Stewart The zoning board conducted a public hearing March 4, 1980 to consider the application fo Lloyd and Jean Layaw of 1129 Dryden Road to rent their property at 1145 Dryden Road to a commercial publishing business and is requesting a variance to Section 901 of Town Zoning Oridinance. Mr. and Mrs. Layaw had no additional information for above named property. Speaking against the variance was Mr. Randall Cole of 1154 Dryden Road. His main concern was in changing the use of the property, which could set a precedent for future business. Ken Tillapaugh, a neighbor, stated he heard no opposition, just a concern as to what was going on at the site. The neighbors would rather see the place occupied than be vacant. Mr. Rose read a statement from the County Health Department, stating no problem as far as the septic system was concerned. Decision: All members voted yes, the variance granted. Deliveries of paper and publications for mailing are made occasionally. In addition, UPS delivers packages from time to time. None of the truck deliveries occur often. July 1, 1980 Present: Acting Chm. D. Rose, K. Marquis, P. Brellochs, Ch. Hatfield, Zoning S. Stewart The zoning board conducted two hearings on July 1, 1980, as follows: Hearing #1 - 7:30 P.M. A hearing was conducted by the zoning board to consider the application of Lloyd Cotterill of Harford, N.Y. to build a house at 277 Lake Road, Dryden, N.Y. He is requesting a variance to Section 702 of Town Zoning Ordinance which requires a lot have at least 125' of road frontage. Mr. Cotterill had no further information except this parcel is twenty-nine acres in size. Decision: All members voted yes. The variance granted with stipulation that one re- sidence only on twenty-nine acre lot and road frontage access for that one resi- dence only. Hearing #2 - 7:45 P.M. The Zoning Board conducted a hearing to consider the application of Robert Alcorn of Moravia, N.Y. to build a Meat Processing Plant and Slaughter House at approximately 65 Cortland Road. He is requesting a use variance to Section 801 of Town Zoning Ordinance. Residence of the area involved, were concerned with following: 1) Run off - some residence have problem in spring with additional amount of water in basements. 2) Noise 3) Smell - manure from animals 4) Will decrease value of property. Those residence voicing concern: 1) Ed Little - 17 Cortland Road 2) Mr. and Mrs. C. Taylor - 6 Mott Road 3) Walter Stairs 4) Ralph Shortell represen-issd TC3 5) Jack Benson - represented Boys Scout of America 6) Roger Hatfield 7) LestLr Stairs was in favor. Mr. Alcorn stated that he understands concerns. The manure has to be barrel- ed and the blood and parts of animals not used would be picked up by rendering trucks. Also stated that the business would be inspected twice a month by the state. .Zoning Board of Appeals -2_ July 1, 1980 He likes this location and feels he shouldn't have to have his business on some back road, away from everything. Decision: The board with -held its decision because they felt more information from Mr. Alcorn was needed. They felt if he could have someone draw his building, siting it on the property showing dimensions of building and access to and from it. Also information from Health Department on size of property requirements for this type of operation. Hatfield The Zoning Board of Appeals conducted two hearings, August 5, 1980, as follows: Hearing #1 - Robert Alcorn - Moravia, N.X. A public hearing was conducted to consider the application of Robert Alcorn to build a meat processing plant and slaughter house at 348 North Road and is requesting a variance to Section 801 of Town Zoning Ordinance., Mr. Keech asked who Mr. Alcorn was and if he had anything else to say or any other information to firing before the board. Mr. Alcorn stated no, samething as before, plans to build a nice place. Mr. Hatfield suggested that Mr. Alcorn explain what he is going to do. Last time we had kind of a backwards front thing. If he explains what he is going to do, the people might know.more. Mr. Keech asked if he wanted to do that and tell the people that are here to say something. They're either for or against. The more information you can give, the more it will be better for you. Mr. Alcorn proposes, if can get through board, to construct a building on North Road, its a third attempt here in Town of Dryden. Intends to operate a nice clean place, which 'I have to do for the government anyway. I don't know any of there things are objectionable around the countryside, maybe you folks do but I don't. The ones I've been association with have always been a nice -..clean houses. Maybe some of you folks have had some bad luck somewhere around, I worked in two or three of them. Intends to set back from the road approximately 240' on land off Mr. Lewis's . Why don't you ask me