TOWN BOARD MEETING

Supv Sumner opened the board meeting at 7 : 35 p. m . and board members and guests
participated in the pledge of allegiance .
CITIZENS PRIVILEGE
Craig Anderson said he understands that at last week 's abstract & agenda meeting,
during the discussion of agriculture, a statement was made by a planning department
employee that agriculture is "the most unregulated industry in the country . " This attitude
creates friction with no positive affect.
411 Supv Sumner said she understands what the speaker intended . She made a point that
farmers deal with more regulation than the average landowner . He was looking at it from an
industry perspective , and it is true that many industries are more heavily regulated than
agriculture . She will get some clarification .
C Anderson - With respect to CEAs, the I�dAF (Environmental Assessment Form) , short
form , 2,ld page - questions " D . Will the project have an impact on the Environmental
Characteristics that caused the establishment of a CEA? ," and "E . Is there , or is there likely to
be , controversy related to the Potential adverse environmental impacts?" and on long the form
Questions 12 and 14 also deal with the impact the proposed action will have on a CEA. It
doesn 't ask where the property is . The action could be on someone else 's property upstream or
upwind , or a view shed . It doesn 't necessarily have to be right in that CEA . The Board should
approach more landowners in the future, because it affects more than the property that is
actually included in the CEA boundaries.
He said the DEC has been reviewing the SEQR process in the last few years and
provided what is likely a final draft of the new SEQR form . That form asks whether the
proposed action is located within or adjacent to a CEA . That word adjacent is huge .
Supv Sumner said that the existing form asks whether the project will have an impact.
The project doesn 't have to be in or adjacent to , so this is a narrower scope .
C Anderson said when the CEAs are presented again , you really need to involve more
landowners around the CEA because they are affected . It is important to reach out to the
people who weren 't notified last tame . They need to understand what is going on . We should

• Scutt expressed concern that the Board didn 't do the pledge of allegiance at the
abstract ea agenda meeting.
With respect to the 2 % tax cap vote, he goes through budget frequently and is dismayed
at how unprofessional it looks . Looks like line items are copied from the year before and it is
difficult to read . Gas is high now (he paid $4 . 13 / gallon) and some can 't take the continuing
increases in property taxes . Dryden can lead the way in the state. Approximately 20 /0 of town
revenue comes from property taxes. The town needs to practice what a homeowner does and
try to live within the budget, 1. 9% of which comes from taxes . The town could afford a 20% cut
in taxes and in theory do away with the tax levy . Government develops a program then seeks
the funds . Instead they should increase the tax base then develop programs . $ 1 . 24 million
comes from the tax roll. $ 124 , 000 could be cut now ( 10% of the taxes) . The Town is looking to
exceed the cap without having a budget in place , and the Town is taking advantage of common
folk by rarnrodding stuff through . If you continue to do this , it doesn 't bode well for the health
of the town down the road .
Supv Sumner said she is frustrated by the rhetoric and she doesn 't know if he believes
what he is saying or is being deliberately misleading. She would be happy to explain it if he
calls her.
Bruno Schickel handed out a taxpayer summary uiecu he prepared to demonstrate the
town's overspending over the last five years based on the Annual Update Document filed with
New York State . He reviewed appropriations and expenses in 2008 , 2009 , 2010 (the year the
town fronted farmland protection money) , and 2011 . Between 2008 and 2011 the Town had an
increase in spending of about 20 . 8% . Income (non- property tax income) dropped about
$400 , 000 from 2008 to 2011 .. Property tax income inches up a little bit each year.
$ 1 , 233 ,000 for property tax in 2011 is 28 . 7% of the income brought in that year. Total income
has actually dropped about $ 150 , 000 from 2008 . The town is running a deficit every year,
according to the numbers from the AUD . Last year's deficit was $ 1 , 314 , 000 ; that 23% of the
total spending done last year.
Supv Sumner said it is not a deficit. Those funds were appropriated from fund balance .
It is part of the spending plan and she would be happy to explain out of this meeting.
13 Schickel said this is about making good decisions moving forward . The town is
spending more than it is bringing in and covering it by taking it from savings . Last year's
actual deficit was $ 1 ,314 , 000 . When the savings account is depleted , to bring in that amount
will mean a huge property tax increase .
Supv Sumner said she has already explained the Town 's reserves and long range
planning. There had been an outcry that the town was holding too much money a few years
ago and the Town Board planned to spend it down .
B Schickel said the unassigned fund balance at the end of 2011 was $ 1 , 7480 , 00 . When
doing the budget this year, you need to really look at the situation . Savings is filling the gap
between spending and income, and when you 're out of savings , you are in a serious pickle .
VERIZON WIRELESS
Supv Sumner explained that Verizon Wireless is applying for an amendment to their
special use permit on the NYSEG tower. The town board expect the application to be
scheduled for public hearing next month . Lisa Vangelo , representing Verizon, is here to
answer any questions with respect to the application . She has a copy of the letter from the
® town 's consultant , Jeff Kirby , and provided some the items requested in that letter. Some

