September 24, 1968
Dear Mr. Locke:
We continued discussing your relocation, the RC zone, and permits for over two
hours after you and your brother left last Thursday night. From this confrontation
and our discussions we have determined that the RC zone intent and purpose (and /or
perhaps that specific area) needs further evaluation and reconsideration. Frankly,
it is impossible to say now how such changes would affect you.
Although we wanted to evaluate your suggestion of a wording.change in the RC
zone allowed uses, we should not and do not intend to add specific wording to a
zone such that there could be any allegation of prejudicial treatment. This does
•not mean, however, that a zone, allowed uses, or uses by permit as they now exist
will not be changed before the final ordinance goes to the first public hearing or
is presented to the Town Board. We might very likely have another public meeting
in that area to ascertain sentiment toward what type of development should be
allowed not a specific individual use, but rather the type or range of uses).
Also, we perhaps need to-reevaluate the area there itself, in light of recent
developments unknown at the time the overall zone was established.
Your brother commented on some of the suppositions in my letter to you. In
summary I can only say that it is impossible for us to make anything other than
suppositions at this time since the ordinance we are working on is not complete,
and when it is complete it will be only our Planning Board recommendation, subject
to possible changes after public hearing, evaluation by the Town Board, another
public hearing, and an ultimate decision by the Town Board whether or not to
accept it and make it law.
Several of the comments and suggestions made by you and your brother last
Thursday were helpful and have stimulated further thought and evaluation by the
Planning Board. However, it will take another meeting or two to resolve any changes,
and as I have tried to make clear above, even then (though we as a board or as in-
dividuals may feel your location in a particular spot is good) we cannot give any
assurance as to the final outcome of the ordinance.
