The Zoning Hoard of Appeals meeting was called to order on
Tuesday , April 2 , 1991 at 7 : 3E PM by Chairman John Raker .
The first variance was heard as follows :
LoPinto and Sons Construction is here having been denied
permission to erect a Double wide Mobile Home without the Town
required Double - wide skirting wall at 349 Sheldon Road ,
Freeville , New York in violation of Article 1000 , Section 309 of
the Town of Dryden Zoning .
Under- Practical Difficulties and / or Unnecessary Hardships are as
follows : We find that installing a skirting wall is impractical
and in lieu of it we will install additional stone base and also
® provide a footing type of drainage . It would also be cost
affective beyond proportion . Along with this a factory skirting
will be installed to below grade . Attached is a copy of the
proposed Tier and Block plan . Skirting is to be attached when
the project is completed .
QUESTIONS FROM THE BOARD
J . Baker : n . Do you have any dollar and cents value of
what a frost wall would cost , if you did
have to go that route ?
S . Day : A . I am actually doing the site preparation for
Joe and we haven ' t broken it down to dollar
and cents . This is more practical to put in
the footer- drain which is going to do more
good , and would be done regardless . That is
going to do more good for frost prevention
then the frost wall itself would . To add
the frost wall after the footer drain would
be cost effective .
J . Baker : 00 Do you have a description of the skirting ?
A . It ' s a manufactured vinyl type skirting that
® you have over the siding of the Mobile Home .

A . If you put in the skirting according to
code , you would be down 36 inches . Footer
drains which we are proving in lieu of the
skirting wall are at least that so we ' re
getting protection from the frost by
installing the footer drain and eliminating
the wall .
Q . I ' m still unclear . Do you bury the skirting
a foot or two down below . . . ?
A . No , not ordinarily .

® A . You remove all top soil , then trench the
footer drains in below the land elevations

( corrugated black plastic ) .
D . Bordonaro : am Will this go down far enough so that it will
keep vermin from borrowing in underneath ?
A . The whole pad is stone , there is no dirt
involved what so ever so it ' s Unlikely . It
is compacted stone .
A . Everett : Q . What is that secured too ?
A . There ' s a manufactured vinyl track that the
skirting sets into and is nailed with long
spikes down into the compacted stones . It
can ' t move and the skirting is designed so
that if there was any movement , settling
there is a certain amount of tolerance for
that adjustment . It is better than anything
you could construct conventionally .

!� ) protects the main house ' s western exposure from wind and weathers
5 ) and preserves the full use and enjoyment of our enclosed porch .
® For the above reasons we feel that Plan 3 enhances the enjoyment
and value of our home at a, reasonable cost whereas Plan 1 and Plan 2
detract from the enjoyment and value of our home at a cost which is
less affordable .
It is important to stress the sa. fe 'ty and convenience of this
addition . We want to avoid the problems we now have in loading and
unloading vehicles on snow or ice covered walkways . We want to be
able to store and protect our property within easy reach of our home .
We want to accomplish these things while still maintaining the original
charm and character of our home . It would be impractical for us to
consider an attached addition to the main house -to accomplish our goals .
Areas where that would be possibl. e , or might be considered , are also
in violation of the set - ba. ck regulation and would also create additiona. l
problems and expenses -that could not be overcome .
We feel that this project will enhance our property and the
neighborhood , The attached perspective drawing is an example of what
we hope to be able -to do .
We believe that •there will be little change In the character of
our neighborhood . Our neighbor directly across the street has an
attached garage ( also in character wi. til their house ) which is 52 ' - O "
from the road centerline ( see photos 9 & 10 ) . T. hey have a. yard made
more private from the road by that garage . They have the conveniences
we wish 'to have while preserving their yard space and its desirable
views .
The proposed garage location would still be farther from the road
® than the existing house and farther from the road than many houses in
our area. , We see no adverse impact on municipal services created by
the proposed location of the garage . Yet , we see a clear benefit to
all by removing parked cars .from the current roadside driveway or') a
dangerous curve .
We have tried to be fair , reasonable and sensitive by trying to
devise a plan which comes closest to meeting both our needs and those
of 'the Town . For all of these reasons we respectfully request that
we be granted permission to construct this proposed garage and
connecter at a distance of 39 ' - 0 " from the Lower Creek Road center -
line as shown on Drawing " a. / 1 Site Plan " .

After reading the application William Temple stated he would
like to stress the importance of the Usability of the rear
® porch . That is currently being used as a family room - to the
rear area and most of that porch would truly be rendered useless
to traffic patterns if we have to move the garage further back
in and install some sort of protective connectors between it and
the building . If you look at photos 5 through 8 which show the
view from that back porch you get a sense from where you can see
the barn , as you move across that porch — the porch is not
overly large to begin with , you encounter that large conifer
very soon , if the garage were to be placed there it really does
cut down on the view from that porch . You ' d be looking at a
garage rather then the conifer .
There is another garage in the other- direction down Lower Creek

