part time paramedics_ 'There is a need for more part rimedics and in fact the Tou*rt has been

Janwk Bush stated he had no idea why it was on the Benda to a.coept a bid for pipe. He
has gone through the formal bidding process, opened sealed bids, and at the last meeting
asked the board to pass a resolution allowing him to accept the lowest responsible bid- For
whatever reasons, Mrs. McFall claimed that the board could not do that and so she has put it
back on the agenda, The resolution said that if the lowest responsible Nd was not in ex " of
$32,000 the Highway Supe=tcndezrit was authorized to accept it. Jack has spoken with the
Assodation of Towns and received some information from them. Atty Perkins has reviewed it.

It appears that the Highway Superintendent does not need the Board's approval for purchase of
materials, but in the past he has tried to communicate with Board and make sure things are
done the right way. He wonders what the neart step is; he needs the pipe. It has not been
ordered although the purchase order has been submitted. This is not the first time he has had
difficulty. The Highway Department is out of salt nova. A request was put iii at least a week
ago and he has not yet received any paperwork. He's left wondering what's going on until he
receives his copy back_ Supv Varvayanis will check on the matter toga c ro , Jack explained
that the frustrations is that this is not the first occurrence of this type of situation. He has been
trying Co wder salt In -zval.ter quautities because -the Town hug no sal11 storAr,, and only have it
delivered as its needed. This makes it difficult for Cargill, as they like to fill the entire order
when they receive a purchase order.
Jack believes there are problems with the purchase order system and that it should be
reviewed. The FO still has a line for a purchasing agent on it. He does not believe we have a
purchasing agent. The Department heads are the ones that are doing all the work to get the
hest prices and figure out where the product should came from. It should be the Department
Head's signature on it_ G1 T Ha,6eld suggested that perhaps it is time to review the system.
Supv Varvayatus stated the general purcha4ng policies are something that will be looked at by
the Little Grace Commission, which should be starting soon.
Items for next week's agenda;
1 Grantham has done a draft 12f"i} For the master plan work which she will distribute
tomorrow night, and would like that on the agenda for next week.

Atty Perkins has provided Supv Varvayanis with a draft of the Flood Hazard Mitigation
agreement to review and send on to the board. It is a generic form, and can be tailored to fit
specific circumstances.
Joseph Valentinelli, Town Justice, explained to the board some of the difficulties his
court encounters because of lack of space. The court room continually needs to be rearranged
because it is used for other meetings, such as board meetings. It makes for a. hectic time prior
to trial. Sometimes 30 and more prospective jurors are in the building. There is no place for
attorneys to conference with their clients or conduct meetings privately and often other offices
in the building are used by them. The Judges frequently are unable to access their own office.
Witnesses need to be kept separate at times of trials, and have had to use other offices in the
building and even in the Highway building. Pre- trials days are also difficult. for the same
reasons. Dryden has one of the busiest courts that there is in the County. When the Board
has had emergency meetings at 8:00 a.m. on a 9:00 am. court day, it has caused difficulties
for the Court. Judge Valentinelli offered to serve on a committee to see what can be done
t., Pale 6 of 33

about additional space. People working in this building are all impacted by the lack of space.
It is very frustrating for the Judges, their secretaries, and everyone in the building.
Cl Beck stated that he had brought this up a few months ago and we now have a
building committee.
Judge Valentinelli has visited other Courts in Lansing, Candor, Virgil, Ithaca and they
have nice complexes not only to accommodate the Court, but other Town offices. It is
important to have more space, not just for storage, but so that people can have a little privacy
while doing their work. People in this building are disturbed all the time. Cl Grantham
pointed out that Jean Ryan is on the building committee.
Judge Christopher Clauson explained that Jean Ryan will be retiring in May and he
needs to hire her replacement. It will take three or four months for a new person to get their
feet on the ground. He would like the board's permission to start interviewing for a
replacement for her and invited the board to attend the interviews. He has been looking and
believes there is a lot of experience out there and he feels that if he could have some sort of
competitive wage that he could get a good court clerk. Though Jean's salary is already in the
budget, a new person would not be started at that wage. Judge Clauson would like to put an
ad in the paper this week and set up interviews within the next week or two and make a
decision by February 1. He believes the minimum wage he would have to offer would be
$10.00 per hour plus health benefits.
Cl T Hatfield suggested that the ad state that the salary would be commensurate with
experience and the Judge Clauson establish a salary range and come back to the board to talk
about it. Ci T Hatfield acknowledged that it will be difficult to replace Mrs Ryan considering
her years of service, experience and knowledge.
Cl Grantham asked Judge Clauson to get information regarding what people are paid in
this position in other Courts in the area to justify a salary request. He will do that. He has a
few people who are interested and he is looking for experience.
Judge Clauson informed that Board that Bill George has taken a job at the airport, so
he is also looking to employ a new court officer. Mike O'Connell, who recently retired from the
State Police, has expressed an interest in the position.
Cl Grantham explained that the building committee met in December and has been
looking at building plans and is trying to obtain copies of space studies from Towns that have
recently built buildings. The next step will be to write an RFP to get a space study done.

