HomeMy WebLinkAbout1971 ZBA MeetingsDRYDEN ZONING BOARD OF APPEALS MAY 4, 1971 PUBLIC HEARING Arthur Anderson, 22 Dutcher Road, Dryden, New York Mr. Anderson requested a variance to build a pole barn, 105' x 401, on his property. The front of the building would be 30 ft. from the center of the road. The reason for building so close to the road being the new building would act as a wind break in the winter and would keep the snow from drifting across the road and also prevent drifts of snow from accumulating in front of the new barn to the road. Anna and Wayne Drake, neighbors of Mr. Anderson, were present at the hearing and were in favor of the erection of this building. They stated that the snow drifts very badly in this spot and the proposed building would eliminate this to a large degree. There were no objections to the proposed construction of a pole barn. Mrs. Clara Snyder, 8 Pinckney Rd. R.D. Ithaca, New York Mrs. Snyder requested permission to move a house, now owned by N.Y.S. Electric and Gas but to be purchased by Mrs. Snyder., from present location to her property which is acrossed the road. Mrs. Snyder wishes to make this house into apartments to supplement her present income. The location to which the house will be moved meets all requirements of the Ordinance. There were no objections to the proposed move. Dryden Zoning Board of Appeals Public Hearing Mr. Roy Draper Hearing #1 May 11, 1971 7:30 p.m. Request for variance to build an Egg Processing Plant on Walker Rd. in the town of Dryden. This land now belongs to Roy Draper. If this site is approved and variance is granted, the land would belong to Draper Egg Processing. Mr. Draper presented plans to the Zoning Board for construction of a 160' x 75' building and also included specifications for a lagoon type of sewer system, approximately 1 acre in size, which would meet all State, County and Federal Health requirements. A refuse truck, garaged inside the plant would carry the egg shells (the only by-product) to the dump. When questioned about the possibility of building within the Industrial Zone, Mr. Draper pointed out that this would be in a location near the Electric and Gas and the drainage is very poor in that area. The cost of land would also make this prohibitive. Mr. Draper's present location in the Village was condemned. by the government because the building did not meet their structure requirements. This building must be closed by July 1, 1971. Mr. Roy Draper Hearing #2 A second location for a new Egg Processing Plant on Rte 38, near the Dryden High School was presented to the Zoning Board for consideration. This is Mr. Draper's preferred location. This site is bordered by the High School, Mott Rd. and Dryden Enterprises. If a variance was granted for this site, the sewer system would include large steel tanks, underground, that would drain into a huge leach field. If the gound should become too saturated to hold the drainage, it would run into the creek. However there would be no pollution since all waste would be chemically treated -to meet County, State and Federal requirements. Mrs. Genevieve Sopp, operator of Tastee Treat, questioned the drainage of this property, since she has had problems with drainage at her nearby location. No objections. Mr. Dale Wallenbeck, represented the Dryden School Board. no objections. Mr. Clyde Cotterill, represented Dryden Enterprises. No objections. The Zoning Board unanimously voted to grant a variance for either the first or second location. Page 2 Mr. John Yarosh, neighbor, stated that Mr. Farman was informed that a building permit was needed to build these buildings and that he was informed that he was in violation of the footage requirements. He also objected because the new building was so located that it was a traffic hazzard. Darryl Van Camp, neighbor,'is in the process of selling his property. Buyers hesitate to consider purchasing his home because they are concerned about the area becoming commercialized. Mr. and Mrs. Perko questioned Mr. Furman's statement that he did not know it was necessary to obtain a building permit, since he is a Master Plumber by Made and deals with this sort of thing. Joyce Stout, neighbor across the street, stated that local busses can not pick up the children in that immediate area because of the safety hazzard caused by the "bubble". Unanimously denied 4th Hearing - 8:30 pm Mr. Leslie Kimmich - Harford Rd. Mr. Kimmich requested a variance