HomeMy WebLinkAbout1987-12-10is TOWN OF DRYDEN Planning Board Meeting Minutes December 10, 1987 The meeting was called to order at 8:10 p.m Present: Rose Marie Bobnick, Ron Chase, Mitchell Lavine, Julie Lee, Eugene Rotunda, Henry Slater, Barbara Caldwell, presiding Also Present: Cheryl L'Amoreaux 1. PRELIXINARY REVIEW - Dwight Harris (Commercial Subdivision) A Preliminary Review was held regarding the proposal by Dwight Harris to develop a commercial subdivision for a storage mall off Route 13 and Hanshaw Roads. This proposal will include a new road. Mr. Sherwood, representing Mr. Harris, presented a new application. He reported that there is an interested purchaser for a one acre sight. This proposal would convert an existing 20' foot right -of -way to a town - approved and town -built road in accordance with Town specifications. The road will extend through the property and across the front of the property to the storage mall. As soon as approval is obtained immediate steps will be taken to have the deed transfered to the Town. The Board expressed concern about the 400' substandard road to the storage mall as well as other potential developing properties - a standard road is • 60' wide; the road proposed is 50'; and an intersection close to Route 13. t Barbara Caldwell reported that there is a letter in the file to Don Shaft, dated July 21, 1987 from Don Gilbert, Highway Superintendent, giving his permission for a 50' right -of -way. Dwight Harris reported that the original property was purchased from Don Schaft for a storage mall; the 20' existing roadway was sold to us and is not a right -of -way. I am a limited partner of the mall and Don Schaft is selling the parcel to the gentleman who originally held a limited partnership with the storage mall (I purchased his limited partnership). Don Schaft and Solchie will deed over the property in order to make this road meet your specifications. The storage mall and I will be responsible for building the road to your specification. Don Schaft pointed out that the road is 50' wide instead of 60', because buffers will be 4' instead of the required 5'. The roads will be the same width, the only difference is in the shoulders and ditches. There was several comments made by the public in regards to a buffer strop separating the MA zone from other zones and potential drainage problems the road might intensify. Much discussion was held on the road distance to Route 13, the road width, road configurations, the buffer on the south side of the parcel labelled •"Wilcox ", the buffer on the south side of the parcel labeled "Salonge ", and drainage. PB: 12 -10 -87 Page 2 The Board discussed the requirements for the buffer strips and that a •contingency in a form of written approval from the TC Highway Department on the location of the intersection recognizing that there is a possibility that the MA Zone service road could come farther south on Hanshaw road and that there exists a small road which would have to be taken into account. An Environmental Assessment form will also be needed. !. No action can be taken regarding the EAF or proposal. After much discussion it was the general consensus of the board that it would recess and reschedule for continuation on December 17, 1987 at 8:00 Pt m. 2. CONTINUATION OF PUBLIC HEARING - Doug Sutton's (Subdivision) A continuation of the Public Hearing to consider the application by Doug Sutton to develop a subdivision of 28 building lots from 46.7 parcel of property. This subdivision would be on the Ellis Hollow Road, a revised map was presented to the Board. T. G. Miller, a consulting engineer, working with Dave Herrick and representing Mr. Sutton, reported that the plan presented last month was changed to reflect the concerns expressed at the last meeting. Eliminated was access from Ellis Hollow Road, increased size of the lots on Hurd Road and change in interior loop. The new plan has 26 lots instead of 28 on the 46.7 acre parcel. The average lot size will be 1 2/3 acre. We are asking for preliminary lot approval of this layout. •The drainage situation has been looked into. The outlets for the area are at the northwest and southwest corners of the property. On the Hunt Hill Road and Ellis Hollow intersection there are two undersized culverts. The town recently put in a 36 x 54 culvert halfway up Hunt Hill Road to the bend to take water down the south side of the road and through those culverts. One of the culverts are 18 ", the other is 21114 It appears that there could be a drainage problem At Hurd and Ellis Hollow Roads existing 5' x 10' boxed culvert is about to replaced with an aluminum corrugated metal culvert by the County. The creek is a designated trout stream and requires a 100' buffer strip on either side in which you could build houses but you can't put sewage disposal systems. The lots along Hurd Road and the north side of the stream have been changed to take this into consideration. The drainage within the sub - division will follow the natural drainage patterns amd carry it to the south -side of Hunt Hill Road through a culvert under the road and then over to the creek or along roadside ditches and property lines to the creek. We discovered that the Town recently put two 21" culverts under Hurd Road which freely discharge on Mr. Sutton's property in inopportune places, without permission. Request is that perhaps one be diverted into a swail to get to the stream. No drainage problems are caused by developing this area. The TC Health Department has been contacted regarding the wells and sewage disposal systems. A number of .test holes have been dug on the property •since 1978 but the Health Department have indicated they want more and Mr. Sutton is planning it before the end of the year. An Engineers Report will be sent to the Health Department concerning sewage disposal and PB: 12 -10 -87 Page 3 length of tile fields that are required for various size houses. The •water flowability is their main interest and have requested we test a number of wells around the perimeter of the property and submit the report. Two wells are already on the property, one is 60' deep and produces 80 gallons per minute, the other is near the old farm house and is 20' and produces 12 gallons per minute. Water was hit in excess of 8 feet according to the three Health Department test holes. To our knowledge there is nothing in this subdivision considering road width or road grades. The road will be a 60' right of way. There was much public concern expressed regarding the area sewage systems, water levels and conditions, road safety, child safety on Hunt Hill Road, pollution, cutting of trees, drainage, run -off, contamination, bedroom, lot sizes, and soil types. It was agreed by Mr. Sutton and the Board that deed restrictions would be made such as: 1) No trees over 3" would be cut except for driveways and house foundation for construction. 2) Septic tanks have to be properly pumped 3) Wells to be fully cased and grouted Some sort of drainage plans properly documented for the northside of the property as the people on the southside will have the creek. •Chairman Caldwell reported that because of the lack of needed adequate information to make a final determination the Public Hearing for Mr. Sutton was declared closed. • 39 SEAR ISSUES Chairman Caldwell reported that the Board has been asked to review the SEQR issues and make comments. This is tentitively scheduled for the December 17, 1987 meeting. 4. MINUTES OF PREVIOUS MEETINGS No minutes of previous meetings were approved.
