N.Y. 14850 • June 5, 1985 The Regular Meeting of the Enfield Town Board was held on the above date with all members present except Mr. Robert Scofield. MINUTES OF PREVIOUS MEETING Minutes reviewd - Mr. Roger Laue made a motion to accept the minutes as submitted. Mr. Larry Stilwell seconded the motion. Motion carried. COMMUNICATIONS AND NOTICES 1. Confirming letter from Marcia Roach - will be in Enfield on June 13, from 3:30 pm to 4:30 pm. Ms. Roach is field representative from Senator Lundine's office. 2. Mortgage Tax - 10/84 to 3/85 - $3,871.71. 3. Report from SPCA for May 1985. 4. Finger Lakes Cooperative Insurance - Minimum premiums will be charged. • 5. NYS Dept. of Tax and Finance - Re. Fuel Oil Purchase. 6. Special Franchise Assessments. 7. Cooperative Extension - Re: School 8. Town of Ulysses - Resolution - request larger portion return on dog fees. PRIVELEGE OF THE FLOOR 1. Leslie Dobson from EMC gave report on wetland areas, gave background, reported they are regulated by the state to save on wildlife. Official maps went into effect in August of 1984 and landowners were notified. Activities regulated not necessarily prohibited. There are 4 classes of wetlands, Class 1 being very strictly regulated. Ms. Dobson explained process and procedures that can be followed to appeal. EMC and DEC are available to anyone with any questions. Mr. David Bock questioned if the new owners of the land were notified that they have wetland areas. Ms. Dobson stated they were not but the previous owner should advise the new owners. Mr. David Bock asked about enforecement procedures and activities against regulations. Town does not have direct responsibilities unless they want to get involved. 2. Debra Finiello had 3 questions - 1. Re: update on the road (Eddy's Road) . • Mr. Carlton Thall stated that Mr. Eddy says he's not going to do anymore. Mr. David Bocks stated roads must be up to specifications by Mr. Eddy before the town takes over the road.. 2. Mrs. Finiello asked about the bridge on Enfield Center Rd. , as no busses will come over the bridge. 3. Mrs. Finiello asked if there will be a leash law as her kids are being chased by dogs. Mr. Roger Laue stated that the board was working on a draft for a law. Page Two . In response to the problem of the bridge, Mr. David Bock advised that the problem has come up before and that the bridge would have to be rebuilt before school bus can go over. County responsible for deck of bridge - superstructure needs replacing. 3. Marnie Kirchgessner - Enfield Community Council Summer Youth Program What jobs can be done - Mr. Thal! stated the kids can cut brush. Mrs. Kirchgessner stated they would be hiring less kids due to .the minimun wage act. Mr. David Bock states the board's direction recommend the same number of kids but fewer hours worked. Mrs. Kirchgessner suggested to consilidate hours - will have plans by July meeting. Mr. Roger Laue suggested to sponsor community council for a fund raiser for CPR Training. 4. Dennis Hubbell - 1. Fire company has opportunity to get 4 tons of gravel from Mr. Townley - needs loader - asked if it was possible to use the town loader - hire or lease other options. Mr. David Bock questioned towns insurance liability. Mr. Carlton Thall to check with insurance company tomorrow. Mr. David Bock questioned if the town was liable on private property with town equipment. General feeling if it is covered by insurance it is okay to use. 2. Dennis Hubbell informed the board that the feasability study has been done on the new fire hall and that the building committee and architect needs to meet with. the board in July or August. Mr. Roger Laue questioned how far can the town board go without community input. Dennis Hubbell stated architect would like public hearing or referendum. The town attorney will be asked about getting it on the November ballott. 5. Marvin Arnold -s stated at the last meeting he attended it was said that Gray Road and Cole Grove Road would be retopped, also sleuces need to be put in and opened up. Mr. Arnold also questioned why the town and town board furnishes transportation for the highway superintendent. Mr. Arnold was advised that the previous superintendents drove it. Mr. Arnold feels the town should not furnish transportation. Mr. Roger Laue also advised. Mr. Arnold that Mr. Thall had used his own vehicle when the town truck was down. 6. Barry Kryzewski - Questioned if VanDorn and Hayts roads would be resurfaced in the near future, also questioned getting ordinances on junk cars and about racing vehicles next to houses, other neighbors annoyed and petition drawn to get stopped. Mr. David Bock advised that there had been massive opposition in the town to any ordinance in the past - possible growth of the town could now get ordinances. Health department only recourse for sewage problems. Mr. Winch advised town can pass local ordinance for junk vehicles. Mr. David Bock _ need detail on state regulations and surrounding town ordinances. Page Three 7. Jack Hubbell - Town Historian questioned if the road is Townline Road or County Line Rd. - October 1874 town board list of names has it as County Line Rd. REPORT FROM DAN WINCH - COUNTY REPRESENTATIVE 1. Mr. Winch asked if we had call from Planning, Dept. ref: signs - was advised that we had. 2. Mr. Winch has Right to Know booklets - Open Meeting Law. 3. Mr. Winch gave out 1985 County booklets. Mr. Roger Laue. question status on landfill - Mr. Winch reports the county using Landstrom's - solid waste disposal being looked into by county. Mr. Don Barber stated county checked about incineration in the past - County lookin at 2 sites - not public knowledge. Study being done by DEC for hazards and pollution. Mr. David Bock asked Mr. Winch to check with Mr. Mobbs on the bridge - Mr. Winch advised bridge reconstruction schedule slow. Mr. Larry Stilwell stated that the fire hall can be used for one election district. 2. Bids on truck - 1 man from Pennsylvania and 1 from Cortland coming up next week., Mr. Roger Laue suggested possibly buying new voting machine for standby - certain number of voters needed for standby machines. Prices needed on machines - town clerk to send letters for prices. • 3. Mr. Roger Laue has Jim Stark lined up to provide the animals and wagon for the town board to ride in the fireman's parade on June 28th. 4. Dog Ordinance - Discussion held on the draft copy of a dog ordinance law. Final form this meeting - adoption following public hearing. Page Five Mr. David Bock made aimotion to change the July Meeting to July 10 and advertise appropriately: Mr. Roger Laue seconded the motion. Motion carried. Mr. Larry Stilwell made a motion to hold a Public Hearing on the Dog Ordinance Law at the July lOth meeting at S:OOpm. Mr. David Bock seconded the motion. Motion carried. 5. Mr. Roger Laue brought up the subject of possible changing the Highway Superintendent, Town Clerk and Supervisor offices to a 4 year term. Resolution for each one seperately. Board of glections to be notified for time limit to get on ballott. Discussion to he held at a later time. 6. Discussion held reference specs. on dump truck. Mr. David Bock questioned if delivery cheaper or buy truck to do haxfling - not convinced new truck best way for town to go yet. Mr. Thall to have state contract prices on moving machines at next meeting. NEW BUSINESS 1. Assessment Review Board Meeting to be held on June llth. Mr. Larry Stilwell make a motion to adjourn.