to build an addition to his present barn that would be located 65' from the center of the road. There was no objections from neighbors or interested parties. Unanimously granted. DRYDEN ZONING BOARD OF APPEALS JUNE 1, 1971 PUBLIC HEARING 7:30 pm lst Hearing - 7:30 pm Mr. Sheldon Wilbur 36 Etna Rd. Mr. Sheldon requested a variance to build an in -the -ground swimming pool in his back yard, six feet from the back lot line. Mr. Sheldon stated that if the pool was built closer to the house, it would be shaded by the house and would be situated too close to the house. If built closer to the side lot line, it would interfer with water line from his pump house to the residence. There was no objections from neighbors or interested parties. Decision -unanimously granted 2nd Hearing - 7:50 pm Mrs. Ruth Bailor - Pinckney Rd. Mrs. Bailor requested a variance to build a garage 34' from the center of the road. This would be the only possible location, since there is a steep bank on one side of the property and house is on the other side. The proposed garage would located to the front of the property with the house located to the rear. Mr. Duane Hurlbutt, neighbor and contlactor-builder, stated he thought the proposed garage would sit on top of the present gas line. He also commented that the proposed building, sitting to the front of Mrs. Bailor's property would not add to the value of her property or to the value of his housing development. Decision -unanimously denied 3rd Hearing - 8:10 pm Mr. DeForest Furman - Plain St. Ithaca Mr. Furman requested a variance to build a dome -like building on his property located on Rte. 79, Slaterville Rd. This property is located in the RB Zone, not adaptable to commercial display. The building is situated 58' from the center of the road. Mr. Furman stated that he is presently a plumber by trade and is under doctor's orders not to lift more than 3 pound;i. For this reason he is trying to phase out of the plumbing business and build ;a busjaess;suitable too his health. No objections were heard and/or received by the board, Decision: Unanimously granted. e Dryden Zoning board of Appeals Sept. 7, 1971 Public Hearing Hearing — 7:30 P.M. Bernard Cornelius — Ringwood Ud. R.D.#2y Freeville, New York Applicant Bernard Cornelius attedded Hearing along with the Zoning Officer Sibley Stewart and three Zoning Board members Donald Rose, Ed Carpenter and Kermit Marquis. Mr. Donald Rose, Zoning Board member, conducted the meeting in the absence of Chairman Peter Levatich. Mr. Robert Keech was also absent. Applicant requested a variance on his property located at R.D.#2, Freeville, New York. Attorney Walter Wiggins spoke for Mr. Cornelius. He stated their were basically two concerns. Number I — A request that the square footage of the lot in circular road be less than the required 30p000 square feet. Subdivision in question was originally laid out before Zoning Ondiance went into effect. First house being built when it was in -tended to have four (4) lots. Second house was constructed in the belief that Mr. Cornelius had a permit, which he did not. He now wants permission to finish this second house which is half constructed. Number 2 — Land which he owns with access on the highway lacks a triangular piece in order to make a full fifty (50) foot right of way. Mr. Cornelius has attempted to purchase the additional land required, but has not been successful in doing so. Drainage for the above iond has been approved by the Health Department which stated drainage was very good for this particular area. Lois Gosaq, a neighbor, asked that this subdivision'be explained. Originally Mr. Cornelius had four (4) lots planned, and went ahead with the construction of the second bviilding to be put into four (4) lots. He is asking instead of the four (4) lots to reduce this area to three (3) lots, each one being about 24,000 square feet. Page A...k.�. 