TOWN OF DRYDEN
TOWN BOARD MEETING
October 8, 2015

The meeting was called to order at 7:20 p.m. following a budget workshop.
A budget workshop will be held October 13, 2015 at 5:30 p.m. A public hearing on the
preliminary budget, after it has been prepared, will be held October 28 at 7:00 p.m. Cl Lavine
would like the tax rate held below a ten percent increase.
RESOLUTION #149 (2015) – APPROVE ABSTRACT #10
Supv Sumner offered the following resolution and asked for its adoption:
RESOLVED, that this Town Board hereby approves Abstract #10, as audited, general
vouchers #76 through #850 (434,207.99) and TA vouchers #54 and #55 ($3,370.92), totaling
$437,578.91.

RESOLUTION #150 (2015) – APPROVE BUDGET MODIFICATION
Supv Sumner offered the following resolution and asked for its adoption:
RESOLVED, that this Town Board hereby approves the following budget modification:
The amount of $90.00 from A1110.4 (court contractual) to A1110.2 (court equipment).

Response to Comptroller on Road Management Plan – Cl Leifer and the Highway
Superintendent Rick Young are composing a letter. R Young has decided to use the Cornell

Local Roads Pavement Management System. After input of maintenance and cost data the
program will plot out what needs to be done on a yearly basis and the expense. An intern from
the Cornell Local Roads Program will help with road inventory and to help the highway
secretary enter data. Supv Sumner would like a draft of the response by the December
abstract meeting.
Petition to exempt Senior Court Clerk – J Case has provided Civil Service with what
they needed with the exception of justification. She provided Judge Clauson with a copy of the
request. She doesn’t know if he has responded and will to follow up with him.
Policy for use of HWY and DPW reserves – Supv Sumner will draft for November.
Personnel memo to Dept heads for comp time – Cl Leifer has been working on this
and it should be ready next week.
Comp Plan review – Supv Sumner has not yet drafted a response to the Planning
Board resolution received by the Town Board. She will have that ready in November.
1401 Dryden Road, Storage Squad – Applicant will be at next week’s meeting. They
still need a stormwater plan and are probably about a month away from getting it to TG Miller
for review. They are committed to doing whatever it takes. The stormwater plan is important
because they are covering more than half of the five acres with impervious surface. County
review of this project is expected tomorrow. R Burger anticipates they will be concerned with
buffering (50’) for the stream and may address design guidelines for Route 13. The board could
grant approval conditioned on receipt of a stormwater plan approved by the town engineer.
The matter is ready for SEQR review and final site plan review.
902 Dryden Road, Townhouses – Applicants would like to get a permit to start the
first building. County review has not yet been received, but R Burger noted they are dubious
about the flood plain and requesting more data. Obstacles are protection of flood plain, density
and traffic. The density is allowed under current zoning. Supv Sumner and R Burger met with
the applicants and urged them to talk with the Highway Superintendent about getting a traffic
count on Forest Home Drive. R Burger said they are confident they are out of the flood plain,
but getting FEMA to weigh in is likely months away. There is LIDAR data that may be
contradictory, but R Burger doesn’t know how to interpret it. The TG Miller survey shows the
project is out of the flood plain and that might be the most accurate data available. Supv
Sumner suggested it could be approved pending flood plain determination.
Cl Lavine said there were a lot of concerns brought up at the Varna meeting and we
should slow down. It was noted that the Town can take action because County has gone past
the thirty days for review. The plans for a buffer between the project and the Plantation
property seem to be acceptable. Cl Lavine will not give provisional approval. It was stated that
open space protection has been addressed and traffic can be addressed. Cl Lavine feels safety
on the road is a concern.
There is a question about whether interpretation of the comp plan is about form based
zoning. Supv Sumner said we are working with what we have on paper which clearly allows
that density on that site.
There was a discussion about form based zoning and the comp plan. Supv Sumner
asked the board to read about form based zoning before next week. Cl Leifer sent the board
some information. R Burger said that the zoning and the comp plan should be in sync, and
there are court cases that indicate the most recently adopted document is in primacy.

R Burger said the applicants need some guidance in moving forward. They are trying
to be accommodating with respect to parking and not constructing all the spaces planned for
initially. They want to provide alternative transportation for tenants and options are being
investigated.
The board did hear comments about sewage flooding in that area during previous
storms and a landfill on this site. There were questions about the age of the sewage
infrastructure and capacity. Someone will ask the town engineer about capacity.
There being no further business, on motion made, seconded and unanimously carried,
the meeting was adjourned at 8:35 p.m.
