Zoning Board of Appeals Town of Dryden -�gains-t 2 , 198 0 Present: Chm. B. Keech, D. Rose, K. Marquis, P. Brellochs, C. Hatfield Zo. S. Stewart A public hearing was conducted to consider the application of Lee Robbins of 149 Johnson Road, Freeville, N.Y. to place a double -wide mobile home on his property at above address and is requesting a variance of -Section 803 of the Town Zoning Ordinance which requires that a lot have at least 30,000 sq.ft. of area. A trailer was on property when former owners lived there and this was prior to zoning. The new sewage system is installed and approved. Mr. Herb Hatfield, 130 Johnson Road, stated he thought there was enough area. It was stated that the lot size falls short because quarter of it, is road way. Grover Woods, 118 Johnson Road, wanted to know what Mr. Robbins purpose was. Mr. Robbins stated the double -wide trailer will be put on basement that is being constructed now. This will be his own residence. Mrs. Harrison Dayton wondered if propety along the road would decrease in value. Mr: Keech thought it was hard to say, if he does nice job on trailer, it shouldn't. Decision: All members voted yes, variance granted with stipulation that it be com- pleted within twelve months from date of variance granting. if he decides to divide the lot in the future, the board stated it would rather see a straight line back on property, rather than the dog -leg he had shown on drawing. Stewart Hearing #1 - Walter Pintner A public hearing was conducted to consider the application of Walter Pintner to build a house at 9 Nottingham Drive and is requesting a variance to Section 702 of the Town Zoning Ordinance which states that a lot must have at least 125' of road frontage. Mr. Anthony Blackler of 14 Nottingham Drive stated his concern about the placement of the driveway. He stated that possibly could be resited to enter V at an angle so his driveway would be less obstructed by trees. The board noted that a cabin was .on the property and being used as a rental. Mr. Pintner stated the cabin was there when he purchased the property from. Mr. Evans. Mr. Pintner installed a septic system and water. Decision: All members voted yes, variance granted. The decision of the placement of the driveway will have to be among the parties.:'involved. Hearing #2 - Mr. Ormsby Dolph - Finger Lakes Stone Company A public hearing was conducted to consider the application of ,Finger Lakes Stone Company, Inc. for a certificate of compliance for the property at 1187 Ellis Hollow Road, tax parcel #67-1-55.12 and is requesting a variance to Section 702 of the Town Zoning Ordinance. Mr. Dolph had nothing additional except that he maintains the drive on an annual contract. Decision: All members voted yes , variance granted with the stipulation that the property owners would not look to the Town of Dryden for services. Hearing #3 - Edward Olmstead A public hearing was conducted to consider the application of Edward Olmstead Jr. of 58 Spring Run Road to build a storage building and is requesting a variance to Section 703 of the Town Zoning Ordinance which requires that a building be at least 25' from the rear property line. Nothing additional except that shed to be put on angle due to the shape of the land. Decision: All members voted yes, variance granted. Do0 Vice -President., U Unnecessary hardship, as follows; In 1978, the late Ormsby Dolph applied for and received a building permit for the property now completed as shown on the survey map attached, on the upper pond. In reliance on the building permit, the house has been built which is now in the process of being sold for $165,000. The house, as well as the earlier house, is built on a private street, and the property has almost 700 feet on the private street as shown on said survey. The zoning ordinance does not specify in its definition of frontage any distinction between public'or private street. Ormsby Dolph was the principal shareholder and owner of Finger Lakes Stone Co., Inc. at the time of his death. Prior to the date of his death, he commenced construction of this home as a personal residence, but his illness and death made it impossible for him to complete the home. The company and the estate had no choice but to complete the partially built house in order to pay off the construction mortgage acquired by Mr. Dolph before his death, in order to have funds to pay estate taxes.
