Marshall Taylor, E1 Turkey Hill Rd. - expressed his support for
the moratorium on adult entertainment. I know Lansing and other
towns in the county have been moved by what has happened in
Groton and it makes sense to take a look at this issue and not
have something sneak up.
Supv Schug - the moratorium will be in place and then go the
Planning Board and Zoning Board of Appeals for their review and
input to the town board as to what they feel is appropriate.

Z.O. Slater - this is the first experience where there is a home
and a business facility that are on the same property that are
connected. For my own purposes for the application I drew the
line through the connection and treated the house as the house
and the business as the business. I was asked to look at the
Christmas tree situation and looking around the town there are
people that sell Christmas trees, and do every year. I thought we
need to treat them all of the same. If we tell Bob he can't sell
Christmas trees then we would have to tell everybody else that is
selling trees. It has never been the towns position to do that
and we have never considered doing that. I didn't feel we should
40 change that for this particular situation just because the house
and the business are right next door to each other. There is a
separate address and that is the judgement I used.

Atty Perkins - Henry's approach is no harm, no foul until someone
complains with respect to the Christmas trees. It could be argued
that since it is not a specific enumerated use it is not an
allowed use. That is one position that could be taken. I don't
think the sale of Christmas trees fall into allowed uses
described as a greenhouse or a nursery unless he grows them there
and harvests them and offers them for sale at the same location.

CITIZEN PRIVILEGE OF THE FLOOR
Lonny Palmieri, Lake Manager - went over project that is going on
at the Owasco Lake Watershed. The Town of Dryden is a participant
in this project. One of the reasons for the project is to produce
a management plan for the watershed. They will look at the
watershed in terms of resources of the water running through it.
This project is hoping to acquaint upstream and downstream users
with each others situation and to address issues and concerns
with local communities. This project is driven by the EPA. In the
early AO's when the Clean Water Act was signed said that every
watershed had to have a State of the Lake Report to receive
funding for water issues. EPA has decided that the State of the
Lake is a requirement and the initial reason for everyone getting
on board. The State of the Lake is a report that will be a
requirement. The first step is to identify everyone who has a
stake in the watershed. The second step is to identify watershed
issues and lake issues. The third step is to compile a State of
Owasco Lake Report. This report will contain scientific
information about the lake, a description of the watershed, and
land uses, and summaries of resident's issues and concerns. The
fourth step is to generate recommendations using the State of the
Lake Report. The recommendations on which the stakeholders will
be used to build the Watershed Management Plan. The last step is
to create an action plan reflecting community priorities for the
watershed and recommendations for implementation.

CAYUGA LAKE WATERSHED NETWORK
® WHY DID *IT GET STARTED AND WH.N?
In the spring of this year (1997) people living in the Cayuga Lake
watershed recognized that communities in the watershed would be at
a decided disadvantage in regard to allocation of Clean Water,
Clean Air Bond Act funds, compared to other Finger Lakes, if there
was no organized citizens group to speak for the needs of the
Cayuga Lake watershed. Each of the other ten Lakes has such a
group. The Cayuga Lake watershed is the largest in the Finger
Lakes (722 sq. mi.) and includes parts of 5 counties and .40
municipalities partially or wholly in the watershed.
It was-recognized that a watershed network could make a difference
in stemming the rising tide of local property taxes by assisting
multi - community collaboration, avoiding duplication of services and
tieing together environmental and economic partnerships.
HOW DID IT GET STARTED?
The network began with phone calls to identify individuals in the
3 principal watershed counties - Cayuga, Seneca, Tompkins- who would
be willing to volunteer their time to participate in a temporary
steering committee to consider the pros and cons of a network. Two
goals were emphasized from the start - -that we would strive for
approximately equal representation from all three counties and that
we would emphasize the positive nature of the network -- established
to be for things that benefit the watershed and are cost effective,
not to oppose specific actions or activities.
Six meetings since June have circulated around the watershed and
have included many stakeholders, including local officials.
However, we intend that the network be a not -for- profit citizens'
organization of individuals, groups and businesses, including, but
not dominated by government agencies or officials.
Representatives of other watershed groups -- Canandaigua, Keuka,
Seneca -- have informed us about their activities and we have
discussed _structure, activities, issues and membership. The
network is now organizing itself into a more formal structure,
has adopted a mission statement and during the coming year expects
to involve a significant number of individuals.and groups to work
with local governments and local agencies in the shared task of
maintaining and improving the ecological health, economic vitality
and beauty of the watershed environment.
HOW DO I JOIN THE NETWORK OR KEEP INFORMED ABOUT WHAT IT IS DOING?
Easy. Just give your name, etc.,to Tim Pezzolesi of Cayuga County
Cooperative Extension who is serving as secretary for the network.
There is no obligation and nothing to pay.

