APPEAL To The Town of Dryden Zoning Board of Appeals

Four Family Apartment House In R-B- 1 Zone
Introduction
The intent and purpose of the R-B� l Zone District
Regulations are to preserve the quality and appearance of low
density reaidentIFU area compatible. with farm use . This is are
application for a land use variance based on the grounds . of
unnecessary hardship . The appliepmt desires to develop the
property for a un a not presently permitted by the zoning
ordinance .
We will show that the applicant ' s plan for use of the land
in question is compatible with existing development in the area
where public sewer an4 water facilities are unlikely to develop
in the near future .
The applicant , Gary L . Dade , desires to maintain the spirit
Of Section 750 and 751 of the " Selected OrdInances and Local Laws
of the Town of Dryden 19881' however , he will adequately show the
need for a variance of 'theme regulations used - on unnecessary
hardship clue to :
A . Uniquen" s of the land ;
B . Inability to realize a reasonable rate of return ;
and Ca The requested modification will not change the
character or quality of the neighborhood .
• A . UNIQUENESS OF THE LAND
There are certain features and conditions of the land that
are not generally applicable throughout the zone . These features
include a ) openness of the land , • a scarcity of shrubbery and
trees not characteristic of other areas in the R-B-1 Zone area ,
b) the direct proximity of the old Caswell Dump being 1/2 mile
from the subject premises , and c ) the tentative location of DR7
to the south of the subject premises (directly behind the land ) .
It should be noted that there is not much farming in this area as
it is not an agricultural district .
a . The lot in question was purchased with 'one intention : to
develop rental units at a reasonable cost for a reasonable rate
of return on the land . The present value of the real property
has actually not risen as expected due to the unanticipated
zoning changes which do not permit such intended development
unless this variance is granted . The scarcity of trees and
shrubbery only serves to decrease the attractiveness of this lot
to someone interested in purchasing it for their own development
purposes . Current market values are demonstrated by annexed
Schedules Al and A2 . The lot has been initially developed in
anticipation of building the 4 unit home , applicant over $2600 . 00
to date.
b . The location of the Old Caswell Dump within one half
mile of the subject premises has caused a higher than normal
amount of truck traffic and related activity due to the trucking
of refuse from the old dung site seven days a week .
c . With the anticipated location of DR7 to the south behind
the subject premises , there is additional (and more expected in
the future ) heavy truck traffic down 11. Dryden Road turning south
onto Caswell Road . This too has limited the resale value as this
lot is not desireable for single family residential development ,
or for families or children . Renters tend to not be as concerned .
about these things as they tend to be shorter term residents . As
you can see from the map annexed hereto as Schedale A3 , not all
the neighborhood of this R-B-1 district is faced with this
problem , but only the subject premises and the vacant lots on the
immediate southeast corner of W. Dryden and Caswell Roads .
undeveloped lots do not benefit from municipal conpensation for
any possible loss due to DR7 .
These are clearly certain features and conditions of the
subject premises that are not generally applicable throughout the
zone , and the foregoing conditions make it impossible to earn a
reasonable rate of return without some adjustment , as further
outlined in the next section of this appeal . The uniqueness of
the subject premises has created an unnecessary hardship .
B . NO RRASO BLE RATE OF RETURN
On the following pages you will find the research the
applicant has done to discern the conparisms of building two
duplex units as per cods allowances , as opposed to the
construction of one four unit dwelling as originally planned .
The increase in actual coats is apparent from the pages annexed
hereto as Schedules Bl , B2 , and B3 .
The average increase of cost to build two du pl " units Is
$441- 179 . 90 .
The costs of a new survey and subdivIsicn for duplex
acccmmodations is also attached hereto as Schedule Sl and S2 , and
are estimates from local surveyors . These show a clear harcbhip ,
with an average of additional costs of $ 700 . 00 as follows :
average cost of survey $ 310 . 00
average subdivisian costs = 175 . 00 + 100 . 00
average additional health dept costs - 115 . 00 .
Name of these costs will be incurred if the use requested in
this application is permitted . Annexed Schedule B5 and B& show
the proposed development plan for the subject premises .
Based on local rental valtaes , the . rents anticipated to be
collected on each unit of the four unit dwelling will be 50GA0
per month each , plus utilities paid by the tenant. The rents
expected to be collected art each duplex unit will b�! $ 425 450
per month per unit , plus utilities . Thus , the rate of return an
the 2 duplex units will be much less and take much more time to
be realized in light of the greatly increased costs factors, and
less income per unit . Two duplexes are clearly unrealistic for
the applicant to realize a reasonable rate of return . The facts
shown that the applicant is left with the inability to realize a
reasonable rate of return under any of the uses permitted by the
zoning ordinance , ,artless an adjustment is made . This is clearly
unnecessary hardship ,
C . - REQUESTED MODIFICATIM WILL, NCI' CHANM THE CHARACTER OR
QUALITY OF THE NEIGHaOR OOD
The neighborhood surrounding the subject preanises can be
seen on annexed Schedule N . The character of this neighborhood
is one of quiet country living . TWO doors east frcm the subject
premises down west Dryden Road , the R-C Zone begins , TAbich allows
for dwellings wider Section 801 . Three Moors to the west of the
subject premises up West Dryden Road' there is already located a
five family apartment house. Characteristics of residents are
that of single people , elderly individuals and young couples .
They maintain quiet residences , as will be common to the _ prcposed
four unit dwelling applied for heroin . The four unit dwelling
will fit in nicely with this neighborhood , not changirrg the
character or quality of the neighborhood in any way. Not.
allowing the construction of this four unit dwelling will produce
unnecessary hardship .
CO[ LUS ICN
Unnecessary hardship in the actual dollar amount of a
$44t679AO increase is created by the unanticipated zoning
change , and the other factors previously detailed .
This unnecessary hardship was not created by the applicant ,
but has been created by not b! fincg able to develop the land freely
within the spirit of Section 751 of the Thwn of Dryden Zoning
Ordinances . The applicant and ' his faraily have lived in the 7bwn
of Dryden for aver a decade and are goad citizens of the Town .
The proposed construction will add to the Town tax roll in a
location where and at a time when construction is not soarzng .
The applicant cannot afford the hardship created by duplex
buildi.rigr but will need to let the land remain u6dev loped if not
granted this variance as requested , He will be forced tb suffer
further unnecessary loss .

laws of the 'Ibwn of Darden .

preservation of 30 " Elm , Conifer Grove is perhaps unique in the Town . . Compliance
with required area would modify existing drainage pattern and vehicular pressure
on soils . Parking and access proposed has been designed to minimize intrusions
on existing mature root systems . A similar business in the Town , The Phoenix
Bookstore , . 6 spaces appear sufficient . Both churches and other businesses in Town

long access drive ( nearly 300 ' ) to my business location . I am able to provide
spaces to accommodate the required number of cars on site . The construction
cost of my access drive and 6 proposed spaces nearly equals the area required
by Ordinance for parking . The City of Ithaca has recently reduced the parking
areas required per car from 1800 sf . to 1600 sf . I am a new business in Town
and have had a greater construction period than anticipated . The access drive
cost in area will be equal to that of the required parking area ..
