The Zoning Board of Appeals meeting of February 7 , 1992 was conducted by Chairman Francis DiTommaso . The Hearing to operate a commercial automobile body shop at 384 Yellow Barn Road , in the Town of Dryden in vxolatipii of Section 751 , allowed uses by Applicant Scott Conover was opened at 7 : 45 PM . The Chairman read the two pages of the application submitted by Scott Conover and made a part of the record . Questions from the Board revealed : • a P Clarification of the m ' which was submitted with the . . • application was explAined 6y ' Scott Conover as the road frontage is on Yellow Barn Road and the driveway entrance is off Ringwood Road . The drive currently being used is 1500 feet long . The drive is gravel and is maintained by the owner . The current buildings on the land are an existing home and a garage . The land has been owned for two years . The house and garage was build last summer . When Yellow Barn Road is finished the driveway will enter on Yellow Barn Road . Chairman DiTommaso requested from Henry Slater the necessity of the letter which appears in the Conover file . Henry Slater : The Town has a new policy since the first of the year that before anything can go before any of the Boards , the Supervisor , the Town Attorney and a designated engineer shall have the opportunity to review all applications and comment on the appropriateness of that application , whether it should be heard or not by the Zoning Ordinance its self as a guidelines or by the subdivision section of the ordinance in terms of the Planning Boards activities ; or the Town Board activities in ® terms of other special treated permits . Mr . Conover applied for a special permit which is permitted in an RC Zone by a special permit review by the Town Board . I had a question at that time what zone his property was in , three zones met in the middle of his property which he wasn ' t aware of . If he had applied for the permit on the section of property by Yellow Barn Road he would have been in the RC Zone . It ' s not the ownership of property but where the location of the building will be . At that time I decided it would be most appropriate for our Office to determine the exact location with respect to the Zoning Districts . After much calculation and site visits the personal from our office determined where the sites were , at that point I made sure the Town Supervisor , Attorney and Engineer had no reason to discount that assessment . Alan LaMotte asked if the policy effective January 1 , meant that the Supervisor , Town Attorney and Engineer would determine the appropriateness of a request , such as this , coming before this Board ? Henry Slater stated from the standpoint of legalities with the Town Attorney ; from the stand point of any engineering related aspects of an application whether it might be an environmental concern , hazard , etc . I and the Supervisor wants to be made Aware of anything that goes on relative to the function of this ® office . Alan LaMotte asked if a citizen could be denied the opportunity to be heard and request a variance simply because one of those individuals deemed it inappropriate ? Henry Slater : It would have to be found inappropriate under the legal aspects of the application and in that case it would be up to the Town Attorney to answer any challenges and defend the Town . QUESTIONS FROM THE BOARD CONTINUE : Ann Everett asked how the people would get to the garage in the winter- over Ringwood Road , and then having to negotiate a 1500 foot drive . S . Conover stated that his wife drives a two wheel vehicle with no problem and they keep the drive scraped down . Henry Slater answered the Boards question concerning the frontage on Yellow Barn Road : Yellow Barn Road became a seasonal use road several years ago and the Town doesn ' t plow it in the winter months . The Town has undertaken a project to make that a regular road . They started at the North end of it where it previously ended and have it ruffed out up to the top . There are two houses now and a third under construction where the legal road frontage is on Yellow Barn Road . Mr . Conover was in a better situation because he has access off Ringwood Road on a temporary bases , if he hadn ' t I would never have given him a ® certificate of occupancy . Mr . Bordonaro asked if his problem wasn ' t temporary until the project on Yellow Barn Road was finished ? Henry Slater : Not unless he wants to move his business into the RC Zone . Facts : Mr . Conover obtained a permit for a two car garage and wished to convert / complete the structure for a business . Mr . Conover is not actively engaged in auto repair at this location . Mr . Conover would need to complete the drive from Yellow Barn Road after the road is completed as that is his legal address . Mr . Bordonaro understood his concern for security with having the business next to the home but questioned the validity as every business can ' t be located next to a residence . HEARING OPEN TO THE PUBLIC Lloyd Mix stated that Scott was applying for , the variance due to a problem that doesn ' t apply everywhere : Very few homeowner ' s run into three zones crossing their property which consists of ten acres . It ' s not the type of business where cars would be coming and going every day ; it is secluded from the road ; it would be a part time business . Scott stated he would not have an inspection station but a registered repair shop and the sign would be posted on the outside of the building . Randy Lacey wished to know if a permit were issued for a specific use what prevents that from changing ? It ' s one thing to have a part time business , and if the business is sold and someone wants to enlarge it what happens ? He is not opposed to granting the variance to Scott but is concerned about the future . Clint Cotterill stated that once a variance is granted it ' s there for life . Brian Mix stated that Scott does the repair and painting on the Mix Brothers Trucks and friends and family come in and want Scott to work on their vehicles , the business would rather have Scott have a business where he can repair- these vehicles and they wouldn ' t have to be concerned with the issue of insurance . ® Scott stated if the variance is denied he would probably have to wait until Yellow Barn Road is completed . The site being within an RBI Zoning District , ' Commercial Garages are not among the listed Section 751 Allowed Uses and is requesting a variance of the Dryden Town Zoning Ordinance . A public hearing was duly conducted by the Town of Dryden Board of Zoning Appeals on Tuesday , April 7 , 1992 with members • presente Chairman Francis DiTommaso , Dominic Bordonaro , • Alan LaMotte , Joseph Jay and Ann Everett . FINDINGS . 1 . Although the Zoning lines crossing the property is a unique situation and the location of the garage as proposed vs . along Yellow Barn Road will not alter the character of the neighborhood the applicant has not shown that the property cannot yield a ® reasonable return without the variance .