municipalities adopt regulations or is it voluntary.
Lonny Palmieri - it is voluntary at this point.
Clp Grantham - these watershed management plans are not
regulatory. What is driving them is the promise of funding or the
threat of riot getting funding for doing any kind of environmental
management. It is coming from the federal level of the
Environmental Protection Agency through the State Department of
Environmental Conservation and at some point when we want money
from the state to do various projects we won't get it unless we
have participated in a watershed management planning process such
as this. Kekua Lake has done a huge amount of watershed planning
and one thing they did was draft local laws and all of the
municipalities in the watershed agreed to adopt the same local
laws regarding their watershed management activities so they are
all operating under the same laws, but they are all local
municipal laws. They are not state, federal or regional laws. The
funding is shared as well. I don't think these watershed
management plans have that intent initially, but I do think non
point source pollution is a problem in every community. It is not
regulated for the most part, but it is a problem and a major
problem in every community. However, there are regulations that
are coming and I think that in a few years we will be regulated
®from the federal and state levels unless we have already managed
to put our own plans in place. One of first ones to get regulated
probably will be the farmers.
.Janet Hawkes - spoke on Cayuga Lake watershed - Cayuga Lake
watershed includes 42 municipalities and included in that are 36
towns and villages. It is about 700 square miles. There are a lot
of issues and a group is looking at those. The organization has
talked about the future for the lake and some of the issues that
are concerns. There isn't a management plan in the future, but
may help contribute to that if one gets started. Cayuga Lake is
the largest of the Finger Lakes and does not have a management
plan or a lake association. We are not available for bond act
funding sin there is some initiative for the neighbors. They are
interested in communication, education and trying to provide some
leadership.

guests a video tape of tributary 14a flood.
Supv Schug - Henry is checking the map to get all of the names
and addresses of the people who would be affected by the stream.
Atty Perkins will put together what is entailed'and let everyone
who lives in the area knew and hold a public hearing and vote on
a watershed protection district. They would also have to
•understand that on some basis they would be responsible for
paying a portion of fixing the stream. It would also give us the
opportunity to get some minney from the county or state to help
defray some of that cost_

already visited this issue. What Mr. Hatfield asks is that the
town amend its mobile home ordinance to permit pre HUD era homes
to be placed in the Town of Dryden upon inspection. Currently pre
HUD era homes are allowed to remain at their present location.
They can not be moved or relocated. If they are moved they must
be from the Town of Dryden. They may be replaced by a HUD era
home. The position of the town was a legislation decision enacted
when the town enacted the mobile home ordinance. They decided to
improve their housing stock by phasing out pre HUD era homes in
not allowing them to be replaced in the Town of Dryden or recited
in the Town of Dryden or brought into the Town of Dryden. If the
board wants to revisit this issue for the third time it certainly
can. On the two prior occasions they decided not to make a
legislative change.

these people who own these units.

Co. Rep. Evans - public safety will be going to a home monitoring
system for certain people in the jail on the 1st of January.
These will be non violent individuals. This is in regard to the
problem we have, since we are boarding out 41 prisoners with the
jail at full capacity. It is costing the county about $900,000.00
a year to do this and this is an attempt to reduce those costs.

type programs
that are already

We left it with the
agency people to
put
together a
draft plan
for a program here in
Dryden. We will
meet
again the third
week
in
January. At that
meeting we will
look
at the draft
plan.
Clp Grantham - reported that Carol Ast from 9 Hunters Lane put a
news item in the Ellis Hollow Gazette in asking people in the
neighborhood if they were having problems with their wells to
contact her. At this point she has received very limited
response. People down hill are not having a problem because their
wells are in a shallow aquifer. The people above her are having
problems because they are using bedrock wells so they are all
using the same water and having trouble. She was supposed to
write a letter addressing their concerns and how they would like
the town to address things in the future. One process the town
could go through when they look at subdivisions concerning water
availability.

move closer, which I did not blame him for, I disqualified
that applicant.
During the past two weeks, I interviewed 3 more persons who
were qualified, Also, there were L additional unqualified
applicants who said they were willing to learn. Since we had
(4) qualified applicants, I did not consider the two
Unqualified persons,
Of the four persons we interviewed, one Kevin Ezell, clearly
stood out above the rest. Kevin is currently working as Code
Enforcement Officer and has seven years plus experience and
comes highly recommended by the New York State Codes Division
and the City of Cortland Codes and Fire Department.