79 1971 He needs to bny the strip of property in order to have a total fifty (50) foot right of way. Vr. Cornelius stated this is not a hard— ship case. A question was rai:7ed about the width of the road. The Board stated they are just concerned with lot size and not the road. That is an entirely separate problem. Lois Cosse opposed variance. Air. Tim Saltonstall, present, also speaking for Floyd Everhart (unable to attend Hearing) spoke in opposition of granting a variance, stating that the Zoning; Ordiance should maintain its predetermined footage. He also mentioned the fact that when his father was alive he had worked so hard for the Qrdiance, to insure there itiould not be many houses built in the area as the land is so beautiful. Mr. Saltonstall also stated there would be a problem of pollution in reference to the septic system. Patrick Tan, present, also stated his opposition for same reasons as Air. Saltonstall. There were no other objections or comments. Public Hearing closed and was followed by a discussion by the members of the Board of Appeals. DECISION: Pending In reference to Mr. Saltonstall's statement concerning pollution, the Board said there would be no such problem, as the drainage is very good. The Board decided to wait for Chairman Levatich and member Robert Keech to return from vacation etc, to reach a decision. also, Ed Carpenter made a motion that all the Board members meet as soon as possible and take a drive up to Wir. Cornelius's property before making a final decision. Kermit Marquis seconded the motion. Dryden Zoning Board I'> of Appeals Public hearing October 5, 1971 Present: Chairman; Peter Levatich Kermit Marquis Donald Rose Ed Carpenter Robert Keech Sibley Stewart, (Zoning Officer) Chairman Levatich opened the meeting at 7:30 P.M. Hearing 7:30 P.M. Robin V. Williams, 110 Baker Hill Rd., Freeville, New York. Mr. Williams requested a varience to build a garage on his property. Garage in qnestion would violate 70—foot setback of Zoning Ordiance. Applicant stated the reason for a garage is the weather element. Mr. Williams presented photographs of his house to the Board in reference to the snow problem. Length of present driveway is also a problem. Applicant also stated he is away from home for a. few days every tvo or three weeks, and it is somewhat of a hardship on his wife as to the shoveling of the snow. A snow fence was tried, brit to no avail. If garage is b�iilt even with ho,ise, it will block fo-ir windows. Proposed b,iilding will stand twelve (12) feet away from house. Applicant answered va.rio,is questions of Board Members regarding his property. The Board deliberated and did not find s,ifficient hardship in this case to grant a variance. DECTSTON: TTnanimously denied. Hearing — 7:50 P.M. White Advertising, Victor, New York MattheW Yob, Advertising represeiitative for Holiday Inn, is requesting a variance to p,it yip a, billboard on Pine Tree Farm, North of Dryden on Rt. 13. The sign is to back another on same site. The sign will not be V-shaped, as originally planned. The poles will be arranged so that ,a new sign will be on bec[,, of the existing sign. Proposed sign will tea Yhave lights, and will be illuminated on both sides. The present set— back is forty—two (42) feet. The new ordiance requires sign will have to be moved to sixty—three (63) feet from center ut road. Sign will be perpendic,ilar to road and can be seen from either direction. Also, it will be six (6) feet off the Yro,ind. PFCISTON: It was decided the appeal sho,ild be reviewed. A list of objections sho,ild be compiled. Involved is a strict sign ordiance and this sho,ild be given to the Planning Board, and let them clarify same. Mr. Yob was granted the variance to exceed.the fifteen (15) feet in height and allowed the sign to be relocated. The Board is granting three (3) feet variance in height. The sign is not to exceed twelve k12) inches in total thickness. OTHER BITSTNES3: Disc,ission of Bailor request. Mrs. Rath Bailor of Pinckey Rd. is requesting; a variance to build a para.ge thirty—fo,ir (34) feet from center of road on her property. The Board denied first appeal in the absence of undue hardship. Proposed garage wo,ild be located to the front of the property with the house located to the rear. James Cirona, president of Ithaca Savings Eind Loan requests a voriarce to erect a sign at 120 North Street, Dryden, N.Y. Applicant presented the board with a graphic illustration of the proposed sign. The si-gn in question will be a. Time and Temperature sign, and will be four (4) feet off the ground and approximately twenty-two (22) feet in height. Vr. Cirona stated the reason for the twenty-two (22) feet in height is primarily to blend with the building. If the sign is too low it will red,ice visibility from the North. He also presented a preliminary i /Plot plan, showing the location, and size of proposed r Nfod,ilar structure. Mr. Wright stated this has been an existing gravel bank b,it has not been us ed for some time.
