Avery , Town Clerk Other Town Staff: Dan Kwasnowski , Director of Planning Andrew Sciarabba , TG Miller Engineers Supv Sumner opened the meeting at 7 : 38 p. m . and board members and guests participated in the pledge of allegiance . PUBLIC HEARING LOCAL LAW AMENDING LOCAL LAW #3 OF 2007 REGARDING HIGHWAY SPECIFICATIONS Supv Sumner opened the public hearing at 7 : 40 p . m . and Town Clerk read the public notice published in The Ithaca Journal . Supv Sumner explained that this local law will amend Local Law # 3 of 2007 , establishing specifications for new highways in the Town of Dryden with respect to centerline grade . There were no public comments. The hearing was left open at 7 : 42 p . m . PUBLIC HEARING ESTABLISH YELLOW BARN WATER DISTRICT Supv Sumner opened the public hearing at 7 : 43 p. m . and dispensed with reading of public notice which was lengthy and sent to all 81 properties in the proposed special district . John Laura, 31 Spring Run Rd , said he is on the board of directors of the Yellow Barn Water Company . He said all board members are in favor of the plan as set forth . The Town . has been very helpful in working out an acceptable plan . He urged the board to support the plan . The company has limited resources available for upgrading the system . It would be a big help for all of their customers to have the town take this over as a water district . Supv Sumner thanked the members of the Yellow Barn water company board for their hard work in the past year. She said it was a pleasure working with them and thanked Ilene Miller in particular for her efforts. Jane Edwards, 1 Foot Hill Rd . , said they didn 't realize they were shareholders of the water company until after they purchased their property. She is grateful to all who brought us to this point. Realistically this will create a good secure system, and spread the cost to the users over time. She thanked everyone for their efforts. A Sciarabba, TG Miller Engineers said the only change made in the Map , Plan and Report is the formula used for distribution of annual cost for debt service . It was changed to units so that each property pays the same across the board . $ 1 , 045 per parcel is the first year ® cost. There were no other comments, and the hearing was left open at 7 : 47 p . m . Page 1of15 1'H 5 - 17- 12 There were no further questions or comments on Local Law #3 of 2012 . And the public hearing was closed at 7 : 48 p . m . RESOLUTION # 103 ( 2012) - ADOPT LOCAL LAW #3 OF 2012 - AMENDING LOCAL LAW #3 OF 2007 - HIGHWAY SPECIFICATIONS Supv Sumner offered the following resolution and asked for its adoption : RESOLVED , that this Town Board hereby adopts Local Law No. 3 of 2012 , a local law amending Local Law No. 3 of the year 2007 , a local law establishing specifications for new highways in the Town of Dryden , and directs that the Town Clerk file the same with the Secretary of State : 1 . Paragraph (b) of Subsection 2 ( General) of Section A ( Design Specifications) of Local Law No . 3 of the year 2007 is hereby amended to read as follows: b. Highways shall be a minimum of 60 feet in width . Highways shall intersect each other at between 80 and 90 degrees. The minimum centerline grade shall be 0. 5% and the maximum centerline grade shall be 10% . The minimum radius for intersecting highways shall be 25 feet. Wider highways may be required where deep cuts and fills , safety issues , pedestrian facilities , bicycle facilities or special maintenance needs exist. Additional widths may also be required adjacent to drainage structures, or where there is potential for future traffic growth . All improvements shall be centered in the highway . Exceptions will be allowed only with the written approval of the Town. Highways may be constructed in pre-existing widths narrower than 60 feet, which were reserved for this purpose . There shall be no obstructions to a clear line of sight , such as trees , bushes , buildings, fences , etc . within the highway. 