some quest- ions. Mr. Hatfield said why don't you describe the building. Tell how many rooms and all this and that, so they will get an idea. Mr. Alcorn stated the building will be 110' long and 50' wide and everything is inside of it. It will have an overhang out front where people back up to pick up their meat and deliver their meat. Operate three phase power that goes out that road. Don't have to change anything out there. The sewage goes underground, no run off. There can't be any run off from any of these buildings. Low profile building made out of blocks. Won't use anymore of that land back there than he can help, but 240' back is fair, anything else. Mr. Keech - thank you. Why don't you sit down right there , at the table. Mose of these questions that these people will have, you're the one thats going to answer them. So - we're open for question any of you might have, either for or against this. Nili•.1t a �a •_" •fir' 'd96 ! ti If 1 Zoning'Board of Appeals -2- August 5, 1980 Mr. Alcorn - Mrs. Olds, I just don't feel as though I should be up on Irish Settlement Road or Simms Dill Road, it will take me.out of the line of traffic. Irene Olds - You'll have trucks coming in there all night long. Mr. Alcorn - I don't anticipate I'd kill over fifteen head of cattle a week. That's been my experience in Moravia. I'm sure there is more cattle trucks coming through there that come to the auction Monday than I would ever have. There is some cattle truck traffic on that road because I've watched it. Irene Olds - Yes I know there is, but its not cattle being slaughtered right here, we just live right across the road, not just kitty cornered. Mr. Alcorn - I know you do. Believe me the worst odor you get out of my place is the smell of hams and bacon. Mr. Keech - someone else. Residence - What do you do with the insides? That was his decision. The other one was where the Adult Bookstore was and Tompkins County Health Department said there wasn't 200' circle that you have to have for sewage. In other words he couldn't sell this business to somebody else, this variance is just for him. And we can put many restrictions on to it. He can accept it or not that's up to him. Residence - How many acres does he intend to buy. Alcorn - twenty Residence - So there's room for expansion on twenty acres, whether he does it or someone else. Mr. Keech - That's very true, it he wants to if we decide to grant this and he wants to live with the conditions we might put on to it, its up to him to decide. Mr. Keech - let me ask you, when these cows are being brought in -- brought in, in bunches or more or less just -- Mr. Alcorn - I wish they were but, there not. One a day what ever, 2 a day. Mr. Keech - where are you going to hold these cows? Mr. Alcorn - inside the building, Mr. Keech probably hold them for how long? Mr. Alcorn - wouldn't hold them over twenty-four hours,. Mr. Keech - What about odors down wind. How much are we going to smell. How about your place in Moravia? Mr. Alcorn - honest to God, there were people who lived within 80', I've never had any complaint. Restaurant right next door, trailer out back, milk plant right across the street, gas station across the street. I. Olds - Why do you want to leave there, then? Mr. Alcorn - I sold the business. I. Olds - Why do you want to get right back into it? Mr. Alcorn - that's business. Mr. Keech - how many employees? Mr. Alcorn - over there I got as many as high as nine and ten in the winter time. Mr. Alcorn - I think drawing shows nine. Mr. Brellochs - I' m not familiar with how quickly one can slaughter, lets say cows. The operation as anticipated was about fifteen a week. The number of holding pens would allow. -you to increase that butchering total or what? Mr. Alcorn - we're trying to keep them separated. Mr. Brellochs - I realize that, but it you have nine hold tanks and it takes an hour each, the potentially, can butcher nine cows times five days a week, that's forty-five. Mr. Alcorn - you're beginning to get some ----- Mr. Brellochs - I understand that but some of the people asked how big is this operation potentially going to be. Within the original plan it could be larger than fifteen cows a week. Mr. Alcorn - if you've got the business. I don't anticipate it more than what I was doing in Moravia, that's all I have to go on. Mr. Brellochs - Say if business was great, would you handle forty cows a week in that facility as you plan it? Mr. Alcorn - couldn't. I takes one person approximately six to eight hours to cut up a 600 pound animal, package it and freeze it. I think everyone is a little bit off the track here, it's not just a slaughter house. Any experience in Moravia was that most of the meal already came in butchered. Someone had already killed it out on the farm. They brought it to me, we unloaded it and put it in the