Chr. B. Caldwell called the meeting to order at 7:45 P.M. She
relayed a telephoned concern from Alton Reed (who cannot be present
tonight or at the Public ;-searing set for Mar. 5th. His concern was
about Blo Tech - whether it should be a special catagory with extra
precautions, It is now listed as research development. He wanted
to be sure everyone was aware of it to make certain there were enough
safeguards. Reed was also concerned about harmful wastes not being
taken care of properly.
Discussion: decided we don't need to do anything - no special case-
Bio Tech will be handled through Site Review,
Discussion: Article XII District Regulations M A zone Sec. 1201
Hunt - question- farming as allowed use in M A and hotels & motels.
Decision to delete numbers 4 and 10 from "'Sec. 1201.
Section 1202 Simplified Procedure
Discussion `= A l it means is to go back through Site 'review - doesn't
simplify this process at all-
Schlecht - good point, not sure of its' intent.
Hunt - Needs to be revised- If Zoning Enforcement Officer has a doubt
as to being noncontroversial or negative declaration needs to be made
undgr SEQH, then ZEO should refer to Site Plan Review. But if he has
no doubts he can issue a permit.
Caldwell - Yes, because you want something that is absolutely non-
controversial to not have any delays.
Cotterill - At a public hearing there's always going to be someone
to find something controversial, maybe the wording could be changed
to meeting certain set criteria before going throughrmore review process,
We don't need a lot of public hearings for standard. situations. If
we are talking about harmful chemicals or hazardous wastes etc. then
we may need a public hearing,
Schecht / Cotterill - Must separate idea of Site Review from a Public
Hearing, The two aiv not the same! Neither Site Review or Public Hear-
ing on a major project would be necessary as long as the State Enforce-
ment Officer and local Zoning Officer is satisfied the project meets
the criteria:,

Hunt - We don't ve a Site Review Process. The State defines the
function of an aa. nistrator (Zoning Officer) is to make simple
administrative decisions whether to grant the permit. A Site Review
Board could be used for border line or questionable decisions.
The point here is unless we set a criteria, we're asking Sib tomake.
a judgement call. If he has a set criteria to go by, and the plan
meets the criteria, Sib can then make the administrative decision to
issue the zoning permit. If tla plan does not meet the criteria, then
Sib can refer to the SPRB.
Porteus - As a normal course he refers to the Planning Board, would
he not?
Caldwell - No,,
Hunt - At present if a plan does not meet criteria, Sib refers to the
Zoning Board.:of Appeals for a decision. This is why we are trying to
set up an Administrative process for minor changes.

Caldwell - Yes. Example: If you purchased a chunk of land in M A for
a small business, and your plans met present requirements, Sib could
grant a permit.
Question - How is Town Board going to know who applied for a. project?

Cotterill - That's why I say I don't understand the reasoning for that
If 'we have Zoning Officer and State Enforcement Officer (who is a
licensed engineer) in my opinion, these people are as qualified as
anyone to make decisions when a plan meets all the requirements. That
is what we are paying these men for. I'm not opposed to the Town Board
going over any questionable situations these officers may encounter,
but if a normal request meets all requirements then it should not be
necessary to bring a board.,
Hunt - Sib should be able to say,
set by law, and grant the permit.
This proposal meets the criteria
Decision - to delete the last two clauses -(or in the event that
Town Board or the Planning Board requests it, then the applicant
shall comply with Article XXIII of the Ordinance.)
Section 1205 Density & Area Requirements
Hunt : Over restrictive in district regulations of M A - limiting
building & parking area to 40% of lot.
Discussion - Agreed that 60 - 70% would be better. 60,E had been
recommended by the Development Committee.
Decision - to-change to 600.
Section 1206 Yards and Landscaping
Hunt recommended to change #3 to read "buffer strip densely planted
by time of occupancy, at least 30 feet wide and at least 8 feet high
at maturity. Also recommended option of landscaped berm (very effective
and much cheaper) be added. Agreed.

Section 1207 Industrial Performance Standard
Discussion - #2b 3 on Ringlemann Chart or 30% opacity. Decision -
• to leave as written.
Article XVI Special Regulations Section 1604 Flight Hazard Area
Discussion - Statement had been made by Atty. Perkins that the State
and Federal regull ons were sufficient. No need for us to try to make
further decisions here. Agreed.
Article XXIII Section 2302.4 Review of Preliminary Site Plan
(C) Public Hearing -
Hunt - I think we should expand the time limit on correspondence
SEQR from 30--days to 45 days of receipt of application and change
advertisement in newspaper to 5 days before public hearing, just
to be consistant with time limits. Agreed
Section 2302.5 Preliminary Site Plan
Add after first clause, "or the date of public hearing if held ".

Schlecht - Do we have a map to present to public Tuesday night
•showing the proposed M A zones?
Caldwell - That was done by tax map numbers, but no large map was
made. It should be on an overlay.
Hunt - I can trace it on one of the overlays by Tuesday for the
Public Hearing.

Chip Ray and his engineer, Bill' Albern, were in for approval of an
expansion of Hillside Acres Trailer Park in Varna..
