Public Hearing on Cleveland subdivision proposal off Peruville Rd. Mr. Schlecht appeared with Mr. Cleveland and presented a plan similar to the plan we discussed at the sketch session but with the following 3 changes: a) The proposed ponds are not shown since they may or may not be built. b) The road has now been centered in the land where it joins the existing road as the Planning Board had requested. c) An adjustment has been made per Planning Board request part way down the proposed road to allow vehicles to turn around or pull over without going to the end of the road. It also might be of help to school buses and emergency vehicles. It was noted that Lots 5 & 6 do not appear to have adequate frontage. This can be accomplished by a simple line adjustment at the "T" end of the road and a penciled notation of approximately how this is proposed to be done was entered on the working map (DPB file copy). It was noted that Lot 9 (and its adjacent lots) actually have more acreage than noted on the map. It appears that the map notations refer to lot size which is not in the power line R.O.W. and thus are the ones used for computing Health Dept. minimums. We discussed the letter from the Health Dept. based on their preliminary findings. Since the Health Dept. also requires some indication of an adequate supply of suitable water, they intend to use existing frontage and develop one lot before proceding to put'in the road. The lot which they develop will not be separated from the rest of the land until /unless the is rest of the project is completed. The EAF (long form) was reviewed. Page 3 -18 referring to possible agriculture district is unknown at this time but it appears that it is not significant in regards to this proposal. There were no questions or comments from the public. Hearing closed. Moved, 2nd, Carried that we issue a negative declaration on the EAF based on our review wherein we found no significant impacts on any of the major categories. Moved, 2nd,Carried that we grant preliminary subdivision approval to the Cleveland proposal subject to the usual health department approvals, road acceptance, and with the necessary changes to the west lines of lots 5 & 6 to provide adequate frontage. It was noted that Mr. Slater will be handling any necessary paperwork for the SEQRA process. 2. Sketch Conference- Stephen White & Charles Dollaway - proposed subdivision off Wood Rd. Mr. Herrick of T.G.Millers appeared with Mr. White & Mr. Dollaway. This is a subdivision proposed for 13 lots, minimum 1 Ac, with a new internal road. The subdivision would be called Spruce Ridge. The proposed name of the internal road is Spruce Lane. This may have to be changed to avoid confusion for emergency vehicles since there is another Spruce Lane in the county. Map (with accompanying photos) appeared to be satisfactory at this stage to the Planning Board. Letter from Health Dept. was reviewed showing some soil limitations which will also necessitate a drainage plan. Water quantity in the area appears to be good though perhaps sulphur content in some cases. Developers asked to check with Etna Fire Dept. (or possibly reach them through the county emergency coordinator) to see what, if any, impact there might be from the proposed new road entrance related to • emergency vehicles. Ralph Varn - Decision on proposed subdivision (commercial) off Rt.13 near Willow Glen cemetery - The Planning Board at the time of the Public Hearing had decided to defer any decision on this proposal to allow Mr. Varn time to get some response from the D.O.T. regarding potential increase in traffic problems and ways in which these could possibly be mitigated. We also were concerned that by approving the project we might in some way limit the options which the DOT might have in their proposed road improvements . By coordination with their plans we might be able to adjust the project to avoid substantial problems later. The DOT response which Mr. Varn delivered was quite limited (copy in project file) but Mr. Varn had brought his engineer with him to specifically address traffic issues. The engineer, Mr. Lawrence Fabbroni, has had specialized advanced training in traffic engineering. The sight distance to the proposed road entrance appears to be in excess of the approximately 800' which Mr. Fabbroni feels is adequate given the nature of the road and its traffic. There was a lengthy discussion of the proposed entrance, possible traffic counts for various types of uses, possible limitations on traffic turns, delivery hours, visibility after snow plowing, possible acceleration, deceleration and turning lanes, and whether the cost for said lanes ought to be borne by the developer, future owners as a group, owner whose use might trigger some numerical traffic threshhold, by the Town or by New York State, or by some combination thereof. Moved, 2nd Carried that we issue a negative declaration under SEQRA based on our decision that with the exception of traffic there is little or no impact. In the matter of traffic there is an impact but to the extent that it is detrimental in can be mitigated. Mr. Lavine and Mr. Rotunda abstained with Mr. Lavine wishing it be noted that he is extremely concerned over traffic risks. Moved, 2nd Carried (Mr. Lavine & Mr. Rotunda abstaining) that we grant preliminary subdivision approval contingent upon: a) Acceptance of road with any necessary road permits b) Any necessary Health Dept. permits c) That a letter be forwarded to the Town Board in their Special Permit or Site Development Review capacity that in any permits or review they place on this development or any portion thereof, that they consider: (1) Lots 1,2,3 & 4 have no curb cuts on Rt.13 (2) That Rights of Way be granted across Lots 2 & 3 for access to lots 1 & 4. (3) That restrictions be put in for left turning movements of vehicles over 5 tons in peak hours (4) That the Board consider methods of implementing acceleration, deceleration, and /or turning lanes on Rt. 13 to DOT specifications whenever it becomes evident that the ADT (Avg.Daily Traffic) will exceed 4000. (5) That at the RB interface (toward the rear of the project) an appropriate buffer be considered. 4. Resolution about Rt.13 projects Moved, 2nd, Carried that we set a policy for the Planning Board that all proposals coming to the board where the land fronts on Rt. 13 west of the Village of Dryden - be proposed that it be reasonable in considering all such proposals to require that the developers and /or landowners provide for appropriate improvements to Rt.13 (e.g. turning lanes, acceleration and or deceleration lanes related to the proposal) either at the time the permission is granted or by some mechanism or process which would automatically be triggered according to traffic conditions. We recommend to the Town Board that the same policy be applied to all Special Permits and Site Plan Reviews in the same area, B. Caldwell I i X I I I