Dear Jim:
Please find attached copies of 3 correspondence that I have received
this week which address the special permit application of Robert
Lehto, Sr. who requests authority to open a used furniture store
within an existing 937 Dryden Road commercial structure.
Briefly, Dave Putnam, T G Miller, reports no concerns as no structure
or site improvements are proposed. The Tompkins County Planning
Department provides a similar- opinion leaving the Board to act as it
sees fit.
.The third opinion is provided by Mary L. James of 936 Dryden Road, an
adjacent project site neighbor. Mrs. James speaks of existing noise
from the surrounding commercial neighborhood and feels that Barter
Bob's will only further aggravate her quality of life_

commercial
and
residential
neighborhood.
Noise
and

inconveniencies
may
be
adequately
mitigated
by
conditions

storage
or
display
of
goods
as
well
as
any
the
Board
may
deem
appropriate.

memorabilia,
There are 3 parking spots in front of the building and there are two additional spaces in
the back of the building. As you can see there is ample parking to accommodate this need.
There should not be more than five customers at any given time.

5) Since the building is existing, the sewage and water needs are existing also. No changes are
needed for this, therefore no certificates of approval are needed by TCDFI.
6) The neighborhood around 930 Dryden Road has several different kinds of uses. Attached to
this building is my place of residence, 928 Darden Road. On the opposite side of the building is
a used car lot and directly across the street is Varna Inn and Auto Service.
7) Due to the nature of a used furniture business there should be no increase in traffic. 1 would
like to place a small sign on the building itself It is our true belief that any deliveries made will
not affect any traffic or harm the neighborhood in way. As far as any future development of the
neighborhood, most of the land is at it's maximum capacity and there doesn't seem to be any
room for growth in this area.

C>. if at any time prior to the issuance of any above permit or authority to
proceed has been granted, it is found that CONSTRUCTION or OCCUPANCY has
begun or taken place, the violator and property owner will be PROSECUTED
in a court of law by this office or the Dryden Town Legal Authority.
4). After necessary permits have issued, if it is found that any holder of
any permit takes occupancy, opens its doors to the public or uses a
permitted device without obtaining a CERTIFICATE OF OCCUPANCY or
CERTIFICATE of COMPLIANCE, the holder of that permit will be PROSECUTED
in a court of law by this office or the Dryden Town Legal Authority.
5). In summary, no violation or noncompliance of either- the Dryden Town
Zoning Ordinance or the New York State Building & Fire Prevention Code
will. be tolerated by the Town of Dryden. No violation of any local,
county, state or federal law or regulation will be tolerated either.
Action will be taken against all. violators. Penalties for such
violations are, $1.00-00 per day not more than 15 days in ,jail, or both.

TOWN OF DRYDEN TRAFFIC ORDINANCE
1.) This Ordinance shall be known ad cited as the Town of Dryden Traffic
Ordinance.
2.) This Ordinance is adopted pursuant to Article 41 of the New York Vehicle
and Traffic Law and Article 9 of the Town Law.
�.) This Ordinance shall apply to all the Town Highways outside of the Villages
of Dryden and Freeville.
4.) Upon the recommendation and report of the Town Highway Superintendent
indicating that it is in the public good and in the best interests of the
Town road in question, the Town Board may by order:
(a) Temporarily exclude from any portion of any Town highway any vehicle with
a gross weight of over four or more tons or any vehicle with a gross weight in
excess of any designated weight on any wheel, axle, any number of axles, or per
inch width of tire when in its opinion such highway would be materially injured
by the operation of any such vehicle thereon. Such exclusion shall take effect
upon the erection of signs on the section of highway from which such vehicles
are excluded, and a notice that such vehicles are excluded shall be published
in the official Town newspaper. • The exclusion shall remain in effect until the
*oval of the signs as directed by the Town Board. Upon written application
any operator of a vehicle subject to this section, the Town Board may issue
ermit providing appropriate exemption to such vehicle, if it is deemed that
said vehicle is performing essential local pickup or delivery service and that
a failure to grant such permit would create hardship. Every such permit may
designate the route to be traversed and contain other reasonable restrictions
or conditions deemed necessary. Every such permit shall be carried on the
vehicle to which it refers and shall be open to inspection of any peace
officer, acting pursuant to his special duties, or-to any police officer. Such
permits shall be for the duration of the restriction imposed under this
section.

