Jr.; Megan Whitman; Wendy Martin, Excused: Martin Hatch; "I"homas Hatfield Staff Present: Dan Kwasnowski, Environmental Planner; Patty Millard, Recording Secretary; Others Present: Wayne Matteson for Bernie Cornelius. Meeting called to order at 7:00 pm. The public hearing for Manhattan Estates Subdivision Phase 1 was opened on a motion made by David Weinstein, and seconded by Joseph Laquatra Jr. All in favor. 11 Slater gave a brief review of the project, various approvals to date, and communication with the Health Department. An updated S��'P13P has been turned in to A Sciarabba, Town Engineer. According to his letter of May 13`h, most items have been addressed with three (3) items left to address. Per 1 -1 Slater, these items have been addressed since A Sciarabba's letter. ® Conditions: 1. .Acceptance of the roadways by the town or perforniance bond approved by the town C 2. SWPPP completed and maintained to the Town's satisfaction 3. Homeowner's Association acceptable to the town attorney 4. Easement to the town for inspection and, if necessary, maintenance of the stormwater pond and the dry hydrant 3. 'turnaround in Phase 1 is to remain part of the town road for access to the fire pond 6. Subject. to Health Department approval The public hearing was closed on a motion made. by Joseph Laquatra, and seconded by Megan Whitman. All in favor. A motion for preliminary and final subdivision approval was made by David Weinstein, and seconded by Wendy Martin. All in favor. Subdivision approved with above stated conditions. Zoning Law Update A marked up copy was sent out by Dan on Tuesday, May 18`h. Dan went over some of the updates that had been made. He still has to go finish going through some of the document. A couple of case studies should be zoning, it's 2 -acre zoning. The key 50% non - buildable land. You have out how many dwelling units can b done at our next public meeting showing that it's not 8 -acre is that ifthe property is in a Conservation Zone, it is over to subtract the non- buildable section before you can figure e built on that parcel. Once you remove the non - buildable F1 0 PB 05 -20 -2010 Page 2 of 2 sections. what's left is what determines how many units can be built. At the moment, it is 8 -acre zoning on the buildable section of the parcel. Should it be changed to be 2 -acre zoning on the buildable section? It may end up being 8 -acres for the parcel, but it shouldn't be so limited for the buildable section. The point: was made that if we go to 2 -acre zoning on everything that is buildable, we are giving up the dream of keeping open space in the Conservation Zones. Public input Session 'The Planning Board will meet at the "Town Hall on July 22' at 7 pm for a final public input session prior to handing over the proposed updated zoning ordinance to the Town Board. There will be a vote after the July 22"" meeting to determine whether the planning board is ready to turn it over. Varna J Lalley is still working on putting together a meeting with all interested parties. It did not happen this past month, but is still on his list and a letter will be going out. soon inviting all those mentioned last month. D Weinstein handed out a map. The Varna community has already started doing some preliminary planning starting with the document they handed out to the Planning Board last month. Minutes Approval On a motion made by J Laquatra and seconded by D Weinstein, the March and April minutes were approved as distributed. All in favor. J Lalley thanked Patty l:or her quick turnaround and thorough minutes. The motion was adjourned at 7.55 pm on a motion made by D Weinstein and seconded by J Laquatra.
