Roy McCartney, John Patterson, Mrs. Ora Smith, Margaret Rogers and Robert Rightmyer, all residents of Slaterville Rd. stated their opposition to granting variance. Reason being there is a very bad curve on tiie road where building is to be constructed. Also, they would like to keep the area strictly residential. Mrs. Eversdyke, neighbor, was present and also spoke for her hasband Claire Eversdyke in stating their opposition to granting, variance. DECISION: Denied Zoning Board of Appeals (2) June 6, 1973 Hearing #3 — Ormsby Dolph, 42 Quarry Rd., Ithaca, New York Mr. Dolph is seeking an application for a building permit to construct an indoor Tennis faci Lit,y (for profit) located at 42 Quarry ad. Stanley `lsapi.s Attorney, represented ter. Dolph who was also present. Mr. Dolph is president of Finger Lakes Stone Inc. Property is located in the Town of Dryden. The land is the former Cornell owned quarry. The courts will be located on 9 acres of Dolph odaned land. Robert B. Tallman, 603 First National Bank Bldg., Ithaca, New York is the Architect for this facility with Mutual Tennis Inc. of Westport, Conn. as consultants. Mr. Tallman stated he talked with the Health Dept. about drainage on the land in re3ard to a sr7tie system. The 6—court facility will include Oubhouse with locaer rooms, sauna, lounge area, viewing area, and an administrative office. There will be ample parking on site. The bgilding will be a steel structure, 40 feet high at its highest point. Setback from Quarry Rd. will be about 150 feet. Building will be approximately 1,800 feet back from Ellis Hollow Rd. and will not be visible from the roadway. The b0 lding will have radiant heat, fluorescent lighting, artificial ventilation and the latest in indoor tennis surfaces. John Kinsbury, Waterville Rd., Ithaca, New York asked Mr. Dolph what his plans were for the remaining land. Mr. Dolph replied any future plans will comply with zoning. Also, Mr. Kinsbury asked how much stone was lent in the Quarry, and if a Tennis facility would be successful in Ithaca. Ernie Bomborst talked aboit the traffic problem. York Mr. Brothefton is seeking a permit to build a house at 28 1 Mott Rd., Dryden, New York and requests a variance to See. 803 and 804 of the Town. Zoning Ordiance. Mr. L. Taylor Attorney of Cortland, New York represented d4r.- Bro-therton. Applicant stated foundction for house is on the property and ready for the double wide trailer. When originaily surveyed an error was made in number of feet required , f�undation being too close' to iotline.. Unit should be 15 feet from adjacenl, property lines. Levatich, D. Rose, R. Keech, E. Carpenter, K. Marquis. Public,Hearing - 7:30 p.m. Appeal made by the Village of Dryden on a proposed location of a "Welcome to Dryden" sign.. Mr. R. Watros and Mr. G. German explained the proposed sign location along Rt. 13 outside the West Village limits. Trees, the slope of the land and existing signs necessitate location about 200 feet outside the Village limits for required visibility of the sign. It must be close to the highway right-of-way for the same reason. Sketch and photos were submitted. Mr. German stated that he had checked the matter with the State Highway Department and that it had no objection. Decision: Granted; 5-0. Public Hearing - 7:50 p.m. Appeal made by Mr. Paul Whitted for a Building Permit to build a house on a lot along the south end of the former Whitted Road. Chairman Levatich made an opening statement announcing that the Town Board had, on 2/18/64 Town Board Meeting, accepted and adopted the N.Y.State Highway Department Inventory of Highways with the specific purpose of fixing the matter of the existent or non-existent(abandoned) Town highways. The lower end of Whitted Road is not,shown in that inventory and is therefore not a Town Road. Mr. Whitted requested that the following be inserted into the minutes: "My application for variance should not in any way be construed as agreement, tacit or otherwise, with Town Zoning Offices statements as to status of the road - Whitted Road." Mr. Whitted redrew his previously submitted sketch which had shown the proposed house located on top of the mobil home. Chairman Levatich stated repeatedly that the variance under consideration is for the specific purpose of building a house and it is an entirely separate matter from the illegal location of a mobil home, a matter now before the courts. Mr. Far-rol spoke for granting the variance and was concerned about Whitted Road not being a Town Road. Messrs. Paul Garcia and L. Garcia spoke against granting on the basis that Whitted Road was not a Town Raod. Messrs. Keech and Rose requested Mr. Whitted to restrain his language and use socially acceptable words during the Hearing. Applicant is seeking a por'FI-i-6 �O Odd a carport to her JIobile Home at #10 Freese Rd. Applicant presented a sketch plan of proposed carport. Ms. Darchargetto.stated reasons for constructing carport as having a cronic back condition. Constructioi of said carport will dismiss the problem of ha-vring to shovel the ,car out in the minter months. She also ntated there is no other place for the carport. Applicant has lived at #10 Freese Rd. since 1964, purchasing a new Mobile. Home since that time. New Mobile Howe is same distance from road as prior Home .
