TOWN BOARD MEETING
• HEARING - UNSAFE STRUCTURE

Supv Schug called the meeting to order at 7:30PM

QUESTIONS AND /OR COMMENTS
Z.O. Slater - received a letter from Mr. Loeven stating he has a
purchase offer from Mr. Charles Paladino who wants to buy the
property at 164 Dryden - Harford Rd. but is contingent upon the barn
being saved and being capable of being repaired. They have
contacted Rick Lazarus for repairing the barn. He is unable to do
the job until next spring. I don't have a problem with this if
they do 3 things. 1- stabilize the building with an acceptable
construction plan until spring, 2- erect a fence or other type of
acceptable enclosure around what would be a fall zone if the barn
were to collapse and to prevent entry by unauthorized persons in
general and 3- agree to a time frame for repair beginning sometime
in the spring and finishing in an acceptable time 30/60/90 days
and the enclosure to remain in place until the project is
• finished.
Atty Theisen - reported the owner would agree to those conditions
only if Mr. Paladino would agree to undertake those requirements.
Mr. Loeven was planning on demolishing the barn, but it is the
buyer who wants to keep the barn so it would be Mr. Paladino who
would have to agree to the conditions.

through there is an agreement by the new owner that repairs should

town is free to act without prejudice to go ahead and do it.
Supv Schug - if Mr. Loeven knows he is not going to sell the
property he had better get it torn down or stabilized or the town
will take care of it.

to remember Sarah Hajney and Jennifer Bolduc and the families
involved.

COUNTY BRIEFING
Co. Rep. Evans - the county is working on the budget. The county
administration recommendation is for a 6 percent increase in
taxes. The program committees are asking for a 10 percent
increase. I think by the time it reaches the county board it will
be less than 6 percent. I would like it 3 percent.
Co. Rep. Evans - the committee did approve $100,000.00 flood
mitigation project. The State is asking for clarification for the
grant money.
Supv Schug - wanted to know about the sales tax relief for 1 week.
Co. Rep. Evans - this will be coming before the board at their
next meeting and I support this. If Tompkins County does not waive
the sales tax review you will see major promotions from the big
malls in
other counties.
It
does
not make
sense to put our
merchants
in this county
in
an unfavorable
situation.
RESOLUTION #201 SUPPORT SALES TAX RELIEF
Clp Roberts offered the following resolution and asked for its
adoption:
RESOLVED, that this Town Board supports the sales tax relief
proposed for the 3rd week of January 1997.

CITIZEN PRIVILEGE OF THE FLOOR
Steve Kirsh - Youth Commission - This year both of the villages
requested more than the full amounts from what they normally
receive from the State and County. The commission feels since it
is rightfully village money that the village needs a program which
we review in light of the other proposed programs. We serve many
residents throughout the town including the villages. If we had to
pull back on some of their funds without any programs we would
like to feel we could do that. Right now our hands are tied. At
some point in the future we could meet with the mayors and look at
the by laws.
Supv Schug - when the youth commission first started both villages
said they would give the town the money and we would ask for the
matching funds. The town agreed to do this and now they are
gradually asking for it back and looking for their own programs. I
do not understand since both villages are on the commission.
Steve Kirsh - the commission looked

Clp T. Hatfield - received a letter from Mrs. Henderson requesting
a noise ordinance. She was experiencing some problems so I asked
her to put it in writing so the board members could review this
and understand her problems. I expressed my concerns to her and
issues of difficulty in defining noise. One concern she mentioned
was calling the State Police and Sheriffs Dept. to assist in
quieting noisy parties that were nearby. Both parties refused to
cooperate since there was no noise ordinance on the books.
Zorika Henderson, 7 Sunny Knoll Rd. - requested the town board to
consider a noise ordinance. In the case of the party the State
Police were called at 2:30AM. In the case of the Sheriffs Dept. it
was someone building a house at 5:OOAM. The sheriff did stop by,
but they weren't able to do anything.

Z.O. Slater - that is what my thoughts were, but Mrs. Henderson
tells me that is incorrect. Based on levels of decibels acceptance

Z.O. Slater - they would definitely exceed it since I have done
several studies for the Wilcox Press site and several others. If
you slam a fire door you have violated it. If you have somebody
who has an axe to grind with someone next door I don't want to be
responsible for responding to that at 2:OOAM. It is obvious where
2 people are aggravated with each other we become the yo yo in the
situation. I would need an interpretation as to who would enforce
the ordinance.
Atty Perkins - it wouldn't necessarily be a zoning ordinance. It
could be done by local law.