2 . Supv Sumner said the Youth Commission offers amazing programming for young people . They also support employment opportunities for young people in jobs at summer day camp programs. The OURS program is run by Cornell student volunteers and is helping disadvantaged young people establish relationships with mentors . CITIZENS PRIVILEGE Evan Carpenter gave an update on the Ag Committee (or Farmers Committee) . They have bylaws drafted but have not adopted them . They have a few more people willing to serve on the committee and will get that information to the Town Clerk. E Carpenter said he has heard complaints about what the committee is actually about and would like to set the record straight. They are not a Bruno Schickel clique . He knows personally. Bruno builds houses for a career. Builders build houses on farmland . As a farmer he doesn 't like contractors. B Schickel has asked their opinion on different things, not the other way around . They are a not a mouthpiece for Bruno or the Republicans , or the pro-fracking group out there . They have sought out people who are anti-gas drilling and asked them to be on the committee. They are trying to get a broad spectrum of those involved in agriculture , not just like-minded folks . They are trying to get as many different opinions as possible , with the goal of promoting agriculture in town and who have an understanding of agriculture in the town . About 20% of the land base in the Town of Dryden is in productive agriculture currently with an investment of approximately 60 million dollars, in infrastructure and the land . They employ between 100 and 125 full time employment equivalents on dairy farms in the town . He 's not sure about employees on non -dairy farms . There are over 3 ,000 cows in town of Dryden , concentrated on larger farms . E Carpenter said farms create the open space that everyone enjoys. The comprehensive plan did call for the development of a standing ag committee to help advise the board on agricultural matters. It's a different lifestyle with different infrastructure required to make it work. It presents a lot of assets to the town . The committee wants to help the town make decisions that promote agriculture . CI Stelick said he thinks this is an excellent idea whose time has come and he is looking forward to working with them . There were no further comments on the public hearing for the Yellow Barn Water District and Supv Sumner closed the public hearing at 8 : 00 p . m . CI Leifer read the resolution . RESOLUTION # 105 (2012 ) - ESTABLISHING TOWN OF DRYDEN YELLOW BARN WATER DISTRICT AND AUTHORIZING THE ACQUISITION, CONSTRUCTION AND INSTALLATION OF THE WATER SYSTEM AND IMPROVEMENTS CI Stelick offered the following resolution and asked for its adoption : WHEREAS, the Town Board of the Town of Dryden , Tompkins County , New York (the "Town" ) has caused a map, plan and report (the " Maps and Plans" ) to be prepared in connection with the proposed establishment of a water district in the Town to be known as Town of Dryden Yellow Barn Water District (the " District" ) pursuant to Article 12-A of the Town Law; and SWHEREAS, the boundaries of the proposed District are set forth on Appendix A attached hereto; and Plagc 3 of 15 TB 5- 17- 12 WHEREAS , the Town proposes to acquire the Yellow Barn Water Company, Inc. water supply and distribution system for the District , and to acquire , construct and install water system improvements in the District , including equipment, machinery or apparatus required in connection therewith and land or rights in land (the "Project") , all as more particularly described in the Maps and Plans; and WHEREAS , the maximum amount proposed to be expended for the Project is $524 , 920 ; and WHEREAS , on April 26 , 2012 , the Town Board adopted a resolution reciting the filing of the Maps and Plans, the boundaries of the proposed District, the improvements proposed , the estimated expense of these improvements, the proposed method of financing, the cost of the District to the typical property, the fact that the Maps and Plans are on file in the Town Clerk' s office for public inspection , and all other matters required by law to be stated ; and WHEREAS , the resolution called a public hearing to be held on May 17 , 2012 at 7 : 45 p. m . to hear all persons interested in this matter and to take action as required by law; and WHEREAS , the resolution was published , posted and mailed as required by law; and WHEREAS , a public hearing on the matter was held by the Town Board on May 17 , 2012 and the matter was fully discussed and all interested persons were heard . NOW, THEREFORE , the Town Board of the Town of Dryden hereby resolves and determines that: 1 . The notice of hearing was published and posted as required by law, and is otherwise sufficient. 2 . All the property and property owners within the proposed District arc benefited thereby . 3 . All the property and property owners benefited are included within the limits of the proposed District. 