followed by the Pledge of Allegiance.

of Dryden will hold a public hearing at the Town Hall, 65 East Main

COUNTY BRIEFIEO
Co. Rep. Lane - reported on parcels of land in the Town of Dryden
on Route 13 across from the Willow Olen Cemetery_ Some of the
parcels have come in the counties possession due to tax
foreclosure. This is designated a commercial park in that area.
Part of the county policy with respect to land transactions
require that each parcel before it is sold by the county to be
reviewed to see if there are any other potential uses that they
should take into consideration and see if there are any
environmental problems. Since there is a big parcel with a lot of
little parcels in the subdivision the planning department
recommended that we not go to auction with that property until we
can sae if thera might be other uses for it. The county is looking
for input from the Town with respect to that issue.
Z.O. Slatar - when that subdivision was built it was contingent
upon a service road being built. Will mail copy to Co. Rep. Lane
of requirement.

Co. Rep. Lane - reported on sales tax - the state legislature
®continues talking about repealing the sales tax on apparel
statewide. If that happens in Tompkins County that would mean a
shortfall of about $408,000.00 based on last years figures. That
is about 2.3 percent of our sales tax collection. There also would
be a similar effect on the city and towns. Some counties are
asking the state legislature to give them permission to repeal the
sales tax on apparel only at the county level no matter what the
state does. Toopkins County has been asked if they plan to do the
same, but at this point we have taken no action. We are surveying
the community for there opinion.
Co. Rep. Lane - reported on cable television - I did read the Town
of Dryden resolution regarding cable television at our last
quarterly commission meeting. We now have a committee that is
looking at cable governance models. I will report more on that
later.

the burial of their daughter, Elizabeth J. Collinsworth on said

Bill Ackro d - representing Dryden Ambulance - it has come to
their attention that there have been some short comings in the
Proposal they had for the ambulance billing software. The current
software that is available today will cost about $8,500.00. In
order to move up to that level of softwar4a it is going to cost
them another $6,000_00 in hardware, operating systems, data base,
software, etc, I could not find any significant benefit to go into
the new software that the old software wouldn't do after speaking
with the representative. If you want to go with the old proposal
of 58,500.00 with the Sweetsoft Company we are willing to go in
that direction. There is still the opportunity for the future if
you want to upgrade the program and there will be an additional
cost. There were a lot of hidden costs that we exposed.
Supv Schug - the only thing that wasn't provided for was the
travel expense, hotel and car rental.
Bill Ackroyd in their proposal it states 5495.00 per day plus
travel expense. That didn't surprise us, we just didn't factor it

Supv Schug called the meeting to order at 7:30PM
Supv Schug read the notice that was published in the newspaper
concerning the application of Edward Boutros to relocate his water
testing and analysis business. (copy in minute book)
QUESTIONS AND /OR COMMENTS
Susan Boutros - they have an environmental laboratory and do
environmental testing on water samples. They have about a dozen
employees and would like to relocate the bulk of the business to
the Ithaca /Dryden area. Right now they have space at Langmire Lab.
They would like to have the business completely in their garage
which is adjacent to the house. The permit application states 3
employees which we have at the present time. We were advised we
would have to get another permit if there were more than 3
unrelated employees. We feel we might go up to 10/12 people, but
this is going to take time. If the business does expand we would
consider moving the business to a different location. We have to
comply with EPA regulations. Since we would be living on the
property the business would be open all the times. We will not be
changing the exterior of the property, since it is in a
residential neighborhood.
Supv Schug - the EPA sounds like you will be using chemicals in
the testing and wanted to know what would be done with the water
when you are finished with the testing.
Susan Boutros - we use some chemicals. We
samples and there is some wastewater, but
are potable water. We do not handle really
like they do in a chemistry lab. They will

to NYS Route 79 of 5 feet to 10 feet. There also is limited
parking lot maneuvering space. 1 do not believe there to exist
sufficient space to permit both parking and turnaround space,
resulting in the need to back up the grade to, Slaterville Road.

positive aspect of the site would be lost if backing on to the road
were to be necessary.