Z.O. Slater - I hope that the town board would weigh the benefit
to the many. We have never had any complaints other than loud
party complaints and I have explained this to Mrs. Henderson.
Zorika Henderson - also complained about the noise from Finger
Lakes Stone at early hours in the morning. I have spoken with Mr.
Ormsby and he seemed concerned but nothing has been done about
working in the early morning.
Z.O. Slater - they are working under a DEC permit and would have
to contact DEC for the hours that are permitted.
Dave Putnam - in one of the snow belt counties they had to revise
their noise ordinance because people could not run their snow
blowers before 7:OOAM therefore couldn't get out of their
driveways to go to work.
Z.O. Slater - wanted to know how this would effect the farmer and
the right to farm law.

Supv Schug - there is a lot the town board will have to look and
. make sure it would be carefully drafted.
Clp T. Hatfield - the Town of Dryden is not the Town of Ithaca.
You have a larger piece of real estate and more diversified base
and community. This will have to be looked at long and hard to
make any sense. I don't understand why if there is a complaint
about a noisy party going on that the Sheriff's Dept. or State
Police couldn't respond. It seems like a reasonable request. I
don't feel you need special legislation for that.

when

noise.
Supv Schug - will check, but would like to hear from the Sheriffs
Dept. and the State Police as to why they didn't close down the
noisy parties when they had received the complaint. We will keep
in contact with you as to what is happening.

Z.O. Slater - we have a setback requirement within the Dryden Town
mining special permit specifications that are to be recommended to
DEC for a potential permit if one was to be issued. We have a
setback that precludes anybody from having any mining activity
within 325 feet from any boundary, municipal line, any road or
anything of that nature and 1000 feet from any residence. The
parcel of the proposed operation is about 1300 feet wide. If that
was enforced with what you have to consider for mining wall slope
you greatly restrict the area with which you have to extract any
material from. It might be reasonable to restrict the mining from
1000 feet from any residential structure. DEC setback for a slope
is 25 feet. I think this should be considered as to how much we
should be involved with the permit.
Supv Schug - DEC is asking the town that once DEC receives and
declares a complete application the town hold a public hearing.
Z.O. Slater - after DEC reviews the completed application DEC has
a 30 day public comment period and the town is to hold our public
hearing during that time. DEC will keep the town updated as to
where the schedule is. Once the 30 day period is closed they would
like the towns special permit recommendations to come in during
the 30 day process so they can become part of the permit.
Supv Schug - it was suggested that Hart Road be abandoned. I would
rather see the setback reduced on their property for mining and
keep Hart Road a town road open for the health, safety and welfare
of the people since it is a back entrance to George Junior
Republic,
Atty Perkins - in order to put a culvert under Mott Road RMS
Gravel has to get a permit and a franchise from the town. This
agreement sets forth those conditions of that franchise for the
installation, maintenance and the rule of the culvert there. There
is a question as to what percent of annual gross revenues the town
would want to set aside to insure and guarantee the performance of
all of the obligations. The franchise requires a public hearing
which should be held the same time you have your special permit
hearing. Gave board members a copy of franchise for the culvert
under the highway and conveyor for their review.

RESOLUTION NO. 202 - 1996
• Councilperson T. Hatfield offered the following
resolution and asked for i.ts adoption:
WHEREAS, the Town Superintendent of Highways has presented to
the Town Board a written description of certain Town highways (or
portions thereof) that in his opinion appear to have not become
wholly disused, but for the previous two (2) years have not been
usually travelled along the greater part thereof, by more than two
(2) vehicles daily in addition to pedestrians and persons on
horseback, and
WHEREAS, the Town Board has satisfied itself as to the
accuracy and completeness of such description of those Town
highways and that they appear to the Town Board to be appropriate
for a qualified abandonment thereof, and
WHEREAS, Highway Law Sections 205(2) and 205 -b(1) prescribes
the procedure to be followed to effect a qualified abandonment of
certain Town highways,
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
10 It appears that the following Town highways are eligible
for a qualified abandonment thereof:
• CARD ROAD: Beginning at a point 700 feet east
of the intersection of Signal Tower
Road and proceeding easterly for
approximately 1,660 feet, to the
westerly boundary of tax parcel #50-
1-2.1
CORNELIIIS ROAD: Extending from 200 feet from Hunt
Hill Road north for approximately
1720 feet to within 485 feet from
the intersection with Midline Road
29 The Superintendent of Highways of Tompkins County is
requested to hold a public hearing on such qualified abandonment
pursuant the provisions and procedures prescribed in Highway Law
Section 205(2) and Section 205- b(1)(a),
3. Copies of this resolution shall be certified by the Town
Clerk and distributed as follows:

Atty Perkins - Lailani Kay to Town of Dryden - I have not heard
from Mr. Westcotts attorney. He did have some kind of a contract
and wanted assurance the town was going to accept the road since
he had complied with all of the requirements. I wrote to Mr.
Westcotts attorney and assured him what our policy was and the
conditions the Planning Board had imposed on their approval.

