Area Variance for 350 Hurd Road
Quinn : Reads the Public Notice
' PLEASE TAKE NOTICE that the Zoning Board of AR peals of the Town of Dryden will hold
a Public Hearing to consider the application of Arthur Rawlings
who is requesting to construct a 600s_q, ft. lean-to addition to an existing garage at 350
Hurd Road. He is seeking relief of required 70 foot setback his proposed addition
' measures 56 feet.
SAID HEARING will be held on Tue . Oct. 4, 2011 at 7: 30 PM prevailing time at the Dryden
Town Hall, 93 East Main St. Dryden NY, at which time all interested persons will be given an
opportunity to be heard .
Individuals with visual, hearing or manual impairments and requiring assistance should
contact the Town of Dryden at 607-844-8888 x 216 at least 48 hours prior to the time of the
public hearing.

Applicant: no
Quinn: to Dave Sprout have we heard from any neighbors or interested parties?
Dave Sprout: Received 2 phone calls just curiosity to the variance, no concerns.
Quinn: to board anything you would like to ask applicant?
Deb Shigley : You note that the placement of the new carport will hide, trailers and equipment that is currently
visibly from the roag how will that happen?

• Applicant: The road is above 10 to 15 jeet above ground level, so with the carport over the top the line ofsite will
actually be the roof.
Quinn to applicant: You are putting the learn-to on the other side of(he garage causing the need for this variance
• wondering why you don 't put it on the back?
Applicant: the turning radios to put the trailers back there and to turn around is not feasible.
Quinn: we will close this part of the public hearing and ,get a sense of the board.
Board: ready to answer the 5 questions and to move on.
Quinn: I would also like to haue the record reflect that we do not have legal counsel here , most
often we have legal counsel to make sure our findings are property stated for the protection of
both us and the applicant should an issue ever come up in the future.
Board : will address the Area Variance Questions A-E
A. IN CONSIDERING WHETHER AN UNDESIRABLE CHANGE WOULD BE PRODUCED IN THE
CHARACTER OF THE NEIGHBORHOOD OR DETRIMENT TO NEARBY PROPERTIES WILL BE
CREATED BY GRANTING OF THE AREA VARIANCE THE ZONING BOARD OF APPEALS FINDS
AS FOLLOWS:

8. IN CONSIDERING WHETHER THE BENEFITS BOUGHT BY THE APPLICANT CAN BE ACHIEVED
BY SOME OTHER METHOD, FEASIBLE FOR THE APPLICANT TO PURSUE, OTHER THAN AN
AREA VARIANCE, THE ZONING BOARD OF APPEALS FINDS AS FOLLOWS:

ACTION UNDER SEQR SECTION (Type 11 Activity) NYCRR Section 617.5 - c 12
This appeal is not subject to 239 L& M General Municipal Review.
® Magbury makes a motion that we grant the area variance for the lean-to to have a 55 feet setback instead of
required 70 feet. With no conditions.
