HomeMy WebLinkAbout2012-06-05 TOWN OF DRYUFN Zoning Board of Appeals .Tune 5 , 2012 Members Present: Mark Maybury, Acting- Chair, Deborah Shigley, Nelson Flogg • Absent : Thomas Quinn , Flint Brinnn Others Present: David Sprout, Code Enforcement; Joy foster, Recording Secretary Applicants : Timothy Frost Town Residents : Bruno Schickel , Brian Magee Meeting celled to order at 7 : 36PM , Agenda * Timothy Frost, Area Variance 1174 Harford-Slaterville Road Timothy Frost, Area Variance : Chair Maybury reads the public notice : PLEASE TAKE NOTICE that the Zoning Board of Appeals for the Town of Dryden • will hold a Public Hearing to consider the application of Timothy Frost who is requesting an Area Variance for relief of Dryden Zoning Ordinance Sections 804 . 1 and 804. 2 corner lot setback and rear yard setback; to enlarge existing garage at 1174 Harford-Slaterville Road iSAID HEARING will be held on Tuesday June 5 , 2012 , at 7: 30 PM prevailing time at the Dryden Town Hall , 93 East Main St. Dryden NY , at which time all interested persons will be given an opportunity to be heard . Individuals with visual , hearing or manual impairments and requiring assistance should contact the Town of Dryden at 607- 844 - 8888 x 2 .16 at least 48 hours prior to the time; of the public hearing. Frost wants to do. • Sprout : County Planning replied and they have no issues with this. 1-logo : curious, the existing building is not set bock far enough, is that because it was put tip be ore zoning? IN CONSIDERING WHETHER AN UNDESIRABLE CHANGE WOULD BE PRODUCED IN THE CHARACTER OF THE NEIGHBORHOOD OR DETRIMENT TO NEARBY PROPERTIES WILL BE CREATED BY GRANTING OF THE AREA VARIANCE THE ZONING BOARD OF APPEALS FINDS AS FOLLOWS: Granting; of the variance will improve the neighborhood by permitting the storage of material that is currently outside, and the neighbors are to favor. Motion made by : Nelson liogg ® Second : Mark Maybitry All in favor Be IN CONSIDERING WHETHER THE BENEFITS SOUGHT BY THE APPLICANT CAN BE ® ACHIEVED BY SOME OTHER METHOD, FEASIBLE FOR THE APPLICANT TO PURSUE, OTHER THAN AN AREA VARIANCE, THE ZONING BOARD OF APPEALS FINDS AS FOLLOWS : It ►could be possible to build a separate structure conforming to zoning but it ivould be an inefficient use of the property caul only add to the clutter. THE ZONING BOARD OF APPEALS FINDS AS FOLLOWS: Yes Motion made by : Shigley Second : Hogg All in favor • D. IN CONSIDERING WHETHER THE PROPOSED VARIANCE WALL HAVE AN ADVERSE EFFECT OR IMPACT ON THE PHYSICAL OR ENVIRONMENTAL CONDITIONS IN THE NEIGHBORHOOD OR DISTRICT. THE ZONING BOARD OF APPEALS FINDS AS FOLLOWS: • ad adverse effects, this will improve the area and both neighbors shoii6 support for the additions.