A . Everett : a . The alternative plan 1 and 2 are both within
the Zoning required setback ?
A . Yes , they would be .
Q . But you would prefer plan 3 ?
® A . In terms of the problems of plans one and
two , to get very specific you ' ll note the
cost differential in plan 1 , additional cost
is $ 4 , 000 . 00 that does not consider the fact
that the connector would cross right over
the well . So that is a virtual
impossibility , you have to eliminate the
connector- as an option for the Randolph ' s to
use or dig a new well .
QQ . There are two wells noted on this . Do they
use both wells ?
A . Yes .
Q . Are they connected in anyway ?
J . Randolph : A . No .
W . Temple : A . The other problem is that to put in the
headers on the doors is a difficulty at that
porch location . There is an existing door
on the porch which is what we hope to use .
By having to put in a second door means we
. have two doors off that porch if we want to
• keep one . Or the expense of putting in a
new one and covering Up the old door in some
form to make the porch look good , or we just
loose the whole space to circulation and it
still may not be possible to get a header in
the wood .

J . Raker : Q . What ' s the cost of a steel header ?
W . Temple : A . The steel is not the expense it ' s the
instillation of it . The steel is about
twice what the wood is , but it ' s a small
beam .
J . Raker : Q . What type of drive way is being installed ?
A . Stone .
Q . Total incremental cost for the drive way
seems out of line . Typically cost run
$ 10 . 00 a foot for a single wide drive way .
This is a double wide so it would be like
$ 20 . 00 a foot .
A . Well we have grading and drainage to worry
about and we wanted to put down crushed lime
stone instead of gravel , it gives a much
nicer look .
Mr . Randolph : A . The $ 4 , 000 . 00 move for plans that comply
with the set back , which is economically we
just can ' t afford .
A . Everett : Q . You would have to take out that large tree ,
and the lilac bush to put the proposed
garage back 70 feet ?
A . Right .
Q . What will you do with the well ? What
significance is that ?
W . Temple : . A . The well is in the way of direct connections
to the garage .
Q . What does the well look like ?
A . Basically a hole in the ground with a well
cap and right now there ' s a temporary cover
over it . ( 316 " by 41 )
J . Baker : Q . Is it a dug or driver well ?
A . Driven .
D . Bordonaro : 0 . You use both wells ? How do you do that ?
Mr . Randolph : A . I don ' t know how there connected . There ' s a
pump in the basement . It ' s an older home ,
• I ' ve been there the last six years but it ' s
been redone and so there are a lot of
uncertain connections .

F . DiTommaso : Q . So how do YOU know which one you can give

Mr . Randolph : A . That ' s the point . Flan one is really not
feasible because it does go over that , and
we don ' t want to destroy it . Plus it would
destroy the view and the mature foliage we
have around the property . While that
complies with the set back regulations it
has the other disadvantages .
Mr . Bordonaro stated that if there wasn ' t disadvantages
obviously you wouldn ' t be here . There are always going to be
disadvantages in everything anyone wants to build , there is
always something that isn ' t quite right . The reason in my mind
at least , that someone gives that they just don ' t like to do it
that way because if didn ' t fit their plan is normally not
enough . You have to give us enough reason to violate the
rul e .
Discussion on the wells and were they active ensued with
uncertainties . No one knew if both wells were active or not .
Mr . Randolph mentioned again the cost hardship . He stated they
were prepared to invest $ 20 , 000 . 00 however $ 30 , 000 . 00 was out of
the question .
® Donald Gilbert mentioned there were a lot of accidents at that
location . The Town was not planning on doing any construction
in that area and the garage would not be any closer then the
house is now .

A public hearing to consider the application submitted by JOSEPHO LO
PINTO of 335 Sheldon Road , Freeville , New York to omit the Dryden Town
required skirting wall for a DOUble - wide Mobile Home which he is
installing at 349 Sheldon Road and is requesting a variance to Article
1000 , Section 309 of the Dryden Town Zoning Ordinance .
A public hearing was duly conducted by the Town of Dryden Board of Zoning
Appeals on Tuesday , April 2 , 1991 with members present : Chairman , John
Baker , Dominic Bordonaro , Francis DiTommaso , Ann Everett and Alan LaMotte .
FINDINGS :
1 . Mr . LoPinto suggested a legitimate and reasonable alternative
that meets the intent of the Zoning Law .
A motion was made by Francis DiTommaso that Mr . LoPinto be granted a
® variance as described based on the findings .

RANDOLPH of 31 Lower Creek Road , Ithaca , New York to erect a private
garage closer than the required 70 feet from the center of Lower Creek
Road and is requesting a variance to Section 754 . 1 of the Dryden Town
Zoning Ordinance .
A public hearing was duly conducted by the Town of Dryden Board of Zoning
Appeals on Tuesday , April 21 1991 with members present : Chairman , John
Baker , Dominic Bordonaro , Francis DiTommaso , Ann Everett and Alan LaMotte .
FINDINGS :
1 . The applicant proved economic hardship ( the figures submitted
showed an additional cost of $ 4 , 000 . 00 which was a 20 % increase
due to Zoning ) .
The proposed location of the garage is no closer to the road than
the existing house therefore , does not change the essential
character of the neighborhood .
3 . There were eleven neighbors notified and there was no
neighborhood opposition at this hearing .
Dominic Bordonaro moved that the variance be granted based on the
findings .
Second to the motion was made by Alan LaMotte