things can be made a condition of the approval . They are happy to add the items to the
drawing that were requested . J Kirby said those kinds of items are quite straightforward .
Supv Sumner asked how the coverage would change from last application . Vangelo is
not a RF engineer but it is the same application as on Walker road two years ago for high speed
data. J Kirby said this is for LTE coverage and doesn 't relate to previous coverage maps. It is
"another system within the system . " Units have ability to utilize multiple coverages. This will
enable utilization of high speed coverage .
J Kirby said after the agenda meeting last week, he looked at what actually is on the
tower. There are two different types of antennas on the tower now . In 2005 , Verizon got a SUP
for construction of an 850 megahertz system using CDMA technology' which was installed in
2006 . At that time it was expected to switch to 1900 at the NYSEG tower, but today 1900 is
already up and Verizon did not go through the application process. The change was made
contrary to the Town 's local law for modification of the special use permit. He asked how this
happened , and how can the Town Board respond to that .
L Vangelo said she doesn 't know what happened specifically but pointed out Verizon
looks to get the biggest antennas approved . The tower was designed for bigger antennas and
they got approval for bigger antennas . The final design is not complete until after approval and
the change in antennas was made in the design knowing that structurally it would be okay . All
of the 8 foot antennas were never put on , instead they put on six 8 ' and six 4 '. No changes
were made after the approval. Greg Hanley will be here next month to address .
J Kirby said it is not the system that was approved . The Walker Road application says
the NYSEG site did not have a 1900 megahertz system two years ago. L Vangelo will see that is
Aaddressed next month .
Cl Stelick does not want to move forward without an answer to that question . Supv
Sumner agreed . L Vangelo will get answers to the Board prior to October 4 , but the Board is
realistically looking at a November hearing .
CITIZENS PRIVILEGE - con 'td
Evan Carpenter said he attended the last meeting regarding CEAs and wanted to
comment on the level of intensity . He noticed that farmers were not quite as intense as
landowners; not because they aren 't concerned , but they are a little more used to regulatory
things they have to deal with . There are so many state and federal regulations farmers have to
follow and thus they are a little numb to some of the new CEA stuff. It's not that they don 't
care as much . A petition was turned in at that meeting, and he asked what the procedure was
going to be regarding the CEAs .
Supv Sumner stated the schedule is suspended for now. They are talking about
holding some neighborhood information meetings and doing some explanatory writings. No
decisions are being made at this time . It will not be on the agenda in the foreseeable future.
E Carpenter said the CEAs are the next layer that , when organized and labeled , some
faceless bureaucrat could then take some action on .
Supv Sumner fully understands the most passionate in the crowd and appreciates their
concerns .

Supv Sumner offered the following resolution and asked for its adoption :

Town Clerk Avery reported that the SPCA has received a grant to spay / neuter about
600 free roaming cats and they have chosen Dryden as their target area .

