MAY 13, 1997
Supv Schug called the meeting to order at 8:30PM
Members

Allegiance.
Roll call was by Town Clerk Lloyd
Present: Supv Schug, Clp Grantham, Clp T. Hatfield, Clp C.
Hatfield, Atty Perkins, Z.O. Slater and Hwy Supt Gilbert
Absent: Clp Roberts
Supv Schug appointed Clp Grantham to audit the general fund bills.
COUNCILMAN PRIVILEGE OF THE FLOOR
Joan Portzline - Portzline Real Estate - gave board members
information about Davall property. (copy in minute book)
Joan Portzline - I had received a phone call from Supv Schug
expressing interest that the town might have in land that Davalls
owned on Lake Road. Initially Davalls had the 89 acres for sale
for $375,000.00 and would not split it. They wanted to sell the
whole parcel. Later they decided they might be willing to sell the
south part of the land. They were also considering in doing a
Isubdivision. rent over map with board members. Lots E & F 4.75
acres each were $25,000.00 per lot and they might consider lot G
for $40,000.00 which would bring the south end of Dryden Lake to
about $90,000.00. Davalls had an offer lot D which was a cash
deal. I notified the town there were 2 offers on the land that
were alternating lots and the town would have to come in above the
$50,000.00. (lots F & H). If I could convince the person who
bought lot F to move to lot G maybe they will reduce the price and
if the town wanted to purchase E & F maybe something like that
could be worked out. The Davalls wanted to give the town the
opportunity even though they had 2 cash deals. I had convinced the
proposed buyers to wait because as a courtesy we wanted to
approach the town one more time. The Davalls have closed on lot D
and then went on vacation. While they were gone the towns offer
came in so I contacted the Davalls and told them what the towns
offer was and asked them if they wanted to counter offer. They
said absolutely not, lets go ahead because we don't want to lose
the other 2 deals. The town is not offering us any more for the
whole thing than what we have for 2 residential parcels. Since the
Davalls were out of town I had their daughter Cherie write the
town a letter refusing the towns offer. The reason for the delay
in accepting the other 2 purchase offers was so the town would
have that information for your April meeting. The purchase offers
are signed contingent upon subdivision.

Joan Portzline - there are still 2 lots left E & G. I do have
someone interested in purchasing 3 acres on lot E. Asked the board
if they had any interest in any of the other lots.
Supv Schug - the town has interest in using the lots for the
bicentennial.
ATTORNEY
Atty Perkins - Cortland Paving (ottenshot) - we are just finishing
up the discovery process.
Atty Perkins - Supv Schug asked me to look over the William and
Millie Reed connection agreement to the Turkey Hill Water /Sewer
district. The Reeds agreed at the time they were given permission
to build a 4 unit apartment on their property at 1065 Dryden Road
that they connect to municipal water. They have since been ordered
by the health department to make the connection. I wrote to the
director of environmental health, John Anderson regarding the
towns position and was told he will take care of that. This would
be a county £unction as far as the connection goes.
Supv Schug - was concerned since the town had an agreement with
the Reeds that they would hook up to the water as soon as it
became available and it still has not been done.
Atty Perkins - they would hook up within so many days after they
were ordered by the town, that is correct.
Supv Schug - wanted to know if the town should send them an order.
Atty Perkins - no, did not know what the town concern is. The
health department should be sending them the order. If you want to
we can.
Supv Schug - wondered why we signed an agreement with the Reeds
then they were not made to hook up to the water.
Atty Perkins - you signed a contract so they could get a permit to
build a 4 unit apartment house. They were originally going to
install improvements to connect the apartment house to the Monkey
Run water /sewer district.
Supv Schug as soon as the Reeds hooked up to the Monkey Ruff
sewer the town paid them based on the 10 year depreciation plan
for the sewer.
Atty Perkins - the town purchased from the Reeda the depreciated
value of the sewer lines. I don't understand the towns concern
about hooking up to the water, we are not selling the water Bolton
Point is.

Supv Schug my Point is, the health department would have to have
00 the Reeds hook up to the water. With the people moving into the
apartment doesn't the town have a responsibility there. Is it up
to the health department?
Atty Perkins - correct, it is up to the health department. The
town is getting the benefit assessment from that property. I am
not sure what the towns interest is it the health department is
going to pursue it. If you want me to pursue it I will be happy to
do it.

