Chr. P. Brellochs, & Z.O. S. Stewart present. Absent: N. LaMotte,J. Crawford.
HEARING I
Public hearing to consider application of Jack Davie to convert old barn
at 339 Groton Road to a small engine & cycle shop & possible sales of small
engines & is requesting variance to Sec. 804 71 which requires that a structure
be at least 70' from road center line.
J. Davie
present to explain
his
intentions of removing the smaller barn in
front.
He had submitted a
site
sketch.
P. Brellochs reviewed a list of concerns he had including; 1. Outdoor displays
2. Advertising signs 3: Off street parking 4. Nature of parking lot 5. Indication
of storm run -off 6. Noise emissions 7. Storage of surplus parts.
• J. Davies' response to concerns; 1. No outdoor displays 2. Small sign on side
of barn ( to be in conformance with ordinance) 3. Off street parking for
probably 4 cars on South side of bldg. (toward Freeville) 4. Will probably
be gravel or blacktop 5. No problem with run -off because of steep slope from
highway toward back of lot 6. Noise level would not be constant or
objectionable - Would only test drive vehicles to make certain running

properly 7. No outside storage of surplus parts.
E. Webster, B. Crissy, Wilcox, C. Newman, & C. Cotterill also present.
Lengthy general discussion between neighbors, J. Davie, & Board about concerns
as listed above & poor visibility from barn! to Rte. 38. Suggestions of
signs being put on highway warning of hidden drive or lessening speed Zone
through that area were considered. Business hours & opening date were also
discussed. Davie hopes to open in Spring with business hours Tues - Sat, 9 -6.
C. Cotterill explained procedure necessary to apply for road signs on
• State highways. Stated community should submit petition to Town Board
listing concerns. Town Board would then pass resolution supporting
petition & ask County to do the same. County then goes on to State level.
Town has no authority on road signs. Cities & villages can set their own
speed limits but Town is Ward of State. It is not an easy procedure.
Most requests are denied by State.

P. Brellochs read letters from Tompkins Co. Dept. of Planning & also
State Education Dept. (both on file).
C. Hatfield made motion to go into Executive Session. D. Rose seconded.
BOARD MOVED INTO EXECUTIVE SESSION.
Public hearings reopened.
DECISIONS
HEARING I
Findings;
1. Concern about visibility onto Rte. 38
2. Concern about measure of steepness (aprox. 6' grade differential)
3. Site drainage is away from road & basically 'away from buildings
4. Applicant proposed limiting parking to 4 or 5 cars
5. Applicant proposed No outside part storage
6. Applicant would be test driving motorcycles on site
7. Applicant stated business,hours would be between 8 & 5 with time
prior to & possibly after to accept work. Will clarify later.
8. Days of operation - Tuesday through Saturday with no work being done
on Sunday or Monday.
P. Brellochs asked for applicant to react to findings.
J. Davie stated he
would like hours to be from 9 to 6 for availibility to customers.

C. Hatfield made motion to rq ant variance with following stipulations;
1. Small shed located between barn & Groton Road, identified as Bldg. "A"
by appellant, must be removed or relocated to an area outside 70'
setback easement.
2. Driveway intersection with Groton Road must be level for a distance
of one & one half car lengths, approx. 301

3. Offstreet parking must be provided for five (5) cars.
4. Business hours shall be limited to Tuesday through Friday, 9 AM to
6 PM, Saturday, 9 AM to l PM. No business hours on Sunday or Monday.
5. Sound emissions shall be limited to business hours.
6. Cycle and small engine parts shall be stored inside barn.
D. Rose seconded motion. Discussion: Neighbors still concerned with poor
visibility & noise emissions.