4 . The establishment of this District is in the public interest . IT IS FURTHER RESOLVED AND DETERMINED that the establishment of the District is hereby approved and that the proposed District water system and improvements thereto (the "Improvements" ) , including the acquisition of the Yellow Barn Water Company , Inc . water supply and distribution system for the District, and the acquisition , construction and installation of water system improvements in the District, including equipment , machinery or apparatus required in connection therewith and land or rights in land , all as more particularly described in the Maps and Plans , shall be acquired , constructed and installed upon the required funds being made available and provided therefor. IT IS FURTHER RESOLVED AND DETERMINED that this District shall be known as the Town of Dryden Yellow Barn Water District in the Town of Dryden and shall be bounded and described as set forth on Appendix A attached hereto . IT IS FURTHER RESOLVED AND DETERMINED that the cost of the Improvements, including legal and engineering fees, and all other costs and expenses , shall be financed by the issuance of serial bonds and bond anticipation notes of the Town containing such terms as Page 4of15 113 5 . 17- 12 may be determined by the Town Board , and such costs shall be assessed by the Town Board in as close a proportion to the benefit to which each lot or parcel will derive from the improvement as is possible . IT IS FURTHER RESOLVED AND DETERMINED that this resolution is subject to permissive referendum as provided in Town Law Section 209-e, in the manner provided in Article 7 of the Town Law , and is subject to approval by the New York State Department of Audit and Control in accordance with Town Law Section 209 -f. 2nd CI Solomon Roll Call Vote Cl Stelick Yes Cl Solomon Yes Supv Sumner Yes CI Leifer Yes Cl Lavine Yes Supv Sumner explained that there is a 30 -day period in which people in the proposed district may petition for a referendum and bring the matter to a vote . Her sense is that the people in the district are happy with the idea and she hopes that in 30 days we can finalize the matter. HIGHWAY/DPW DEPARTMENT No report. RECREATION DEPARTMENT No report. Supv Sumner announced that the Recreation Director, Melissa Bianconi , had a baby last week, William , and said mother and child are doing well. COUNTY BRIEFING No report. PLANNING DEPARTMENT Matters will be taken care of under new business . ATTORNEY No report. Supv Sumner announced Atty Perkins is on his way to join his daughter at commencement ceremonies at Lewis and Clark Law School where Logan is receiving a degree in Environmental Law with honors . She has been elected to the Law Honor Society and will be taking the bar exam in Maine . NEW BUSINESS Code enforcement contract with Village of Dryden - Board members have received a copy of the proposed contract . Supv Sumner said the rate and service remains the same and the Village has approved it . RESOLUTION # 106 106 (2012) - AUTHORIZE CONTRACT FOR CODE ENFORCEMENT • SERVICES WITH THE VILLAGE OF DRYDEN Cl Stelick offered the following resolution and asked for its adoption : Page 5 of IS TB 5 - 17- 12 RESOLVED , that this Town Board approves the contract for code enforcement services for the Village of Dryden for the term June 1 , 2012 , to May 31. , 2012 , at an annual amount of $21 ,600 , to be paid to the town in monthly installments of $ 1 , 800 . 00 . 2nd Cl Leifer Roll Call Vote CI Stelick Yes CI Solomon Yes Supv Sumner Yes CI Leifer Yes CI Lavine Yes Zoning Amendment - Supv Sumner said we have been working on this amendment for quite some time and have arrived at a good document. The SEQR will be done next month and the narrative contains a very good description of what has been done and why . We have gone from a town map with 4 districts that were kind of arbitrary and loosely defined to an incredibly detailed map with 9 different districts with very specific characteristics distinguishing the neighborhoods from each other. It is really good and we have had a number of comments from builders, planners , and residents urging us to adopt this so we can move on . D Kwasnowski said he would hold a public information session , probably June 13 at 6 : 30 p. m . He didn 't want to schedule it until the amendment had been introduced . RESOLUTION NO . 