According to a review of Part 617 (SEQR Procedures) this subdivision is an
Unlisted Action, and coordinated review is required only if a DEIS is being required.
If the Town of Dryden is requiring a DEIS, the Town of Dryden must be the Lead
Agency.
If the Town wishes to coordinate review, it must declare itself the Lead Agency.
The Town does not seem willing to become the Lead Agency, and neither does the
Health Department. Therefore, each agency must make its own determination of
significance within 15 days of receiving a completed application.
We would like to point out that 617.6 (d)(i) states "...if such impacts are of
primarily local significance, all other considerations being equal, the local agency
involved shall be the Lead Agency." It's quite clear all impacts of the project will
be neighborhood or Town impacts, not intermunicipal or County impacts.