punishable by a fine not less than three hundred -fifty dollars nor more

not less than seven hundred dollars nor more than one thousand dollars or

UNDER THE UNIFORM FIRE PREVENTION AND BUILDING
CODE AND OTHER ORDINANCES AND LOCAL LAWS
1_ Introduction.
(a) LDCal law No. 1 of the year 1999 adopted by the Town
Board of the Town of Dryden on May 10, 1988 and effective May 1E,
1988 authorizes and empnwers the Town Board by Resolution to adopt,
amend, supplement, change, modify and repeal procedural rules for
the enforcement Of such local law. Bach local law provides for the
enforc�Pment by the Town of Dryden of the New York State Uniform.
Fire Prrevention and Building Code (herein the Uniform Crde).
(b) The fob. lowing procedural rules shall pertain to such
enforcement by the Code Enforcement Officer CEO) and the other
individuals designated and authorized to administer and enforce the:

(c) The applicant shall notify the Tawn of Dryden of any
changes in the information contained in the application during the
period for which the permit is in effect. A permit shall be issued
when the application has been deterinined to be C�Dmplete and when
the proposed work is determined to conform to the requirements of
the Uniform Code. The aLtthority conferred by 51.ich permit rni�iy be
limited by conditions, if any, contained therein.

3. Certificates of Occupancy and Completion.
(a) Upon completion of all pr%Gjects for which a building or
demolition permit has been iSSUed, the property owner shall obtain a
certificate of occupancy or completion. No biLrilding erected subject to
the Uniform Cade and these Rules shall he used or occupied, except to the
extent provided in this seCtiGil, until a Certificate of occupancy has been
issued. No building similarly enlarged, extended, or altered, or upon
which Work has been performed which required the issuance of a building or
demolition permit shall be Occupied or 115ed for more than thirty {30} days

The following determination and resolution were respectively
made and adopted by the Town Board of the Town of Dryden, to wit:
DETERMINATION
WHEREAS, the Town Board caused notice of public hearing to be
published in The Ithaca Journal, the official newspaper of the Town
of Dryden on October 31, 19971 to consider the advisability of
adopting a resolution, in accordance w1th the provisions of Section
209-b of the General Municipal Law, authorizing the SLATER ILLE
VOLUNTEER FIRE COMPANY, INC. , to furnish general ambulance service
far all of the residents of the Town cf Dryden, and
WMREAS, a public hearing pursuant to such notice was held on
November G, 1997, and which said notice of hearing described: (1}
the general ambulance servk%e which is proposed to be furnished,;
(2) the area to be served; (3) the names of the fire company
affected; {4} the time and place within the Town where such hearing
will be held, and (3) that all persons residing within the area to
be served or persons, firms and corporations owning real property
within the area to be served, or persons, firms and corporations
whose business interests or employment would either be benefitted
or adversely affected, whether or not a resident or owner of real
property within the area to be served shall, have the night to be
heard in person or by representatIve at the public hearing, and at
which public hearing it was pointed out that the Town of Dryden was
served by several other Fire companies which did not provide
general ambulance service to the area proposed to be served by the
Slaterville Volunteer Fire Company, Inc. and the -understanding
between the Town and the Slaterville Volunteer Fire Company, Inc.,
was that the fire protection contract is to be entered into

1996, there is anticipated substantial growth in the erection of
telecommunication towers and there has been interest concerning the
construction of such towers within the Town of Dryden, and
WHEREAS, the zoning ordinance of the Town of Dryden makes no
reference to permits for the construction of telecommunication
towers, and
WHEREAS, in order to preserve the status quo pending a study
of issues it recommended that the town board enact a local law
establishing a three (3) month moratorium on the filing of

construction of telecommunication towers within the Town of Dryden,
and
WHEREAS, the town board will immediately commence a complete
study and review of the Town of Dryden Zoning Ordinance as same
would apply to the issuance of building permits for the
construction of telecommunication towers in the town, and
WHEREAS, a reasonable time for the town board to complete
their aforementioned review and for the town board to enact any
required legislation resulting therefrom is three (3) months from
the date such local law enacting said moratorium is filed with the
office of the Secretary of State,

ON PROPOSED LOCAL LAW NO. 4 OF THE YEAR 1997
LEGAL NOTICE IS HEREBY GIVEN that the Town Board of the Town
of Dryden will hold a public hearing at the Town Hall, 65 East Main
Street, Dryden, New York, on the 9th day of December, 1997, at 7:45
o'clock P.M. prevailing time to hear all interested parties and
citizens for or against a proposed local law prohibiting the
issuance of building permits for the construction of
telecommunication towers within the Town of Dryden for a period of
three (3) months while the Town Board considers adopting
regulations for such construction.