COUNTY BRIEFING
Mike Lane - The County has started their budget season and have received their
411 administrators' budget. He said it is the best one in years and is clear and precise . The
expanded budget committee is now hearing presentations from department heads and "over-
target" requests. The legislature may make cuts and changes. The County Administrator is
recommending a 3 . 48% increase tax levy . Their cap is 3 . 15% so the amount is not a large gap .
Budget forums will be announced soon . The first is October 9 at 7 : 00 pm in the old
courthouse .
At their last meeting the legislature discussed drug issues , primarily bath salts. The
Sheriff is concerned with being able to arrest dealers and manufacturers since the substance
continually changes . It is synthetic and can be deadly . This is a health issue affecting young
people in particular. The County passed a resolution asking New York State to pass
meaningful legislation to outlaw the production and sale of these synthetic drugs.
Martha Robertson -The colored shoulders on Ellis Hollow Road have received a lot of
media attention . The original plan was that shoulders would have color in the aggregate, but
because of budget restraints this was not possible . In the meantime , the County has been
tracking speeds on the road , and then used $ 17 , 500 to paint the shoulders . They are again
tracking speeds. The theory is that because the road looks narrower, it will mitigate speed .
They have a year's worth of speed data with the newly paved road and will compare that to
speeds with painted shoulders. If there seems to be a difference, it could be considered as a
tool on other road projects in the future.
Tompkins County Area Development - For a number of years , they were operating very
well and had a fund balance of almost $ 1 , 000 , 000 . Then the County made a decision to pull
back county property tax support and told TCAD and IDA to use IDA fund balance to support
TCAD . Cornell and IC have made a policy decision to not borrow for construction projects
® anymore . The IDA has some fund balance for next year but without county support, current
operations cannot be sustained . The County budget proposes $ 170 , 000 in taxpayer money in

® one time funding and they will appoint a task force to analyze the issue and present alternative
options .
Elected Officials to Protect NY - A letter was sent to NYS government asking that no
(racking be done until impact studies are complete . 280 signatures of elected officials were
originally submitted . They now have 421 signatures from 50 counties. Elected officials can go
to nyelectedofficials. org to sign on .
Commissioner Martens has announced that the State Department of Health will be
asked to do a health impact study on fracking. This is good news since it wouldn 't make sense
to do an impact study and do permitting at the same time.

The board has received proposed resolution authorizing the Supervisor to sign the
application to the State Comptroller for permission to form the Yellow Barn Water District.
RESOLUTION # 151 ( 2012 ) - APPROVING APPLICATION FOR
PERMISSION OF THE NEW YORK STATE COMPTROLLER
REGARDING FORMATION OF YELLOW BARN WATER
DISTRICT.
Cl Stelick offered the following resolution and asked for its adoption :
WHEREAS , the Town Board of the Town of Dryden , New York (the "Town " ) has
authorized the establishment of Yellow Barn Water District (the " District" ) and the acquisition
and construction of improvements to the District, subject to receipt of permission of the New
York State Comptroller in accordance with Town Law Section 209 -f and Part 85 of the New
York State Comptroller' s Regulations; and
WHEREAS , at the direction of the Town Board , the Town Supervisor has prepared an
application for permission of the State Comptroller (the " Application " ) a copy of which is
attached to this resolution ;
NOW , THEREFORE, be it resolved by the Town Board of the Town of Dryden as follows:
1 . The Town Board believes the contents of the Application to be accurate .
2 . The Town Board has previously determined that the formation of the
District and the acquisition , construction and installation of the proposed improvements
thereto are in the public interest and will not constitute an undue burden on the property
which will bear the cost thereof.

S 3 . The real property to be assessed the cost of the proposed improvements
will be benefited by the proposed improvements and no benefited property has been excluded.
4 . This resolution is adopted in accordance with Section 85 . 3 of the New

