and an incomplete tape recording of the meeting.
Supv Varvayanis opened the meeting at 3:50 p.m. and explained that this was a special
emergency meeting. Cl Michaels was notified of the meeting but could not be present and had
no objection.
There was discussion regarding a model local law for classifying local roads, the
guidelines of which are an alternative to AASHTO standards. Copies of the model local law
have been distributed to Town Board members, the Town Attorney and Highway
Superintendent. The Planning Board will also be provided with copies and asked to provide
comment prior to June 5, 2002, when Cl Grantham intends to introduce it.
`Mere was discussion regarding whether to hire Darrell Harp, Esq., to give the Town
expert advice on highway issues. There is an opinion of the Association of Towns that indicates
the Town Board should be asked permission about litigation before any officer of the Town
proceeds. Atty Perkins said that neither Highway Law Section 140 or Section 319 say anything
about prior Board approval before the Highway Superintendent can bring an action to enforce
the Town's rights in the highways.
Board discussed possible solutions to the Freese Road /David Weinstein issue. Jack
Bush is working on a sketch of a possible solution to propose and has measured and marked
the road in front of Weinstein's property.
There was further discussion regarding hiring Darrell 'Harp for his legal expertise. Atty
Perkins indicated he is interested in having him as a resource, but would want written
disclosure that Mr Harp has not consulted the plaintiff's in the current litigation matter. It was
understood that Mr. Harp would not be taking over the responsibility for the current litigation.
RESOLUTION #ISO - AUTHORIZE SUPERVISOR TO HIRE DARRELL HARP
Cl Grantham offered the following resolution and asked for its adoption:
RESOLVED, that this Town Board does hereby authorize the Supervisor to contact: and
hire Darrell Harp to advise the Town regarding legal matters concerning Town roads and
litigation, on the condition that there is no conflict of interest (he has not consulted with the
' plaintiffs in any current litigation), at the rate of $200 per hour.
