Sumner Yes Cl makar Yes RESOLUTION 033 - ADOPT ORDER CALLING PUBLIC HEARING CORTLAND ROAD SEWER DISTRICT »'PENSION Cl Steiick offered the fallowing resolution and asked for its adoption: WHEREAS, a map, plan and report have been duly prepared in such manner and detail as heretofore was determined by the Town Board of the Town of Dryden, Tompkins Colonty, New York, relating to a proposed sewer district extension, pursuant to Town Law § 209 =c to the Town of Dryden Cortland Road Sewer District, and WHEREAS, said map, }plan and report have been prepared by T, C, Miller, P.C:., Engineers and Surveyors, duly licensed by the State of New York and have been filed in the office of the Town Clerk where it is available for public inspection, and WHEREAS, the area of said town determined to be benefited by said extension consists of the area of said town described as follows: Beginning at the northeast corner of the pillage of Dryden, Page I of �m 1 -s -08 • Thence, easterly about 1,270 feet along the extension of the Village of Dryden's northerly line to the centerline of Livermore Road; Thence, southerly about 540 feet along the centerline of Livermore Road to the southeast corner of Tax Parcel No. 37.- 1- 10.12; Thence, westerly about 1,273 feet along the south line of Iax Parcel No. 37.-1- 10.12 to the southwest corner of said parcel; Thence, northerly about 494 feet along the westerly line of Tax Parcel No. 37.-1- 10.12 to the point of beginning, and Containing fifteen (15) acres more or less, and WHEREAS, the proposed extension to the sewer district does not propose any improvements, and WHEREAS, the maximum amount proposed to be expended for the extension of said sewer district is $5,000.00 and the proposed method of payment of said amount is from only the properties within said sewer district determined to be benefited by said extension and described in the preambles of this Order, NOW, THEREFORE, IT IS HEREBY ORDERED, by the Town Board of the Town of Dryden, Tompkins County, New York, as follows: Section 1. A pL in said Town, on the consider the aforesaid the sewer district, and with the provisions of Law and Local Finance Lblic hearing will be held at the Town Hall, 93 East Main Street, Dryden, 18th day of January, 2008 at 6:30 o'clock p.m. prevailing time, to map, plan and report and the question of approving such extension to to hear all persons interested in the subject thereof, all in accordance Town Law §209 -d and applicable provisions of the General Municipal Law, Section 2. The Town Clerk is hereby authorized and directed to cause a copy of this order to be published once in The Ithaca Journal, the official newspaper of the Town, and also to post a copy thereof on the Town signboard maintained by said Clerk, not less than ten nor more than twenty days before the day designated for the hearing as aforesaid. Section 3. The resolution makes certain determinations that the hearing was posted and published, that the hearing is regular, that all the property owners within the extension are benefitted, and that the establishment of the extension is in the public interest. It will be known as the Cortland Road Sewer District: Extension No. 1 and be bounded according to the legal description in the map, plan and report. The adoption of that resolution by the board is subject to a permissive referendum. However, ® the only people who could trigger a referendum have to be located within the district. The board then reviewed the Short Environmental Assessment Form for this action. Page 2 of 4 TB 1 -s -0s RESOLUTION #34 - NEG SEQR DEC - EXTENSION OF CORTLAND ROAD SEWER DISTRICT Supv Sumner offered the following resolution and asked for its adoption: WHEREAS, A. The proposed action involves consideration of the extension of t:he boundaries of the Cortland Road Sewer District in the Town of Dryden. B. The proposed action is an Unlisted Action for which the Town Board of the Town of Dryden is the lead agency for the purposes of uncoordinated environmental review in connection with approval by the Town. C. The Town Board of the Town of Dryden, in performing the lead agency function for its independent and uncoordinated environmental review in accordance with Article 8 of the New York State Environmental Conservation Law - the State Environmental Quality Review Act "(SEQR), (i) thoroughly reviewed the Short Environmental Assessment Form (the "Short EAF "), Part I, and any and all other documents prepared and submitted with respect to this proposed action and its environmental review, (ii) thoroughly analyzed the potential relevant areas of environmental concern to determine if the proposed action may have a significant adverse impact on the environment, including the criteria identified in 6 NYCRR §617.7(c), and (iii) completed the Short EAF, Part II; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: I . The Town Board of the Town of Dryden, based upon (i) its thorough review of the Short EAF, Part I, and any and all other documents prepared and submitted with respect to this proposed action and its environmental review, (ii) its thorough review of the potential relevant areas of environmental concern to determine if the proposed action may have a significant adverse impact on the environment, including the criteria identified in 6 NYCRR §617.7(c), and (iii) its completion of the Short EAF, Part II, including the findings noted thereon (which findings are incorporated herein as if set forth at length), hereby makes a negative determination of environmental significance ( "Negative Declaration") in accordance with SEQR for the above referenced proposed action, and determines that neither a full Environmental Assessment Form, nor an Environmental Impact Statement will be required, and 2. The Responsible Officer of the Town Board of the Town of Dryden is hereby authorized and directed to complete and sign as required the determination of significance, confirming the foregoing Negative Declaration, which fully completed and signed the Short EAF and determination of significance shall be incorporated by reference in this Resolution. 2nd Cl Stelick Roll Call Vote Cl Stelick Yes Cl Solomon Yes Supv Sumner Yes Cl Makar Yes After the process of extending the district is complete TG Miller will prepare a new map, noting the parcels within the district that have been annexed to the Village.
