Scofield seconded the motion. Z4otion carried. Meeting adjourned at 8:33 pm. Egan Re : Town dealings with an incorporated Fire Company In response to your call yesterday, have both reviewed my notes and done a bit of additional research as well , although due to the short notice this is probably by no means complete. The Not-For-Profit Corporation Law which governs fire corporations expressly provides that the consent of the Town Board is necessary for their formation and even for the election of new members . Election of new members may be deemed approved if the Town Board takes no action within 40 days of service on it of notice of election of a new member - 70 days if the nominee is a nonresident. Further, the law provides specifically at Section 1402(e) (1) : "A fire, hose., protective or hook and ladder corpor- ation heretofore incorporated under any general law or a fire corporation hereafter incorporated under this section shall be under the control of the city, village , fire district or town authorities having, by law, control over the prevention or extinguishment of fires therein. Such authorities may adopt rules and regu- lations for�Ee government ana-control of su�orpora- tion. mp asi.s added. Directors of a fire corporation are required to file an annual report with the county clerk, stating among other things , an inventory of its property and a statement of its liabilities : This is due by January 15th each year. You asked a further question concerning the allocation of contract monies for a building reserve , that is whether it was legal to pay over Town funds for the evential purchase of property which would not be owned by the Town. I have not yet found anything specifically on this point, but I would like more time to research it. It is the sort of question we should feel free to ask of the Comptroller' s office. SKE/dlw