coolers, tagged it, cut it up. I operated over there for three years without a kill, maybe four years. Some folks have been over there, small operation. There's another one over there on top of the hill . ----- did more there cause he retailed meat. He bought and sold meat. I. Olds - you don't intend to do that. Mr. Alcorn - I don't intend to do that. I. Olds - you could change your mind. I won't get caught up in that kind of thing. -----just came over here, buy some ----animals every Monday, take back there, :slaughter them. Farmers brought in meat, slaughtered them. It was a much larger operation. More traffic. Mr. Keech - more question back there now. Residence - if anyone brought in a cow on Saturday to custome killed, she would be held over the weekend. Mr. Alcorn - no-, Mr. Olds. That's not even humane hardly to hold an animal. I. Olds - I worked in a place and that's way they did it. Mr. Alcorn - not suppose to. Olds - by Monday morning there was lot of racket around there. Mr. Alcorn - I've seen more general ----animals down around the countryside than ever happen in a slaughter house. Mr. Sutton - say, you put this 50 x 110 building, you're there for a year and a half and go out of business, what happens to building? If board restricts that to you only. Mr. Alcorn - I didn't know this myself. Mr. Sutton - you're apt to loose alot of money. Mr. Alcorn - I've done that before, Mr. Keech - how many people for this? Mr. Keech - How many against this? I. Decision: Three members voted yes and one voted no, variance granted with stipulation that building size to be 110' x 50' and set back 500' from road and that build- ing construction must start from one year of granting of variance, otherwise approval of variance lapse. Other stipulation be that building be 80' from his north boundary 1ne. Mr. Alcorn stated that all animals are inside building except when being unloaded. Also manure, blood and remains of animals are barrel- ed and taked away by truck each day. a Zoning Board of Appeals -13- August 5, 1980 Hearing #2 - Bernard Cornelius - Freeville, N.Y. A public hearing was conducted to consider the application of Mr. Cornelius for the excuvation and sale of aggregate materials at 395 Main Street, Etna, N.Y. Mr. Cornelius stated that he wanted to excuvate gravel from his farm. Stated that 2' of top soil over most areas, 1611 of clay and underneath gravel. The land is wet and hard to farm, without getting stuck with farm equipment. Diversion ditches are full of muck -and won't drain field. If can drain field, feels po- tential for farming. Mr. Keech stated if he is to mine what will he do with water. Mr. Robert Relyea, representing Cameo Gardens present owners of Allengrove Apartments and representing Robert and Ann Relyea as contract purchasers of Allengrove Apartments and acerage adjacent to it from Robert Lathrop, under contract. He stated two concerns: 1) Mr. Cornelius got a variance for use of property. He agreed to various conditions. Septic cleaner would not be parked so not obnocious to residence, opeations be carried on inside the building and storage of any manufactured material be on north side of the building. Since that time there is a junkyard, manure storage pile, permit to dump afluents from septic pumpings all over fields, used equipment sales center, retail sales center for steps and only one purpose granted. Mr. Cornelius stated in the winter time stores equipment inside so don't freeze up. Does not see how he could store every bit of his machinery. Mr. Keech stated not operating by zoning ordinance. Mr. Brellochs understood Mr. Cornelius's intent was to get gravel out to improve diversion ditches and allow to farm land. Why need a permit unless want to sell aggregate rather than improve farm land.. Mr. Cornelius said its nice to sell top soil and gravel but also work land. He dig ditches 4' - 5' deep and slope down, so water has place to go. Water table 16" below ground. Would probably dig four to five and make 60' wide, width of farm from railroad tracks to Fall Creek. Swampy area where he also wants to make a T so can drain. Mr. Relyea believes farm can be drained but should use a plan and help from Soil Conservation Department. Mr. Cornelius stated that Soil Conservation Service will not.sub- sidize any diversion ditch cleaning out that already exists. Be plans to clean ditches out, that are there. Possibly make one new one down to swamp so it will drain. As far as violation of 1976 variance, Mr. Keech stated Mr. Cornelius made the mistate that he could keep equipment inside. Mr. Cornelius should look at his business and if you think it will get larger, come in and ask for another variance. Decision: The board reserved decision until Mr. Cornelius can get a soil drainage plan from Soil Conservation Department. See something more specific.