Atty Perkins � this town board let them off the honk the first
time and they -thought they were off the hook for good, because you
didn't make them live up to the original contract. They came in
here and pleaded poverty and they didn't want to hook up because
they didn't want to spend money twice and it was going to be
eensive etc. So there is an amendment to the agreement and the
amendment said they will make the required connections to the
Turkey Hill water district at their own cost and expense at such
time they are directed to make such connection by said water
district. IE you have directed them to do that and they haven't
done it fine, lets pursue it, you can force them to do it.

him know that if the road is not completed by June 6th the town
will utilize his money that was set aside for this purpose.
Atty Perkins - the town has the money to do the work Ralph is
supposed to do with respeot to the road. The town also has the
authority to issue no building permits until he has constructed
and installed the sewer meter.

Unsafe stxucture - Lipinsky - in compliance
.D. Slater � R. Hatfield, 207 Sweetland Road - Roger Hatfield
wrote to the Supv with a copy to the board members regarding his
alleged double wide mobile home. This st,ructmre is neither a
mobile home, modular home or any other recognized residential
dwelling knit. This is not the first time I have been down this
road with this particular applicant. I don't think there is any
question the applicant has the knowledge of what a HUD approved
home is and what it is supposed to be. I even volunteered that
once he found a home we would go and look at it before it was
moved to the Town of Dryden just to avoid the situation.
Clp C. Rat-field - wanted to know who owns the home.
Z.O. Slater w the applicant alleges that it is going to be a
tenant and the tenant, owns this particular structure and Roger
told me he owns it. I don't really know. I know where it came
from. It came from Lake County Dommunity formerly Pariwood
Village. These were a special build to order project for the
winterly�agias in Lake Placid. I have issued a stop work order
and handed the violation to the court system. Actually that home
can not go anywhere in Nei York State. Roger asked the Town Hoard
to change our local legislation to agree with what New York State
recently did. Since this structure was built after June 15. 1976
it must conform with HUD requirements. it is not subject to the
exemptions to HUD because it was built after that date. The serial
number Roger represented Titan nevar heard of, nor could it be a
Titan serial number because it is totally incorrect and does not
have the state configuration letters or numbers or plant numbers.
There is a way for tracing a HUD home by taking the stamped serial
number which is on the frame, go back to the manufacturer and you

There was discussion regarding Hovanec Pleasant Mountain proposed
subdivision of Mt Pleasant Road_ The Town Hoard recommended to the
Planning Board that the developer transfer unusable property to
the Finger Lakes Land Trust, however the town does want an
easement to own that portion of the property which is the
abandoned railroad property,

The reason that our office initially rejected the proposed stricture
is, structure home does not have a HUD Certification label attached in

The plant that built the home is required to maintain the original
construction details for an indefinite period of time. For an
example, if this subject home had a serial #, all a person would need
to do is provide Titan with that serial number and a duplicate data
package could be provided. That package would provide, serial
numbers, HUD Certification numbers assigned to the unit or units,
insulation valves, snow loading, wind loading, configuration details,
climate zones approved for and so forth. Titan as well as all other
manufacturers of mobile homes are required to maintain these records
and provide details upon receipt of a serial number inquiry.

• In the late 197 0's a person by the name of Patrick Kennedy, at the
time owner of Parkwood Village Mobile Home Park on Hanshaw Road, Town
of Dryden, obtained a contract to provide mobile temporary housing for
the 1980 Winter Olympic games held in Lake Placid, New York. Since
these structures were needed only for a few weeks, these structures
would be leased. The contract provided that the supplier would bring
these structures to Lake Placid and then remove the majority of these
structures at the conclusion of the Olympic games.

In summary, it remains my opinion, this 207 Sweetland Road structure
is not a mobile home. Mr. Hatfield and the Town of Dryden have been
engaged in a battle over the installation of a Non HUD approved mobile
home at 205 Sweetland Road since 1995. Mr. Hatfield has been advised
of HUD Certification requirements by this office on numerous
occasions, therefore he either is aware or should be aware of HUD
Certification requirements. This leads me to believe that he
previously has and continues to have total disregard for the Dryden
Town Zoning Ordinance, the New York State Fire Prevention & Building
Code and the general safety of his tenants and the community.
Further, this abuse of public safety must stop! This problem with
Mr. Hatfield occurs far to often.
By the provision of Dryden Town Mobile Home and Zoning Ordinance
Article II Section 2048, I would ask that the Town Court find the
defendant Guilty order removal of this home from the Town of Dryden
and assess an appropriate fine for this intentional, fraudulent act.

