ZONING BOARD OF APPEALS
April 1, 1986
Zoning Board of Appeals met April 1, 1986 with members D. Rose,
• C. Hatfield, Chr. P. Brellochs, J. Baker, & Z.O. S. Stewart present.
Absent: N. LaMotte. Also present: A. Reed, L. Mix, R. Lacey, S. Milton,
C. EvaT�S, & J. Bizzell.
HEARING I
Public hearing to consider application of Alton Reed to convert part
of his barn at 212 Turkey Hill Rd. for a Craft Shop & is requesting
variance to Sec. 701 of Town Zoning Ordinance.
A. Reed present
- Had pictures, survey
map, & tax map.
Daughter, who lives
in Fayetteville,
N.C., wishes to teach
basketry & crafts during summers.
Mr. Reed would
like to put his office
in part of barn,
& use remaining
space for storage.
Had applied for 45
mph zone & been
turned down, has
reapplied.
P. Brellochs - Concerns: Off street parking, business hours, days of
operation, number of people to frequent that type of business.
A. Reed - Response: Sufficient parking for 20 -25 cars, shop probably open.
3 -4 days per week including Saturday w/ afternoon & evening classes for
5 or 6 people per class. No Sunday business.
HEARING II
Public hearing to consider application of Lloyd Mix to build house
• at approximately 351 Ringwood Rd., Tax parcel #51 -1 -17 & is requesting
variance to Sec. 803 of Town Zoning Ordinance which requires that lot
have at least 125' frontage on public road.
L. Mix present - Explained sketch. Wishes to sell 20 acre lot which.opens
up about 30' in from Ringwood Rd. Only has approx. 77.88 ft. frontage on
Ringwood Rd. however. Also wishes to keep 60' of that frontage in case he
should ever wish to put in a road. Then lot he wishes to sell would only
have 17.88 ft. frontage for the 20 acre lot.
Mr. & Mrs. S. Milton present - Own triangular lot adjacent to Mix property
& road. Curious as to Mix intentions. Milton & Mix properties share
driveway at one point.
R. Lacey present - Has purchase agreement with Mix contingent upon granting
of variance. Lacey's access to house would be from 60' Mix wishes to keep,
not the 17.88 ft. he wants to purchase.
HEARING III
Public hearing to consider application of Charles Evans of 819 Snyder
Hill Rd. to keep an unregistered vehicle on his property at 819 Snyder Hill
Road for use in his woodland, & is requesting variance to Sec. 703 of
Town Zoning Ordinance which states that all lots shall be kept free of
unregistered and /or abandoned or inoperable vehicles.

C. Evans present - Request for variance is for one specific vehicle only.
A very large 1972 Travel -All station wagon with very low gear convenient
for traveling through fields to haul wood from his woodlot.Vehicle is very
• operable & had been registered in Aug. last year.
J. Bizzell - 46 Genung Rd., questioned why this was an issue, a wood
hauling vehicle should not be subject to ordinance.
General lengthy discussion of "abandoned, unregistered, & inoperable"
vehicles, Town Policv, & Zonina Ordinances.
C. Hatfield motion to move into Executive Session. Seconded by J. Baker.
VOTE ALL YES
Public hearings reopened.
DECISIONS
HEARING I (A. Reed)
Bd. moved into Ex. Sess.
D. Rose motion to grant variance w/ following stipulations.
1. Variance for Reed family only - can not be passed on by sale or
lease to another party.
2. Variance would be subject to Article 17 of Zoning Ordinance which
deals with non conforming uses - spe-clfically section 1703 that deals
with discontinuance.
Seconded by J. Baker. Discussion: A. Reed wondered if Board would care to
mention speed zones in that area. P. Brellochs stated it would be in
background information attached to letter of decision.
VOTE ALL YES Variance GRANTED
( with stipulations )
HEARING II (L. Mix)
J. Baker motion to deny variance. Seconded by D. Rose. Discussion: L. Mix
questioned State requirement for width of driveway. P. Brellochs explained
concern of Board was frontage for variance not specific in number of feet
he wished to set aside. No proof of actual footage. Reasons submitted not
sufficient for hardship.

DENIED
D. Rose motion to deny variance. Seconded by C. Hatfield. Discussion*
No
unnecessary hardship or practical difficulty shown. Vehicle is not abandoned,
it is operable, & is not junk or trash, & ordinance does require registration
of all vehicles.
VOTE 3 YES (Rose,Hatfield,Brellochs) Variance
• 1 NO (Baker) DENIED