Supv Sumner said she met with the Yellow Barn folks on Tuesday and they are excited
with this progress.
NEW BUSINESS
Supv Sumner has provided a proposed local law authorizing the Board to override the
tax levy cap. She added that she does not anticipate it will be necessary to exceed the cap
limit. She has calculated the cap at 2 . 72 %, almost the same as last year . Early indications are
that the tax levy increase would increase 2 . 4 % .
The board introduced the following local law and set the public hearing for October 18'"
at 7 : 30 p . m .
A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED
IN GENERAL MUNICIPAL LAW §3-C
Be it enacted by the Town Board of the Town of Dryden as follows:
Section 1 . Legislative Intent: It is the intent of this local law to override the limit on
the amount of real property taxes that may be levied by the Town of Dryden , County of
Tompkins pursuant to General Municipal Law §3 -c , and to allow the Town of Dryden , County
of Tompkins to adopt a town budget for (a) town purposes , (b) fire protection districts , and (c)
any other special or improvement district, and Town improvements provided pursuant to Town
Law Article 12- C , governed by the Town Board for the fiscal year beginning January 1 , 2013
and ending December 31 , 2013 that requires a real property tax levy in excess of the " tax levy
limit" as defined by General Municipal Law §3 -c .
Section 2. Authority: This local law is adopted pursuant to subdivision S of General
Municipal Law §3-c , which expressly authorizes the Town Board to override the tax levy limit
by the adoption of a local law approved by vote of at least sixty percent (60%) of the Town
Board .
Section 3 . Tax Levy Limit Override : The Town Board of the Town of Dryden , County
of Tompkins is hereby authorized to adopt a budget for the fiscal year 2013 that requires a real
property tax levy in excess of the limit specified in General Municipal Law §3 -c .
411) Section 4. Severability: If any clause , sentence, paragraph, subdivision , or part of
this Local Law or the application thereof to any person , firm or corporation , or circumstance,
shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional , such

• order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be
confined in its operation to the clause , sentence , paragraph , subdivision , or part of this Local
Law or in its application to the person , individual , firm or corporation or circumstance , directly
involved in the controversy in which such judgment or order shall be rendered .
Section 5 . Effective date : This local law shall take effect immediately upon filing with
the Secretary of State .
Bolton Point Water Rate -
The five municipalities participating all have to approve the new rate . It will increase
from $3 . 15 / 1 ,000 gallons to $4 . 00 / 1000 gallons . This increase will aid in long range planning
for capital projects . It will cost more if bonding is necessary . The rate declined for several
years, but over 9 years the average rate increase was 1 . 3% , which is substantially below the
inflation rate . The rate would be $4 . 18 if we had kept pace with the rate of inflation .
RESOLUTION # 152 (2012 ) - APPROVE BOLTON POINT WATER RATE INCREASE
Supv Sumner offered the following resolution and asked for its adoption :
RESOLVED , that this Town Board hereby approves the Bolton Point water rate for 2013
of $4 . 00 per thousand gallons.

Personnel Policy Waiver
Cl Stelick said the personnel committee approved a waiver for Erin Bieber (Deputy Town
Clerk) to receive health benefits effective October 1 . The reason is that three months from her
start date would be past the middle of October, making a November 1 start date for benefits .
RESOLUTION # 153 ( 2012 ) - HEALTH INSURANCE POLICY WAIVER
Supv Sumner offered the following resolution and asked for its adoption :
RESOLVED , that this Town Board hereby approves the health insurance waiver as
recommended by the Personnel Committee that coverage for Erin Bieber be effective October 1 ,
2012 .

a Supv Sumner is working on the draft tentative budget . it appears that appropriations
will be lower than last year and we will need less fund balance than last year. She said she
expects zero growth in fire protection , thanks to cooperation from the departments. She is
looking at scenarios that would reduce appropriations and has concluded we may be able to
reduce appropriations by 10%.
Committee Reports
Technology Committee - The Town 's new server equipment has been ordered . Supv
Sumner has enjoyed working with IV4 . Cl Stelick said the contract needs detail on what their
customer service includes. They are doing a good job, but he is concerned about whether we
are being charged for anything extra . Supv Sumner said IV4 bills at a discounted contract
rate , but sometimes they don't charge us. She will get detail from them on what has been done
so far. She said there will be training for staff on using the client portal online .
The Board would like staff to make better use of technology and equipment during
meetings.
Moving forward with road protection and aquifer protection .
There being no further business , on motion made , seconded and unanimously carried ,
the meeting was adjourned at 9 : 21 p . m .