The garage was built in 1,993. It is two stories high with
approximately 1860 feet of usable space. The first store has a
concrete floor, is pal-tlaJ1y insulated, and is. being used for storage.
The second store has been insulated and dry - wailed and has been
used by the current owner's family as a woodworkin.g shop. The
structure already has natural gas, water, electrical., telephone, and
septic lines,

eight cars.
The conversion of the garage to use as a water testing
laboratory will involve the following steps:
- install hisulation, drywall and finished surface to first
floor walls
- install new gas furnace
- hook -up of telephone, septic, etc. lines
- install employee restroom
- install window
- create office space
- install light fixtures and counters
enhance or replace septic s .stem
extend graded and paved areas north and south of the
building to accommodate one or mic additional parking
spaces
Environmental Associates Ltd, is a corporation (sub -S) and it is
a laboratory specializing in the defection of waterborne parasites,
filtration evaluation by nlieroscOplc particulate analysis, and
determination of ground water cinder the direct influence of surface
water. The firm plans to have three employees in the near term: an
office manager, a Senior Analyst laboratory manager, and our field
ream manager, at the 1795 Slaterville Road laboratory,
Testing samples will come into the laboratory as water
sediments on filters. The ,sam.ples will be washed with the surf cant
Tween- 0 (a Mild soap) and the sediment will be extracted, placed
on a slide, and examined under a microscope.
Some samples of the residual sediments will be archived and
the rest we intend to compost. Any life biologicals will be
ecruCoclaved before disposal in the garbage. We intend. to install a
gray water system to accommodate the waste water- generated by
the washin. g process, and to use the gray water oil our gardens.
N ,scimples or waste water used in the testing process will go
into the septic system. In terns of waste disposal, the laboratory
Will be considerably less hazardous than a calf or well nourished
brabv.

I have contacted the Tompkins County Health Department and
have attached a Certificate of Approval for the current water and
septic system. Upon purchase of the property I will upgrade the
system or construct a new one in -accordance with health department
specifications. if necessary I wilt also obtain approval from the New
York State Department of Environmental Conserva Uon.
6) 1795 Slaterville Road sits in a niostly residential area of single -
family homes on lots of one to three acres, There are single -famil y
hones at 1781 and 1805 Slaterville load, and across th.e street at
1784, 1792, and 1790 Slaterville load.
7) There will be a period of disruption during the construction
Phase of the project. Thereafter the lab will have minimal impact
on traffic and waste disposal, and will produce no noise, vibration,
10 dust, fumes, smoke, odor, fire, hazard, glare, or flashing lights.
The homes at 1781 and 1805 lie approximately 250 an.d 400
,feet, respectively, from the garage and are screened by hedgerows.
Any impacr on these properties will be slight. The neighbors at
1,784, 1792, and 1796 will experience al few cars turning into out of
the property at the beginning and er.Yd of the work day, and periodic
stops by express delivery trucks. We anticipate no impact oil the
future development of the neighborhood,

I would also take this opportunity to review a couple of other
important issues. It is important that you understand some of
the necessary qualifications of acceptable Home Occupations.
Appendix A, of the Dryden Town Zoning Ordinance, Definitions
provide: Home Occupations, "A subordinate use of a commercial or
service nature located on a lot whose primary use is residential
and which is not detrimental to the residential character of said
lot and the surrounding neighborhoods. Home occupations shall be
such things as hair dressing, tailoring, teaching, carpentry,
electrical and plumbing work and similar activities and
professional offices such as doctor, lawyers, architects and
licensed real estate brokers ". Special Permit applications,
should provide detail, that your project will fit within the
immediate neighborhood.

• terms of the original Intermunicipal Agreement and name all three entities on the discharge
permit. Recently the US EPA has developed a consolidated permits program which appears to
address a multiple permiee policy. For this reason, the federal form is being used however it is
being submitted to your office as NYS is the approval authority for the permitting program.
By submission of the attached Consolidated Pen-nit Application form and this cover letter, the
City of Ithaca, Town of Ithaca and the Town of Dryden herein request that page 1 of the SPDES
No. NY 0026638, "Pennittce Name” be amended to read:
The communities presently act as one entity in regards to the POTW as evidenced by the
administration of the Industrial Pretreatment Program which makes no distinction between them.
However, the US EPA has indicated concern over the lack of total enforcement capabilities by
the City within the Town of Dryden. Such capabilities are necessary as the City is named on the
pen-nit. This concern is addressed with the Town named on the permit.
The Joint Sewer Agreement of 1984, approved of by each municipality and signed by the
principal executive officers clearly illustrates that each municipality agreed to be named on the
permit.

the following sections specifically. These sections further signify the shared efforts and
liabilities of the individual entities.