SECTION l: Title
This local law shall be referred to as the "Moratorium for the
Establishment of Adult Uses”.
SECTION 2: Purpose
The Town of Dryden Zoning Ordinance establishes zoning
districts and regulations concerning the use of land and
structures. The statutory grant of power to regulate the use of
land and. structures includes among the purposes of such regulation
promoting the health, safety, morals or the general welfare of the
community. The Town Board is concerned that the lack of specific
regulation of adult uses of land and structures may result in the
attempted establishment of an adult use in an undesirable location.
The Town Board also recognizes that there are important
constitutional issues and protections which must be identified and
addressed in any regulation of adult uses. In order to address all
concerns and issues in a lawful, thoughtful and reasoned manner the
Town Board determines that it must declare a moratorium on the
establishment of such uses pending the review and enactment of
appropriate legislation regulating the same.
SECTION 3: Definitions
(A) Adult use. An adult use is the use of land or structures
for an "adult entertainment business" or an "adult physical contact
establishment" as herein defined.
(B) Adult entertainment business:
® (1) A public establishment which features topless
dancers, nude dancers or strippers, male or female.
(If additional space is needed, attach pages the same sire as this sheet, and number each.)

(2) A building or structure used for presenting,
lending or selling motion picture films, video
cassettes, cable television, or any other such
visual media, or used for presenting, lending, or
selling books, magazines, publications,
photographs, or any other written materials
distinguished or characterized by an emphasis on
matter depicting, describing or relating to
"specific sexual activities" or "specific anatomical
areas" as hereafter defined.
(C) Adult physical contact establishment. Any establishment
which offers or purports to offer massage, whether or not licensed,
or other physical contact by members of the opposite sex. Medical
offices, electrolysis, karate, judo and dance studios are not
"adult physical contact establishments ".
(D) Specified sexual activities:
(1) Human genitals in a state of sexual stimulation or
arousal; or
(2) Acts of human masturbation, sexual intercourse or
sodomy; or
(3) Fondling or other erotic touching of human
genitals, pubic region, buttock or female breast.
(E) Specified anatomical areas.
(1) Less than completely and opaquely covered human
genitals, pubic region, buttock, and female breast
below a point immediately above the top of the
areola; or
(2) Human male genitals in a discernible turgid state,
even if completely and opaquely covered.
SECTION 4: Scope of Controls
(A) During the effective period of this local law:
(1) The Town Board shall not grant any approvals by
means of a special permit, site plan review, zoning
change or otherwise for the establishment of an
adult use.
(2) The Town Planning Board shall not grant any
preliminary or final approval to a subdivision plat
or any other approval which would result in the
establishment of an adult use.

® (3) The Town Zoning Board of Appeals shall not grant
any variance for any use which would result in the
establishment of an adult use.
(4) The Code Enforcement Officer shall not issue any
permit which would result in the establishment of
an adult use.
(5) No person, firm or corporation shall establish or
use any land or structure for an adult use.
(B) The Town Board reserves the right to direct the Code
Enforcement Officer to revoke or rescind any Building Permits,
Certificates of Occupancy and /or Certificates of Compliance issued
in violation of this local law.
SECTION 5: No Consideration of New Applications
No applications of any kind for the establishment of adult
uses as defined in this local law shall be considered by any board,
employee or other representative of the Town of Dryden (whether
elected or appointed) while this local law is in effect.
SECTION 6e. Term
This local law shall be in effect for a period of 180 days
from its effective date or until the enactment of a comprehensive
set of regulations pertaining to adult uses, whichever comes first.
SECTION 7: Penalties
(A) Any person, firm or corporation that
adult use in violation of this provisions of

Section 1 Tbree (3) month moratorium. There is hereby
enacted a three (3) month moratorium on the acceptance by the Town
of Dryden Code Enforcement Officer of applications for the review
® of plans for the construction of telecommunication towers and the
issuance of building permits therefor.
Section 2. Definitions. For the purposes of this local law,
a telecommunication tower shall be described in and governed by
Telecommunication Act of 1996,
Section 3. Superseding. a)Pursuant to the powers granted by
Municipal Home Rule Law, this local law supersedes and suspends the
provisions of Article 16 of the Town Law, including specifically
Sections 267; 267 -a; 267 -b; and 267 -c insofar as they are
inconsistent with this law.
b) All ordinances, local laws and regulations of the Town of
Dryden in conflict with the provisions of.this local law are hereby
superseded to the extent necessary to give this local law full
force and effect.