107 (2012 ) RESOLUTION RESCINDING RESOLUTION NO. 62 (2012) AND NO. 63 ( 2012 ) , AND PROPOSING THE REPEAL OF PART OF THE TOWN OF DRYDEN ZONING ORDINANCE EXCEPT FOR CERTAIN 2009 AND 2011 AMENDMENTS AND CLARIFYING THE INTERPLAY OF THE UNREPEALED SECTIONS OF SUCH ORDINANCE AND PROPOSED AMENDMENTS TO THE TOWN OF DRYDEN ZONING ORDINANCE. Supervisor Sumner offered the following resolution and asked for its adoption : WHEREAS , the Town Board adopted certain amendments to the Town of Dryden Zoning Ordinance on August 3 , 2011 , which amendments became effective August 19 , 2011 , and WHEREAS , such amendments added definitions to Appendix A of such Ordinance pertaining to natural gas and / or petroleum exploration and extraction and added a new section , 2104 : Prohibited Uses, which section clarified the Zoning Ordinance's prohibition of the use of land in the town for natural gas and / or petroleum exploration and extraction , and WHEREAS , as a result of such amendments the town is the subject of a lawsuit which seeks to declare such amendments invalid , and WHEREAS, the town has been in the process of revising its zoning regulations and has held a public hearing on a proposed local law which would establish revised zoning regulations and incorporate the substance of such amendments , and WHEREAS , it is now determined to be desirable to adopt the previously proposed local law provisions as amendments to the existing zoning ordinance in order to preserve such amendments in the form they were originally adopted in August 2011 , and Page 6 of 15 -1-13 5- 17- 12 WHEREAS , in Resolution No . 62 (2012 ) certain amendments to the Zoning Ordinance were introduced and a public hearing thereon was scheduled , and WHEREAS, in Resolution No . 63 (2012) the date of the public hearing was changed to April 18, 2012 , and WHEREAS , the proposed amendments were referred to the Tompkins County Planning Department pursuant to the requirements of General Municipal Law 293 -m and comments were received from the Tompkins County Planning Department which , if not incorporated into the proposed amendments, would require a vote of a supermajority (meaning majority plus one) of all members of the town board , and WHEREAS , such comments have been reviewed and some can be addressed by the contemporaneous introduction of a proposed subdivision local law , being introduced on even date herewith , and WHEREAS , due to the comments of the Tompkins County Planning Department, and the fact that the proposed subdivision local law was not ready for introduction at the time of the aforesaid resolutions, and other factors , the public hearing to be held April 18 , 2012 was not held, now therefore , BE IT RESOLVED as follows ; 1 . Recreation Partnership - Supv Stunner said they have a recommendation from the Recreation Commission to continue participation in the Recreation Partnership . She added 111) that organizations that are doing well get the least public notice . The partnership makes programs affordable for many , many young people . Cl Stelick read the recommendation by the Dryden Recreation Commission : WHEREAS , the Recreation Partnership has been an excellent and cost efficient model of inter-municipal collaboration which enables municipalities to jointly plan , finance and share a diverse set of high quality recreation programs, WHEREAS , the Recreation Department could now assist with transportation due to the purchase of a van , we encourage the town to support this service , WHEREAS, the programs are available to all Town of Dryden residents , an effort should be made to increase the advertising of these programs to a broader base, including but not limited to the schools , WHEREAS , the locations are limited to the City of Ithaca , we would request the Town Board encourage the Recreation Partnership to offer programming in locations throughout the county in an effort to increase visibility, availability , and rural participation , the Dryden Recreation Commission HEREBY RECOMMENDS that the Town of Dryden continue to remain a municipal partner in the Recreation Partnership agreement for an additional five year period, expiring December 31 , 2017 . RESOLUTION # 109 (2012 ) - AUTHORIZE INTERMUNICIPAL RECREATION PARTNERSHIP AGREEMENT Supv Sumner offered the following resolution and asked for its adoption : Page 9 of 15 TR 5- 17- 12 WHEREAS , the Town of Dryden is currently a member of the Intermunicipal Recreation Partnership by agreement dated August 21 , 2007 , with an original 5 year term expiring December 31 , 2012 ; and WHEREAS , the Recreation Partnership has been an excellent and cost efficient model of intermunicipal collaboration which enables municipalities to jointly plan , finance and share a diverse set of high quality recreation programs; and WHEREAS , the Intermunicipal Recreation Partnership agreement by its own terms may be renewed for an additional five years by appropriate resolutions by each of the municipal partners on or before December 31 , 2012 ; and WHEREAS , any municipality may withdraw from the Intermunicipal Recreation Partnership agreement upon a full calendar year's notice , Now, therefore , be it RESOLVED , that the Town of Dryden agrees to renew the August 21 , 2007 Intermunicipal Recreation Partnership agreement for an additional S years , expiring December 31 , 2017 , and further RESOLVED , that a copy of this resolution be sent to the Recreation Partnership Board care of Tompkins County Youth Services Department at 320 W State/ MLK Jr. Street, Ithaca, NY 14850 . 2nd CI Stelick a Roll Call Vote Cl Stelick Yes Cl Solomon Yes Supv Sumner Yes Cl Leifer Yes Cl Lavine Yes Close Springhouse Road - Supv Sumner said the town has been asked to close Springhouse Road for a period of time on June 2 , 2012 ,. for a fundraising 5K race to benefit the Dryden boys and girls lacrosse programs . Atty Perkins has prepared a proposed resolution and a public hearing must be held . After discussion , the board will hold the public hearing on Friday , May 25 , 2012 ,. at 4 : 30 p. m . RESOLUTION # 110 (2012 ) - AUTHORIZE CLOSURE OF SPRING HOUSE ROAD Supv Sumner offered the following resolution and asked for its adoption : WHEREAS , the Dryden boys and girls lacrosse programs are sponsoring a 5K. road race as a fundraiser for their teams and desire to use Spring House Road as part of their course , and WHEREAS , the safety of the public and its participants is best protected by a temporary closure of the road during the road race , and WHEREAS , Town Law section 64 ( 10 -b) authorizes the town board to set terms and conditions for issuance of a permit by the town superintendent of highways to hold a road race • on Spring House Road and temporarily block such road during the event, and Page 10 1)1 15 . RESOLUTION 0 114 (2012 ) - SUPPORTING STATE SENATE BILL S4616 (AVELLA) / ASSEMBLY BILL A7013 (SWEENEY) TO AMEND THE ENVIRONMENTAL CONSERVATION LAW IN RELATION TO THE UNIFORM TREATMENT OF WASTE. Supv Sumner offered the following resolution and asked for its adoption : Whereas this bill S 4616 (Avella) / A7013 (Sweeney ) would require hazardous wastes produced from oil and natural gas activities to be subject to the requirements for treatment of hazardous wastes; and 411 Whereas currently the oil and gas industry enjoys exemptions from New York State laws governing hazardous waste transport and disposal . Though a great deal of the wastewater generated by hydraulic fracturing meets the state definition of hazardous, it is not required to be treated as such ; and Whereas the oil and gas industry is not required to disclose the chemicals used in the hydraulic fracturing process but the following chemicals are often found in waste water resulting from the hydraulic fracturing process : benzene, toluene , formaldehyde , salts , heavy metals, and radioactive particles ; and Whereas closing this exemption loophole will require hydraulic fracturing flowback and produced water to be monitored through a manifest system and that extra safeguards will be in place to avoid accidents and ensure proper waste treatment; and Whereas such a designation will keep fracking wastes out of municipal treatment plants and the waterways leading to sources of drinking water. Dryden Veterans Memorial Home has invited the board to the Memorial Day parade and service in the village on Monday , May 28 . The non -competitive parade will move out from Highland Drive at 10 : 30 and end at the Village Green with a service . • COMMITTEE REPORTS : Cl Leifer said the committees that he and Cl Stelick are on did not meet this month because they were doing the local assessment review. There were no committee reports . Supv Sumner said at the last meeting the board had talked about a Bar Association ® presentation on fracking issues. She is hoping that Deborah Goldberg will go to the presentation in New York and Mahlon Perkins will go to the one in Albany. Cl Lavine introduced Deborah Goldberg, of I;arthJustice , who will be presenting the town in the Anschutz law suit appeal . She said : "We often hear the sad expression that no good deed goes unpunished, and today we have the opposite story . The good news: The Dryden Town Board, before I was a member, was smart and brave enough to pass legislation protecting Dryden from a potential invasion by gas drilling interests. They were ahead of the pack, a pack that now numbers more than a hundred municipalities in New York State alone who have passed some kind of protective legislation . It took courage from the board members and good legal advice from our town attorney and other lawyers who helped us find the legal high road that we are marching on today. We , however, were chosen by the gas industry as what they probably hoped would be an easy target. They sued us in Anschutz vs. Dryden . We rallied our forces and we won and won decisively . We won in both Dryden and in our sister case in Middlefield . We won in Decisions written by smart , experienced Judges. The two independent Decisions made it about as clear as can be that in New York State , local democracy rules. Local governments have a right to speak for the people of the town on matters of zoning and land use. Indeed , the Decisions were so clear that for a while we wondered if they would bother to appeal . At the last minute , Tom West announced that there would be an appeal , which is not really shocking for at least two reasons . One is that money is no object , and two is that it could be years until the case is actually heard, and in the meantime, Tom West can rattle his saber and continue to threaten towns across New York State , as they did in a recent flyer/ letter ® that they sent to municipalities all over the state warning them of the same looming threat of lawsuits. Page 14 of 15 TB 5 - 17- 12 Dryden would have been faced with an appeal that might have been potentially frivolous , but still would have been expensive, except that this good deed has been rewarded . We have been gifted with the expert legal services of one of the finest lawyers in America, Deborah Goldberg , and while such talent would have been a gift at any price, even better, this gift was free. Tonight, we are pleased to have Deborah visiting and we can thank her personally . We will have a reception following the meeting. " Cl Lavine presented Deborah Goldberg with a Dryden t- shirt . D Goldberg updated the board on matters related to the Anschutz lawsuit . In the Middlefield case , the plaintiff has have moved to renew the argument on the grounds of alleged ground-breaking legislative history that they found . That hearing will be held on June 1 . The date to perfect the Dryden appeal is May 29 . She expects to hear from Torn West seeking additional time, consolidation of cases , a new briefing schedule and so forth . Although it would be tempting to say no and move to dismiss the appeal for failure to perfect on time , she said it is important that Dryden be involved . Since the zoning amendment is in place and in effect and we have no particular stake in expediting this appeal , her opinion is that whatever time he gets for himself, we tell him we want equal amount of time for ourselves . The longer it goes, the better it is for us. We are not loosing anything as this moves forward . She will let the board know how things progress . D Goldberg said she has reached out to Tom West about the possibility of having an understanding that neither side would oppose friend of the court briefs. His reaction was that they would want to move to consolidate the cases , and see what the court says about this. So he is expecting the cases to be consolidated , but that doesn 't happen without action, so well wait to see what he does . Consolidation typically means that the briefs will come in at the same time . There will be just one oral argument. It doesn 't usually mean that there is only one person who will argue for either side, because there are different plaintiffs and there are different defendants . There is a savings of judicial resources because the court doesn 't have to show up twice to argue what is essentially the same legal position. She expects that will happen . Third Department makes the ultimate decision on consolidation . There could be a decision in the Middlefield case from the bench on June 1 , or it could take a while . D Goldberg said she is hopeful that the judge will recognize that what they've turned up isn 't very much different from what they had before , but we can never know for sure .