RESOLUTION #161 = PROCUREMENT POLICY
Cl T Hatfield offered the following resolution and asked for its adoption:
RESOLVED, that the TOWN of DRYDEN does hereby adopt the following procurement policy
which is intended to apply to all goods and services which are not required by law to be
publicly bid, subject to further review:
1. a. Every purchase to be made must. be initially reviewed to determine whether it is a
purchase contract or a public works contract.
b. Once that determination is made, a good faith effort shall be made to determine whether
it is known or can reasonably be expected that the aggregate amount to be spent on the item of
supply or service is not subject to competitive bidding, taking into account past purchases and
the aggregate amount to be spent in a year.
c. The following items are not subject to competitive bidding pursuant: to Section. 102 of the
General Municipal Law:. purchase contracts under $10,000 anal public works contracts under
$20,000; emergency purchases; goods purchased from agencies for the blind or severely

handicapped; goods purchased from correctional institutions; purchases under State and
I(S county contracts; and surplus and secondhand purchases from another governmental entity.
d. The decision that a purchase is not subject to competitive bidding will be documented in
writing by the individual making the purchase. This documentation may include written or
verbal quotes from vendors, a memo from the purchaser indicating how the decision was
arrived at, a copy of the contract indicating the source which makes the item or service exempt,
a memo from the purchaser detailing the circumstances which led to an emergency purchase,
or any other written documentation that is appropriate.
e. This policy will apply to all equipment rentals made throughout the year with prior Town
Board approval per rental.
2. All goods and services which are the subject of this procurement policy will be secured by
use of written requests for proposals, written quotations, verbal quotations, or any other
method that assures that goods will be purchased at the lowest price and that favoritism will
be avoided, except in the following circumstances: purchase contracts over $10,000 and public
works contracts over $20,000; goods purchased from agencies for the blind or correctional
institutions pursuant to Section 175 -b of the State Finance Law; goods purchased from
correctional institutions pursuant to Section 186 of the Correction Law; purchases under State
contracts pursuant to Section 1.04 of the General Municipal Law; purchases under county
contracts pursuant to Section 103(3) of the General Municipal Law; or purchases pursuant to
subdivision 6 of this policy.
3. The time and docuumentation required to purchase goods and services under $1,000.00
through this policy may be more costly than the item itself and would therefore not be in the
best interests of the taxpayer. In addition, it is not likely that such de minimis contracts would
be awarded based on favoritism.
® The following are the minimum requirements necessary for purchases and /or equipment
rentals when the amount to be expended in any one year exceeds $1,000 as required by this
policy in order to achieve the highest savings:

include: 41
a.. Professional services or services requiring special or technical skill, training or expertise.
The individual or company must be chosen based on accountability, reliability, responsibility,
skill, education and training, judgment:, integrity, and moral worth. These qualifications are
not necessarily found in the individual or company that offers the lowest price and the nature
of these services are such that they do not readily lend themselves to competitive procurement
procedures.
In determining whether a service fits into this category the TOWN BOARD shall take
into consideration the following guidelines: (a) whether the services are subject to State
licensing or testing requirements; (b) whether substantial formal education or training is a
necessary prerequisite to the performance of the services; and (c) whether the services require a
personal relationship between the individual and municipal officials. Professional or technical
services shall include but not be limited to the following: services of an attorney; services of a
physician; technical services of an engineer engaged to prepare plans, maps and estimates;
securing insurance coverage and /or services of an insurance broker; services of a certified
public accountant; investment management services; printing services involving extensive
writing, editing or art work; management of municipally owned property; and computer
software or programming services for customized programs, or services involved in substantial
modification and customizing of prepackaged software.
b. Repair of equipment and machinery and maintenance items i.e.: toner, ribbons, oil filters,
nuts & bolts etc. These can be specialized items. The purchaser will obtain at least two verbal,
written, faxed or catalog prices. It is up to the purchaser which product to purchase.
c. Emergency purchases pursuant to Section 103(4) of the General Municipal Law. Due to •
the nature of this exception, these goods or services must be purchased immediately and a
delay in order to seek alternate proposals may threaten life, health, safety or welfare of the
residents. This section does not preclude alternate proposals if time permits.
d. Purchases of surplus and secondhand goods from any source. If alternate proposals are
required, the purchaser is allowed to purchase surplus and secondhand goods at auctions or
through specific advertised sources where the best prices are usually obtained. Prior Town
Board approval is required for amounts over $1,000.00.

actions the Town will undertake to meet this requirement.

Cl Granthamm spoke about the Fall Creek Watershed Committee. It is a grass roots
committee and she has been attending the meetings when she can. A lot of the people involved
in it are Dryden people. The Town did a letter of support earlier in the year for an application
through the Tompkins County Water Resources Council to get funding for a cleanup along the
creek. That was funded and the Committee will be doing a Fall Creek cleanup in the Spring.
They are now working on a proposal to get some funding to do some stream bank stabilization
demonstration projects for homeowners along Fall Creek. Matt Shulman has volunteered to
help with this proposal which is due January 17. If funded, the committee will do one or two
projects in Fall Creek, and workshops will be open to anyone who is interested in learning how
to do it on their property. Sharon Anderson has ordered 1,000 willows for stream stabilization.