On January 30th of this year, our office in writing notified
Mr. Lipenski of our concern and his responsibility, establishing
May 1st as a bead line for demolition and site restoration,
Again, on March 10th, 1997 we sent Mr. Lipenski a reminder of the
concern and the May 1st dead line. To this time, we have not
received any response from Mr. Lipenski nor has there been early
effort to resolve the immediate concern for public safety.
Based on our concern for the pubsis safety of the Etna Community,
I would request the Town Board pr -oceed with public demolition of
the fire damaged remains at 16 Lower Creek Road including the
remaining structural debris and fire debris including as burned
out motor vehicle,

Z.O. Slater - wanted to know if the board had any input for the
sketch conference subdivision regarding Ron and Marilyn Davall.
Supv Schug - the board would like to have a full EAF form filled
out by the applicant.
Atty Perkins - Supv Schug has asked me to take a look at the
sketch the developer has proposed and there might be some issues
the Planning Board might want to address at some point in their
review including the issues of wetlands and setbacks. On site
septic systems, the lake, make sure there are buildable lots
there, site distance along Lake Road and access along Lake Road,
driveways instead of none so they should consider some other way
of getting onto these lots.

Clp Grantham offered the following resolution and asked for its

RESOLVED, that this Town Board authorize Hwy Supt Gilbert to
attend highway seminar at Cornell University on June 6th and to
pay expenses. Cost for class is $65.00.

Hwy Supt Gilbert - has letter from Dept. of Planning, Tompkins
County for a flood hazard mitigation program. The amount is
$25,000.00 and to receive this there has to be a committee set up.
Supv Schug - recommendation was made that the town work with the
Village of Dryden. The committee will be Don Gilbert, Henry
Slater, possibly Dan Karig and myself from the town and Reba
Taylor and John Bradley from the village.

TO SELL EQUIPMENT AT AUCTION
Clp C. Hatfield offered the following resolution and asked for its
adoption
RESOLVED, that this Town Board authorize Hwy Supt Gilbert to sell
at auction the old forklift and a 1962 Brockway truck.

Hwy Supt Gilbert - Ferguson Rd culvert by Cook's will put a
sleeve in and grout rather than digging up the highway. The coat
will be about $3,059.00.
Hwy Supt Gilbert - George Road bridge - will have to work with the
county.
Supv Schug - The cost for the decking with the membrane is
011,905.00. The cost for crecsota, tong and grove yellow pine is
t10,935.00. The soteel decking would probably be better even though
it is only 0900.00 more. We asked the county if the bridge could
be widened and questioned the under pinning.
Supv Schug - Keith Lane bridge pipe has to be replaced.

Clp T. Hatfield offered the following resolution and asked for its
adoption:
RESOLVED, that this Town Board express our appreciation to
Councilman Ron Roberts for all his service and dedication to the
town from January 2, 1990 to May 13, 1997.

Supv Schug - Recycling center on Peruville Road - I have not
received any correspondence requesting the recycling center to
stay open. I did promise Groton Town Supervisor, Theresa Robinson,
that I would bring this matter up again at the next town board
meeting even though our town board was not interested in keeping
the center open. Board members have copy of information regarding
the operation of the recycling center. It would cost the Town of
Dryden taxpayers 84,211.00 to keep it open. The board decided not
to continue to keep it open.

WHEREAS, the Town Board of the Town of Dryden, New York
adopted a resolution on March 2BI 1995 making certain
determinations in relation to and approving the establishment of
the Snyder Hill Sewer District pursuant to Article 12 of the Town
Law, and
WHEREAS, said resolution was duly filed in the office of the
state department of audit and control in Albany, New York and
recorded in the Tompkins County clerk's Office on April 3, 1995 in
Ember 51 of miscellaneous Records at page 165, and
WHEREASt it is now desirous to change the name of the sewer
district to more accurateJy reflect the area served and to avoid
confusion with respect to the availability of sewer 8e -rvice on
Snyder Hi 11 Road, and
WHEREAS, there is presently no outstanding indebtedness of
said sewer district, and
WHEREAS, the Town Board may adopt a resolution changing the
name of the sewer district pursuant to 'Sawn Law 5198 {13 },
