At the Planning Board meeting, Chairwoman Caldwell noted at the County Plan-
ning meeting, they voted to encourage a ------ s return law. Has some strong
enviromental groups come in and speak. Ralph Jourdan from Chamber Commerce,
talked about what this would do to small business men. Paul Munson from Lansing
stated he would now be in favor of it. Lansing spent alot trying to keep high-
ways clean. They voted for recommendation.
On April 15, 1981, Chairwoman Caldwell attended a meeting on housing etc.
She picked up maps concerning the cross county highway. Two maps were presented
showing that portion in town of Dryden.
Basically it would come off over Pinetree Road, go over through Judd Falls,
town of Ithaca has had a right of way saved for this purpose for quite sometime,
Goes between P and C and the apartments. Then go over Game Farm Road and then
use area noted on map by Chairwoman Caldwell, near trailer park on Forest Home
Drive and catch onto Freese Road by beef place and go up to Hanshaw. They would
improve the intersection. Then go through Rocco's section by Route 13.
In Town of Dryden, its not hitting any major roads except Route 366, Forest
Home. People can get onto it on Freese Road.
After some discussion on it, Mr. Bonn noted
far. Chairwoman Caldwell would take the Planning
Planning Department.

Board's comments to County
As a board, we inform the other boards that deal with sub - division, zoning
so forth, they are required by state law to consider solar access in any de-
cision they make. This is not a, should not receive any special kind of priority
over such other factors we consider. State law mandates it be considered. If
we can help any other boards in understanding it, we have publications and in-
formation that Mr. Stewart has. This was stated by Mr. Hunt, who attended the
meeting along with Chairwoman Caldwell and Mr. Lavine.
Mr. Hunt was disappointed dt the meeting. Same presentation was given
that he gave at our Planning Board meeting. We don't know what the law means.
It was recommended by Mr. Hunt that the board has been informed that our state
law requires that solar access be considered, as a factor, not of any special
priority among the other factors on which zoning decisions are made.
Mr. Bonn wanted to know if that would require the board doing something
about sub - division regulation. Mr. Hunt.didn't think so. They warned about
putting in some general statement. There has been no court experience so far.
As far as Town liability, if we can say we have considered solar access in
making our decisions on any -- - - - - -• Applies to sub - division; Zoning Board
of Appeals as well at Town Board and Planning Board. This recommendation was
seconded by Mr. Bonn. Motion carried with two members voting yes and one
opposing.

Other Business:
Mr. Bonn is concerned that we never as a board, in spite of early updates,
a year ago about progress of sewer commission, never had any update or infor-
mation on it through the Town Board. It seems that the whole sewer program is
an appropriate.area for discussion and consideration for making recommendation
from the Town Planning Board. We should be serving in some king of advisory
capacity.
Chairwoman
Caldwell went

meeting and asked Henry to
come and update
us and he isn't
here. We want to
express our concern. Mr.
Bonn felt that
the Town Board
is ignoring us.

Re: Proposed Road for Clinton E
Dear Members of the Planning Board:
Cotterill
Mr. Clinton E. Cotterill has ask me to represent him
before you and before the Town Board of the Town of
Dryden, with respect to his proposed dedication of
a private road to the Town of Dryden as a public
road and right ,of way. The road runs generally
northerly from the Dryden- Virgil Road and has been
constructed to Town of Dryden specifications. I
believe the Town Highway Superintendent will cer•t-
ify.tao that. Mr. Cotterill has agreed to laying
doom coat of stone and oil on the road to the
specifications of the Town of Dryden, Highway Super-
intendent.
I am appearing before you to explain the reasons why
I believe your approval of this road and Mr. Cotterill's
future sale of lots in this area is not needed. To
begin with the proposed lot lying to the west of the
intersection of the proposed road and north of the
Dryden - Virgil Road with frontage on both of the pro-
posed road and the Dryden - Virgil Road would not.bring
Mr. Cotterill within the definition of your sub- division
ordin.a.nce He has previously sold a lot to Mr. Lampila
on the other side of the proposed road.
The balance of the lots will all be over 10 Acres
in size and accordingly are exempt from the sub - division
regulations. Those lots include a lot on each side of the
Proposed road(1 to the east, 1 to the West) and
on the north of the proposed road and its terminus 4
Each lot would exceed 10 Acres.
Under.the circumtances and according to your own sub-
• division rules and regulations, Mr. Cotterill's prop-
osals do not fit the definition of sub - division.

I am appearing before you as a courtesy to explain why an
offer to dedicate the road will be made directly to the
Town Board and not to the Planning Board. If you
need more information I would be happy to provide
you with that.
