Communications). The traffic on Rt. 13 makes it unsuitable for uses
that are allowed in the RED -1 designation. This fact is demonstrated
by the fact that the entire Rt. 1.3 corridor from the Village of
Dryden to the Ithaca town line is zoned either .hi -A or RD -11
The land only has value as a commercial site.
3. Reasonable Return: This property has been for sale continually -f.or
the past three years without an offer. Mr. Park is the first and.
only offer to be made on this property, and. his offer is contingent
on obtaining a variance. If this property were located any place
other than Rt, 13 an offer for an allowed use surely would have
been made. As the situation now stands the zoning laws are denying
the owner his only chance in three years to realize a1x return,
reasonable or not.
4. Character: As a commercial business location, Mr. Park's garage and
used car lot fits within the character of the existing
neighborhood. 14. out of the 31 existing structures on Rt. 13 from
Rt. 366 to Kirk rd. are commercial businesses. This fact is fr.r.rther

immediate neighbors were opposed to the project, although they all

® Practical difficulty occurs in that the State has
purchased right -0f -way depth out of the ordinary in
front of my store, depth approximately 65 feet from the
center line instead of 33 feet as normal. The existing
right of way location already exceeds the Town
requirement, under normal circumstances, by approx. 17
feet. If I take this 15 feet set back it places me
approx. 80 feet from the center line instead of the
normal 33 + 15 or 48 feet making it difficult to read,
creating a potential traffic hazard. Signed by Mr.
