Hatfield, & Z.O. S.Stewart. Absent: D. Rose. Also present:M. Perkins. HEARING I Publiclhearing to consider application of Charles P. Johns to build family room at his dwelling 933 Dryden Rd. & requesting variance to Sec. 1004 -2a of Zoning Ord. C. Johns present, explained he owns service station & 7 unit motel & is surrounded by Jim Ray Mobile Homes Inc. Original house probably built in 50's & present property lines established at that time. Emergency equipment has access by road 25 to 30 ft. away. Pine trees separating present home & Ray property. HEARING II Public hearing to consider application of Dryden Baptist Chapel to have sign on front of Church at 138 Virgil Rd. & requesting variance to Sec. 1502 of Town Zoning Ordinance'. No one present to speak for Baptist Chapel. While waiting for time for 3rd hearing, J. Jackson (Dryden Assoc.) had information Board requested at former hearing. Gave revised run -off report & site plan & research study of 3 other community colleges with housing facilities similar to proposed Dryden Housing (what of tenants owned vehicles). HEARING III Public +hearing to consider application of Jeffery McGuire to place mobile home on lot off Bone Plain Rd. & requesting variance to Section 803 of Town Zoning Ordinance which requires lot have at least 125' frontage on public road. M. Malkin, atty. for McGuire:, explained McGuire had extended driveway across land owned by Audrey McGuire & Mercy Krebs (by easement) to Bone Plain Rd. Driveway will be at least 15' wide & maintained by J. McGuire. Easement drawn up, not recorded. E. Spaulding & M. Russell spoke against granting variance, concerned McGuire may use Short'Rd. rather than own driveway. Atty. Perkins said iI not up to Town. B. Keech read proposal (Dryden Assoc.) for 2 space per dwelling unit or 96 total space minimum with additional parking possible:, Construction of 189 spaces severe hardship on project sponsors because of strict drainage control on storm run -off. Larger parking lot would double amount of run -off from area & mean further expense for retention'structures & piping controls. Moving site up hill, required water pressure booster system. Additional.costs for more paving & complex storm drainage control would further reduce economic viability of project to point where may not be feasible to proceed with project. P. Brellochs felt letter gave comparison Board had required. Jackson Enterprises made comparisons of community colleges similar to Dryden's proposed housing concerning tenant ownership of vehicles: Geneseo Community College -'' College Meadows 35% Herkimer Community College College Hill Tenant Housing 400/o Herkimer Community Housing 25% Dryden is' proposing 50.0. C. Hatfield questioned availability of written document from TC3 on overflow parking. Jackson stated it was oversight; thought no problem to obtain. N J Ll 0 -2- P. Brellochs _ Motion to goo into Exec. Sess. Seconded N. LaMotte. VOTE Public hearings reopened. HEARING ;I (C. Johns) ALL YES Bd. moved into Exec. Sess. B. Keech motion to grant variance with 5' minimum set back from property line. Seconded - P. Brellochs. Discussion: Proximity of property line potential for practical & legal difficulties - interest of ordinance is to maintain separation between adjacent dwellings - combination of 5' set back & 25' separation of adjacent trailer from proposed addition would maintain zoning ordinance intent for 15' set back requirement - (being within 1' of line could create difficulties with 16" overhang on roof, eves would be dripping on property next door). VOTE ALL YES HEARING II (Dryden Baptist Chapel) VARIANCE GRANTED (with 5' stipulation) C. Hatfield motion to grant variance as stated. Seconded -P. Brellochs. Discussion: Felt applicant would face practical difficulties if variance denied. With set back from primary road that services property & type of activity, needs measure of visibility for sign that identifies building. VOTE I ALL YES VARIANCE GRANTED HEARING III (J. McGuire) B. Keech stated that Board discussed at length & considered findings from previous meetng. Reminded everyone Board had no jurisdiction on Short Rd. being public or private & that request for private drive off Bone Plain Rd. was issue. P. Brellochs motion to grant variance w/ following stipulations. 1. Driveway must be at least 15' wide. 2. Easement must be maintained even if property sold or transfered, or until such time as Short Rd. may become public road. 3. Granting variance contingent upon receipt of copy of court documentation of fact easement recorded. Seconded -C. Hatfield. Discussion: Given fact that considering variance request involving co- operation of 3 members of same family, tipped scale toward granting. VOTE ALL YES VARIANCE GRANTED (with stipulation) Dryden Assoc. - Discussion: Board felt additional information asked for at previous hearing had been provided by applicant. D. Bravo - Cullen questioned location of future parking lot & was opposed to location. N. LaMotte motion to grant variance with following stipulation. Written documentation must be given to Board concerning TC3 allowing any over -flow parking on their camppus. Seconded - P. Brellochs. VOTE MEETING ADJOURNED vault.
