HomeMy WebLinkAbout1987-01-15DRYDEN PLANNING BOARD MEETING January 15, 1987 The meeting was called to order at 8 :15 p.m. Those present: Gene Rotunda, Julie Lee, Barbara Caldwell, Buzz Lavine, and Henry Slater. Rosemarie Bobnick arrived later. Ron Chase was absent. The minutes of December 18, 1986 were presented. There were two points of clarification: l.) The "For Your Information" section refers to the Hungerford subdivision and should read each purchaser of the lots is to receive a copy of the final subdivision map. 2.) In the paragraph at the end of the minutes referring to Sodom Road it reads 90% of the people did not want the name changed. This was 90% of the people who lived on the road. On the previous petition 90% of the people who signed it did not live on the road. MOTION was made to approve the minutes as amended. SECONDED. CARRIED. • There were four public hearing on the agenda this evening: I. THE APPLICATION OF RICHARD NEFF FOR APPROVAL OF A FIFTEEN LOT SUBDIVISION ON NORTH ROAD. Mr. Novelli representing. The appropriate tests were done and the Health Department's official written report is on the way. John Anderson has approved the site for one acre lots with either a fill or mound sewage system for each lot. The subdivision plans were sent to the soil conservation service to the Attention of Tom Todd for an erosion control plan. IThe site has been looked at and no large problems are foreseen but the conservation service would rather wait until the snow melts to look at the ground before they issue a written report. At this point it looks as though Mr. Todd has no objections to the plan and that the soil conservation service would like to specify erosion control measures for the construction. Mr. Novelli said that he had no problems with that. This area is not classified as a wetland, and it is not in an AG district. The last remaining topic was regarding the dead end road. Mr. Novelli elaborated on a description of the difference between rural and urban 'roads. He classified North Road as rural and felt 1500 feet was not excessive; especially since the road's location would allow for a continuation. Mr. Novelli was asked for an elaboration on the continuation of the road. His response was that if at sometime the next parcel of • land were to be developed that the logical place to have the road would be to continue on with the road in this subdivision. . Mr. Lavine wanted to comment that he would make no serious issue of the dead end road, but wanted it recorded that he has a concern about roads this length as he had a concern about this issue the last time it came up. He feels this is an issue that the Board should pursue as a policy issue and get something set on this Board or within the Town as a formal policy that can be applied on a regular basis without having to deal with it on an individual basis. Mr. Lavine felt they had made a terrible mistake previously; this is not necessarily a terrible mistake but is certainly in the range where he would have questions about it. He wanted it recorded that he has questions about it and that it is past time that the Board had set a policy on this within the town. A MOTION was made based on what was presented this evening to approve the application as submitted and consider it an unsignificant action with a negative declaration on the Environmental impact. (Since the Environment Assessment Forms were outstanding, action taken must be based only on what was presented tonight.) SECONDED. CARRIED. Jason Slottje addressed the board next. Mr. Slottje bought land on Hanshaw Road and Route 13. He received a variance on this property in August 1984 from the Zoning Board of Appeals for entrance to build a mini - warehouse. • Two months prior to this evening Mr. Wilcox came to the Board about purchasing part of this land for another commercial purpose. Mr. Wilcox wanted to know if this was possible and if so what the procedure would be. Would he go through the Planning Board, the Zoning Board of Appeals or what other mechanism should be used to do this if indeed it could be done. Based on the sketch which Mr. Wilcox presented it appeared that it probably came under subdivision regulations. From a review of subdivision outlines and a conversation with Henry Slater Mr. Slottje felt that this is not a subdivision. It would be a subdivision if within 5 years the parcel is broken up three times which has not been done. If in fact, the original owner holds one piece of land then it takes four times breaking it up for it to fall under subdivision. This is not the case. Mr. Slottje purchased 13 acres approximately 2 years ago. The Zoning Board of Appeals gave permission to build with 25 feet of frontage. A year later Mr. Slottje received a special permit to build again. Now, he's asking to break off one acre of land,for Mr. Wilcox to build a warehouse facility. Henry Slater investigated: he agrees it does not fall under subdivision classification. Mr. Slater felt the problem here is an insufficient roadway. Discussion about the road followed with an • explanation that this roadway is not a public road and that there would be a minimal amount of traffic. i i I • Barbara Caldwell recommended town attorney about whether this Board or the Zoning Board of strictly for the zoning officer to Mr. Slater said he was waiting willing to work with Mr. Slottje. 1 that Henry Slater speak with the i issue comes before the Planning Appeals or whether it's a matter just go ahead and issue a permit. to hear from Mahlon Perkins and is II. THE APPLICATION OF AVERY AND LEONARD PARK FOR APPROVAL OF A NINE LOT SUBDIVISION ON BAKER HILL ROAD. Mr. Robert Flummerfeld representing. Maps were presented showing adjustments to lot #9 and changes were made to the end of the cul -de -sac configuration. The question arose as to whether potential tenants would know this is an actively agricultural area. Mr. Flummerfeld responded yes. Perk tests were done on an extremely wet day in December. The ground was soggy and what was expected to be the best soil wasn't and vice versa. The Health Department would like to conduct more tests in better weather in the spring closer to the actual location of the disposal system. The question was asked whether these homes would be medium or high income since both were checked on the form. The response was that they didn't know where the dividing line is between medium and high income. Mr. Reed questioned when the road construction is due to begin. Mr. Park wasn't sure. MOTION was made to accept the Environmental Assessment Form and consider it a negative declaration with an unlisted action. SECONDED. No discussion. CARRIED. MOTION was made to grant preliminary approval of the subdivision itself. SECONDED. Subject to: Town approval of the finished road or satisfactory Bond or letter of credit according to the town regulations, Health Department approval, Town Supervisor approval, with revisions to drainage to cause some flow to go towards the fire pond behind New York State Electric & Gas Corporation. CARRIED. III. THE APPLICATION OF MR. CLARK FOR MODIFICATION OF A LOT LINE ON GENUNG CIRCLE. Mr. Clark presented maps to everyone to show the 12/100 of an acre that he wishes to purchase from a neighbor. It doesn't make either lot substandard in size. The lot is a vacant lot. It's basically a modification of the boundaries. 9 MOTION was made to approve. SECONDED. CARRIED. N n U IV. THE APPLICATION OF MR. ROCCO LUCENTE ON A SEVEN LOT SUBDIVISION. Mr. Larry Fabroni representing. Mr. Fabroni gave a brief description of the subdivision as per last months meeting. Since that time he spoke with John Anderson about the problem with the sewer. Mr. Anderson's first preference naturally was to connect with the public sewer system in Cayuga Heights. Mr. Anderson was not too receptive to the septic tank idea. Mr. Fabroni reiterated that he was asking for preliminary approval tonight so he could move ahead with the final design for Mr. Anderson's approval. Water has been approved for this area already. Mr. Fabroni was asking for approval of the subdivision as it was 5 years ago. If the Board doesn't approve based on sewage then there's no way to go to Mr. Anderson. MOTION was made and SECONDED to grant preliminary approval contingent on Health Department approval, any necessary approval for public sewer and water, Highway Department approval of the road or acceptance of the road by the town or approved Bond or letter of credit according to their current regulations, and input from the county because of the location of the road in conjunction with Hanshaw Road.