• Dave Putnam - Bone Plain Road drainage - Hwy Supt Gilbert did not
have any luck getting Mr. Ellis to sign an easement. I did find
several other places where a culvert could be installed but do not
think this will correct the problem. The town could make a deep
ditch and would be the least cost to construct and the most impact
on the neighbors. This would help to dry out some of their soil.
Supv Schug - wanted to know if this would jeopardize the stability
and usability of the town road.
Hwy Supt Gilbert - no, this does not have any impact on the road.
Supv Schug - since the town has already spent money for a drainage
study and if it doesn't impact the town road and only will solve a
couple of neighbors problems, does the town want to get into
putting a ditch through Ellis property and then having to maintain
its

consideration for public demolition by public hearing at the
October 8th Town Board meeting. The barn has not been stabilised
but a building permit has been filed for demolition and repairs in
conformance with the time schedules established during the October
8th public hearing. At this time, the potential new owner has
•asked that I not issue the appropriate permit until the closing
has occurred, scheduled for some time during the week of 11/11/96.

meet.
Planning Board
The Planning Board met to conduct a sketch conference for a
proposed minor subdivision lot modification. Finding the proposal
to conform to all applicable requirements, the board choose to
hold a public hearing for the proposal at their November session.

tracking program. This will permit you to see how your special
approval projects progress.
Once a Site Plan Review or Special Permit project has been
approved, it will appear on the appropriate sheet with the

RESOLUTION #204 ACCEPT LOW BID FOR PLOW EQUIPMENT
Clp Roberts offered the following resolution and asked for its
adoption:
RESOLVED, that this Town Board accept the low bid of $17,271.00
from Seneca Supply for snow plow equipment.
2nd Clp T. Hatfield Roll call vote - all voting Yes
Supv Schug - letter sent to board members from Hwy Supt Gilbert
regarding equipment for auctions. He received information and made
a very good decision regarding selling highway equipment. I think
Don should be commended on making good an informed on the spot
decision.
RESOLUTION #205 SEASONAL LIMITED USE HIGHWAYS
Clp T. Hatfield offered the following resolution and asked for its
adoption:
RESOLVED, that this Town Board accept the following list of
seasonal limited use highways upon the recommendation of Highway
Superintendent Don Gilbert. These roads will not be plowed nor
maintained from November 1996 through April 1997. The roads will
be posted with the appropriate signs and the Town Clerk shall post
such notice at the Town Hall.
14 - Hile School Road - from #147 Ed Hill Road west to within
approximately 500 feet of Route 38.
24 - Yellow Barn Road - from Dusenbury Sports Club north to
#368 a distance of approximately 4224 feet.
30 - Signal Town Road - from Card Road north to the power
lines.

notices for the Town Clerk to publish and post. In fact, we even
prepared a letter for her signature sending the notice of adoption
to The Ithaca Journal.
The notices and letter to The Ithaca Journal were hand delivered to
the Town Clerk who was instructed verbally several times to make
sure that the notices were published and posted as required by law.
It was suggested to the Town Clerk that she hand deliver the notice
The Ithaca Journal or that she FAX it to them. She elected to mail
the notice which apparently either was not done in a timely fashion
or was received by The Ithaca Journal and misplaced. I don't know
for sure what happened but I do know that the notice was not
published as required by law.
The action of the Town Board on September 3, 1996 is therefore void
ak initio. The Board must adopt another resolution at the October
8 Board Meeting and the Town Clerk must publish and post notice of
the adoption as required by law. The resolution appropriating the
sum of money is not effective until 30 days after the adoption of
the resolution, notice of adoption is posted and published and no
petition for a referendum has been filed with the Town Clerk.

consideration by the Town Board at its regular meeting October 8.
By copy of this letter I am advising T.G. Miller, P.C. of the delay

A RESOLUTION APPROPRIATING $41,000 OF THE TOWN
OF DRYDEN, TOMPKINS COUNTY, NEW YORK, TO PAY
THE COST OF PREPARING A MAP, PLAN AND REPORT
IN CONNECTION WITH THE PROPOSED ESTABLISHMENT
OF A NEW WATER DISTRICT IN SAID TOWN IN AN
AREA OF SAID TOWN NOT INCLUDED WITHIN THE
BOUNDARIES OF ANY EXISTING WATER DISTRICT OR
INCORPORATED VILLAGE.
WHEREAS, Section 209 -b of the Town Law authorizes any Town to
adopt a resolution, subject to a permissive referendum,
appropriating a specific amount of monies to pay the cost of
preparing a map, plan and report in connection with the
establishment
of a proposed
improvement district
not included
within the
boundaries of
any existing water
district or
incorporated village; and
WHEREAS, it has been proposed to establish a new water

WHEREAS, it is now desired to appropriate monies of said Town