Amend Discharge Permit
Refer to Section 9, Operation, which states: "All parties to this agreement shall be named as
permittee on the SPDES Permit for the Ithaca Area Waster Treatment Plant.
Refer to Section 3, Title to Property, which states: "Title to all real property and improvements
thereon, including the wastewater treatment plant site location and the rights -of -way to jointly
owned sewer lines and other facilities shall vest in the parties hereto as tenants in common in
proportions outlined in Appendix I."
Refer to Section 11, Responsibility for damages and claims, which states: "In the event any
liability is asserted against any of the parties hereto arising out of the construction, operation, or
maintenance of this joint project, the parties shall be jointly and severally liable for the defense
and payments of any such claims."
Refer to Section 13 which states that the oversight of the jointly owned wastewater treatment
facility will be by a subcommittee named the Special Joint Subcommittee (SJS) and composed
of 8 members from the three municipalities.
The attached application form does not provide sufficient room for the signatures of the three
principal executive officers however Item XIII of the application does allow that the Chairman
of the Special Joint Subcommittee may be designated to sign the form.
Authorization of the Chairman of the Special Joint Subcommittee to sign the attached
application is herein verified by the signatures of the principal executive officers affixed to this
cover letter.

Zoning Board of Appeals
The ZBA met to hear two requests. One, applicant requested
adjournment until May so that their attorney could be
present. The second hearing was held and approved.
Planning Board
The Planning Hoard held (2) sketch conferences. One was for a
proposed 8 lot subdivision on the former James Clarke property on
Mt. Pleasant Road between NYS Route 1066 and Turkey Hill Road.
After much discussion about, Turkey Hill Water & Sewer, Road
Safety & the Railroad easement and the Towns desire for
recreational use of said easement; Developer Mike Hovance, decided
to revise the plan to 7 lots, cut the road cuts in half. He will
provide a new plat at a second sketch conference to be held on
• Thursday, May 15th, 1997.
The second sketch conference, proposed to modify a proposed
West Dryden — Wood Road Subdivision which has not yet completed
sketch conference stage. Since this action was proposed by a
future buyer, the board recommended to buyer to have the developer
include this proposal within the original subdivision plan rather
than have two subdivision ongoing for the same property.
The reason for current hold on the primary action is the need
for further wet land identification by DEC once spring growth is
established.

from their jurisdiction. I have not received anything from either
agency at this time, nor have I received their parking plan. I
have not yet received a response from County Planning and their
recommendation under 239L &M.
Susan Boutros - some of the work they do does not come under the
EPA regulations. (Gave copy of Qualifications for ICR Microbial
Testing to Z.O. Slater). I don't need EPA regulations until I do
ICR work.

Z.O. Slater - you did, but I felt it was inadequate for that site
to park in front and along the side of the building because it
limited the ability to maneuver, turn around and drive out of the

Atty Perkins - for the boards information the ordinance defines
home occupation as a subordinate use of a commercial or service
isnature located on a lot whose primary use is residential and which
is not detrimental to the residential character of said lot and
the surrounding neighborhood. Home occupations shall be such
things as hair dressing, tailoring, teaching, carpentry,
electrical and plumbing work and similar activities, and
professional offices such as doctors, lawyers, architects and
licensed real estate brokers. The board can use this as guidance.
Joseph Westbrook - I am also concerned about ground and well
water. I have not heard any plan if there is an emergency with
contaminated samples.

lot of faith that packaging scientifically you wouldn't be
endangered by her business. Partly because of the nature of her
business and because she conducts herself very professionally. If
it were next door to me this would not be a problem knowing what
she does. I think in having her relocate her business to this area

environmental protection this would be valuable to jobs in the
long run. If we can work out some of the concerns I would strongly
support this application some way or the other, even if it is
temporary.
Margaret Hobby, sales person for Audrey Edelman - I am compiling
this purchase offer and there is space at the back of the building
for parking so it would be screened from the neighbors.
Supv Schug - asked Henry if we had a parking plan or a turn around
plan.
Z. 0. Slater - I do not have either of the plans although they
were requested. Their site plan shows the driveway and the area
that is developed.
Supv Schug - we need an official parking plan, where you are going
to put it, how many cars and where they are going to park. UPS and
Federal Express turn around. The proposed hours of operation and
how many people working there. These are the questions that need
to be answered.
Supv Schug - suggested she work with Henry to find out the
required number of parking spaces needed, but you are going to
have to tell us how many people are going to be there and how many
cars. The Town Board can approve the business for you and your
family. If you are going to only have a couple of people outside
of your family you don't need to go to the ZBOA. The board needs
more definite information to help the neighborhood. We don't want
to micro manage your business, but if it is a safe project great.

You will have to come back to the board with a parking plan,
stated hours of operation, disposal of gray water and number of
employees. If there are more than 3 unrelated people you will have
to go to the ZBOA for a variance and them come back to the Town
Board.
Supv Schug - wanted to know if the Health Department had approved
the septic system and the gray water system.
Z.O. Slater - I have asked for that information and have not yet
received it.
Information needed for the town board - good parking plan, hours
of operation, number of employees, health department approval and
gray water recycling. All information should be available before
June 10th board meeting.
