J_ Lalley: With new lot line there are no side yard setbacks.
L. Fabbroni: That's correct.
D_ Weinstein: Plenty of setback from the edge of the gorge so the building
wont be built right on the edge.
H. Slater: As adjusted, enhanced in conformance. Better use of new
lot line.
D. Grantham: Why enhanced?
H. Slater: It was awkward, long and skinny. Now more uniform.
D. Weinstein: How far will new building be from the lot line?

M. DeWitt: Gone from 19 to 10 lots due to soil conditions. Builder's Best
has addressed issues that the Planning Board was
concerned about. Consider leaving easement, would gain
one site.
J. Lalley: Hammerhead required?
D. Weinstein: Driveways 4 and 7 not off T?
J. Lalley: No
H. Slater: T or L okay. Builders choice.
J. Lalley: L design more attractive will save construction cost.
M. DeWitt: John's sketch possible?
J. Lalley: Would it save money on the road?
M, DeWitt: Yes,
L. Griffin: Future development means another road off Ferguson.
G. Deibler: Easement placement
M. Christofferson: Large lot cut in half
M. DeWitt: No, because of soil conditions
H. Slater: Drainage, road conformance, SPEDES permit, and
Coordinate Builder's Best activities with Towns needs.
J. Lalley: Just preliminary hearing.
D. Weinstein: Ag. Data statement required
H. Slater: Has been provided to Builder's Best.
D. Weinstein: Report from John Anderson?
H. Slater: Not yet, He knows what is needed.

H. Slater: Before moving forward there must be consideration for the
protection of the Town of Dryden relative to development.
Number of 17 lots built on is 5. Sewer is in place.
Flow meter tells how much flow is coming from a particular
sewer district.
J. Lalley: Copy of plat that Barbara signed and was ultimately filed. 44
lots delineated. Approved phase 1, conditionally Sept. 94.
Certain milestones had to be reached before phase 1 could
be allowed to progress. Approval expires 6130100 unless
Health Department waves.
H. Slater: Phase 1 B is the remaining lots, less the 17, no bonding in
place for any of this phase.
J. Lalley: What is the relevance of the tax department not filing this
map?
H. Slater: Unsure of the relevance.
• D. Weinstein: to have an official subdivision in p lace it must be filed within
30 days. If it isn't filed it's non - existent.
H. Slater: It has technically been filed. However a large portion is
missing. Does this make approval null and void?
J. Lalley: Approved Peregrine subdivision. Also approved Phase 1 of
a proposed 4 phases. With conditions. It conditions are met
or are not met is the relevant question.
H. Slater: July of 1995 fell back to a 1A approval. Mr. Varn requested
that phase 12 be broken into phase 1A and Phase 1 B. Cost
of developing was overwhelming.
D. Weinstein: Planning Board never approved the 1 B part of that.
® H. Slater: Conditionally pp it was approved but may not have been

conformed with.
L. Griffin: If all conditions are not met why continue to phase 1 B?
H. Slater: Peregrine partners are under the impression that the entire
phase has been approved and they can move forward as
long as they conform to all the requirements of the
conditional approval.
H. Saldsieder: Peregrine Partners lawyer interpretation is that phase 1 has
been approved. There is a chance to sell and mistakes must
be avoided.

J. Lalley: In everyone's best interest to get this project back on its feet.
0 What needs to be done about the Health Department
expiration?
H. Slater: Health Department has not yet been contacted.
J. Lalley: Phase 1A and 16 was a construction sequence to address
financial concerns. Without changing the concept of there
being a phase 1,
D. Grantham: Didn't chance the concept, changed when conditions had to
be met.
J. Lalley: We modified the delivery schedule for the conditions of
phase 1.
H. Slater: Paper trail of phase 1A ends at the county clerk for some
9 reason.
J. Lalley: Phase 1 was filed and approved with these conditions.
H. Slater: What are the conditions for phase 1 B, only conditions for
phase 1A were spelled out. Is this considered abandoned?
Perhaps refer to Town Attorney. If it's legally filed it becomes
an issue of the Town Board and the Health Department.
H. Saldsieder: We would like to extend the road and make an estimate for
the investors.
D_ Weinstein: It's possible that 1 B was abandoned for some reason. The
Board gave conditional approval. The two questions are

whether the phases were abandoned and have the
conditions been met.
J. Lalley: Peregrine Partners is seeking some reassurance that this is
still an approved subdivision. The Town is seeking some
assurance that this subdivision as conditionally approved will
meet the conditions of the approval.
H, Slater: They may want to build 14 houses but as it stands only five
can be built. We cannot issue any more than 10 total
building permits to that project site because of an agreement
the Town's of Dryden and Ithaca have until meter pit is
completed.
J. Lalley: Is it the Town Board's action to grant an extension.
D. Grantham: If this didn't show up on the records because it was formally
abandoned then it's a different project now.
J. Lalley: Town Board should know the Planning Boards position on
this issue.
