The Planning Board opened the meeting with the approval of last month's
minutes. There were no corrections or additions, so minutes were approved
as submitted.
Representing the residence of Peaceful Drive were Mr. and Mrs. Barry
Cooper and Mr. and Mrs. William Schutz. They had been to the public hearing
held Tuesday, September 16, 1980, that the Town Board conducted, concerning
Mr. Douglas Sutton's plan to realign the road.
Mr. Cooper's main concern with the proposal is unfair to change the
realignment especially when there is no real reason to do it. There is
one person who favors it, because it moves the road further from his house
and gives him more land to buy from Mr. Sutton.
The Planning Board at that time, said they had no objections as long as
all the people on the street that were affected by the proposal, could agree.
Consequently, they don't agree.
Mr. Cooper tried several times to discuss a compromise situation with
both Mr. Sutton and the Halls but, they have never shown any favor to this.
Mr. Cooper has been trying to buy the lot from Mr. Sutton for 1J� years. At
the meeting Tuesday evening, Mr. Sutton stated he would sell Mr. Cooper the
lot after everything is settled. If the Planning Board and Town Board accept
the proposal to realign the road, then Mr. Sutton will offer to sell Mr. Cooper,
as he stated, the new triangular lot, which would be of no use to him. If
proposal refused, then maybe Mr. Cooper can settle the deal originally agreed
upon, which is for the existing lot' #5. The reason Mr. Cooper particularly
doesn 't want it, besides having cars speed around the corner outside his
bedroom window, is to plant trees to protect his house from the wind in the
winter.

proposal. Mr. Bonn stated he felt the Planning Board was at a disadvantage
due,to two new members, no drawings, haven't heard the discussion of Tuesday's
meeting and no opposing point of view. It would be unfair to reach a decision.
Chairwoman Caldwell asked if Mr. Cooper could write a letter stating the
concerns of the proposal. Mr. Cooper will write a letter plus supply a copy
of the plans that Attorney Perkins had given him.
Mr. Lavine stated that there were two things, he recalled from April
meeting and before,

Mr. Cooper stated that in

the same complaint. He said at that
time,

was willing to consider some

Other Discussion:
Chairwoman Caldwell stated Mr. Hanshaw_.will be at October meeting con-
cerning his development in Ellis"Highlands and will bring a topography map.
County Planning Report:
.Chairwoman Caldwell stated the Route 13 corridors are being discussed
again. There is a faint possibility that Cortland may change its mind. May
possibly open up the further north route again,
Zoning Officer Stewart presented a drawing from Douglas Sutton concerning
14 acre parcel off Eagles Head Road; with combineing frontage. The person
buying the parcel, possibly would divide lot.in future. If at that time he
would have to see Zoning Board of Appeals to get variance because of lack of
road frontage.
Also involved is a parcel on Ringwood Court, which originally was owned
by Cornelius and could not be used because not enough area to build. They
sold it and in return it was bought for taxes. Someone -ants to build on it.
Mr. Sutton may buy this parcel, ac "ing to other part of 1 �cel to make another

Planning Board wasn't sure if there could then be three building lots
making it be a.su b- division. Chairwoman Caldwell stated an earlier.ruling,
as made by late Attorney Amdure, making one lot large enough to build on
and not considered a sub - division.
Chairwoman Caldwell will see Attorney Perkins and get a ruling on this.
In the meantime, Mr. Stewart can fissure a permit for the one parcel off Eagles
Head Road.
