Paul Snyder, arising out of the denial of a building permit to place a double wide mobil home on his property at 2 Snyder Height6i a private street off Ellis Hollow Road, a. Public Hearing was duly held on May 1, 1979 with all ZBA members present, Mr. Snyder showed the Board and others present, pictures and brochures of the home he plans to buy. It will have con- ventional eaves and rake overhangs, asphalt strip shingles, aluminum siding, and is 28' wide and 52' long. It will be placed on a wall which the bottom of shall be a minimum of 4211 below finished grade. This wall shall enclose all four sides with vents and access panels as necessary. This wall may be either concrete block, poured concrete or pressure treated wood with exterior painted. The Board also considered the fact that this property has been in the Snyder family for many many years., and it has been Mr. Snyder's plan for some time to put his retirement home on this lotq which will be the last one to be developed without going through the Planning Board. Several neighbors came to urge the Board to grant the variance sought. Four members of the ZBA felt that the design, quality and size, and the fact that the home will be placed on a permanent foundation was enough to cause them to vote in favor of granting the variance. Stewart Hearing #1- Samuel and Peggy Brewer, 1304 Dryden Road A public hearing was held to consider the application of Samuel and Peggy Brewer for a variance to erect a building at 1384 Dryden Road to accomodate their business which at the present time is in their house at above address. Decision: A unanimous vote and variance granted. Hearing #2 Wayne Schutt, 151 Ferguson Road A public hearing was held to consider the application of 'Wayne Schutt to build a garage at the above address and is requesting a variance to Section 703 of Town Zoning Ordinance which requires that a building be at least 70' from the road center line. Mr. Rose stated, he received a phone call from Mr. Claude Dann voicing his support for the variance. Decision: Unanimous vote and variance granted. Hearing #3 - Paul Snyder, 2 Snyder Heights A public hearing was held to consider the application of Mr. Snyder, to place a doublewide mobile home on his property and is requesting a variance to Section 701 and 702 of Town Zoning Ordinance. Mr. Snyder presented a letter from Mr. Eberhart, a neighbor, supporting the variance. Mr. Warren Knapp of 1143 Ellis Hollow Road voiced concern over driveway and physical arrangements. Mr. and Mrs. Edward Swort, neighbors, also supported the variance. Decision:Four members voted yes and one no vote. The no vote of Mr. Brellochs, who stated he was basically against allowing,` homes in an RB1 zone. The variance was granted with following conditions: 1) Mobile home to be as pictured, peak roof, siding, meet HUD requirements etc. 2) Bottom of footing and foundation piers be minimum of 42" below finished grade and wall around perimeter. 3) Private road which Mr. Snyder maintains. He's owned property, himself since 1973, but property been family owned for years, 4) Actual size of house, 52' x 281. A public hearing was held to consider the application of Susan Morse to operate a gift and craft shop at 278 Lower Creek Road and is requesting a variance to Section 751 of the Town Zoning Ordinance. Decision: Variance granted with three zoning board members voting yes and one mem- ber voting no. Hearing #2 - 7:45 P. M. - John Clark, 74 South Knoll Drive, Dryden, N.Y. A public hearing was held to consider the application of John Clark to operate a retail clothing business in his home at above address and is requesting a variance to Section 701 of the Town Zoning Ordinance. Mr. Clark stated the house would remain the same. There would be a separate entrance in the back of the house with parking for no more than four cars. Residence from the area voiced their concern mainly with traffice increase, would like to keep development as residential only and setting a precedence.
