David Abbott, owner of the parcel, and Robert Tallman, architect for the
project presented the plat. Robert Tallman reviewed plat for what is now
three lot subdivision. The project had been described as a two lot
subdivision with a road in the preliminary review at the Planning Board
meeting of 1/11/90. Parcel 1 is 4.9 acres and its intended use if for His -
Speed Checkweigher's new plant. Parcel 2 and 3 are 2.26 and. 1.59 acres
respectively. Tallman said he has verbal approval from the Tompkins
County Highway Department for the entrance onto Hanshaw Road. The
new town road proposed in the project is under review by the Town of
Dryden Highway Department.

Heidt: What happens to the D &R Abbott parcel on Lower Creek Rd.
Abbott: It is not part of the subdivision. It is also in a separate zone..
Lavine initiated a review of the concepts behind the drainage plan with
Tallman. Drainage from building and parking lot on Parcel 1 will go to a
new retention pond. The project will obtain right of way to storm sewer
located at manhole on New York State armory property.
Lavine: Is the retention pond designed to hold runoff from a one hour
storm?
Tallman: Yes.

Heidt: Will the berm along the south end of the project extend onto the
state land?
Tallman: Yes.
Lavine: Do you have an easement.
Abbott presented a copy of easement.
Heidt: Did George Schlecht do work on the project?
Tallman Yes, he did the topography map before he established his business
relationship as Town Engineer,
Heidt: Will the berm have two foot evergreens planted on it?
Caldwell: Is this part of the plan?
Waldbridge :The site plan review of 1/24/90 did not include this.
Caldwell advised board members that we could stipulate what the plantings
should be.
Lavine and Lalley sought clarification from Abbott regarding the
easement. The document presented by Abbott was not an easement. Abbott
responded that he did not have the easement from the state but expected to
have a portion of the armory property deeded back to him.
Caldwell: Does the drainage plan address the possibility of heavy rain
while massive snowbanks are on the site?
Tallman: Yes, I did a similar plan for the YMCA site in Lansing. 4.
Lavine: What acreage is the State considering deeding back to you?
Abbott referring to the plat indicated that it would be an area adjacent to
the north side of the proposed subdivision.
Lalley and Lavine again pursued the issue of the easement for the
proposed berm along the south side of the project that extended onto State
property. Abbott requested and was given the floor. He strongly criticized
the board for pursuing the discussion of the drainage plan, complaining
that it was an attempt to delay the project or prevent the project from
starting.
Chairwoman Caldwell declared a ten minute recess at 8:55 P.M.

The board reconvened at 9:05 P.M.
Lavine initiated and determined the following from a review of the EAF
with Tallman:
The soil information was taken from the USDA soil survey for
Tompkins County.
Depth to bedrock was estimated from borings done when armory on
adjacent property was constructed.
The determination that there were no endangered species was based
upon applicants observations at the site. DEC and USMA Corps of
Engineers have not been notified.
Tallman indicated the drainage plan was based upon a fifty year storm.
Phase 1 will be for Parcel 1 with construction to begin in April 1990
with completion scheduled for fall 1990. Phase 1 will have 160 parking
spaces. Hi -Speed operates one shift spanning the hours of 7 :00 A.M.
until 6:00 P.M. Peak hours are estimated to be 7 :00 - 9 :00 A.M. and
4:00 - 6:00 P.M.
Caldwell: Does the plan address runoff during construction.
Tallman: Yes.
Lavine: Would the project consider a deed restriction on the D &R Abbott
property to prevent construction of an access road to the subdivision from
Lower Creek on that parcel.
Tallman:, They would prefer not.
Waldbridge: The Town Board expects that the new Town road constructed
during phase 1 on the project will be sized to handle all traffic for future
development.
Tallman asked what steps were needed to bring the action to closure.
Caldwell advised that the Board would initiate the SEQR process and that
there were time requirements for notification. Tallman requested that he
get some sense from the board as to what other issues needed to be
resolved. The board proposed the following steps to Tallman

maintain the portion of the berm along the south side of the
subdivision that extends to the storm sewer manhole and lies on

sate property adjacent to the subdivision.
2. Approval of the drainage plan by the Town Engineer and it
completion as part of Phase 1 development.
3. Approval by the Tompkins County Highway Department of the
curb cut on Hanshaw Road.
4. Approval of the new Town road to be constructed as part of
Phase 1.
5. Review and approval of the traffic flow analysis by the Town
Engineer.
6. Approval of the plan to control drainage during construction by
the Town Engineer.
7. Approval of the planting schedule for the berm by the Town
Planning Board,
The Planning Board indicated informally that they felt these issues could
be resolved at a subsequent meeting. The board indicated a willingness to
meet again before March to resume the public hearing.
Tallman requested a draft copy of the minutes.
The public hearing was recessed at 10:15 P.M.
In informal discussions after Tallman's departure, the board noted that an
easement may be required for sewer and water access. Tallman will be
advised of this by means of the draft copy of the minutes.

The Town Planning Board declares itself to be lead agency.
Motion carried with all members voting yes.
The Planning Board will direct Mr Slater to notify the Tompkins County
Planning Department, DEC, Town Board, Monkey Run Sewer District,
and NYSDOT.

Public hearing 10:25 P.M.
Four Lot Subdivision Robert F. & Marchetta Utter
Mr & Mrs Utter presented plans and an EAF for a two lot subdivision
along West Dryden Rd. After some discussion between Lavine, Lalley, and
the Utter's, the subdivision was reclassified as a four lot subdivision. Each
lot is 450 ft. x 150 ft. , each with 150 ft of frontage along West Dryden
Rd. Rotunda led a checkoff of the EAF by the board. The subdivision is
6.17 acres; each lot is 1.54 acres.
Public Comment
No one present to comment.
Accept EAF as modified.
Declaration of negative impact.
Motion carried with all members voting yes.
Approve subdivision as presented without modification.
Motion carried with all members voting yes.

Board Discussion
with Town Board Liaison
Lalley initiated a discussion regarding the boards frustration in developing
a policy regarding site drainage plans. Lavine agreed to find some model
regulation. Caldwell noted that a Landscape Architecture student ma be

working with Mr. Schug on the same issue. Waldbridge agreed to find out
if this was so.
